Mayor Bernard L. McKinley in the Chair. Roll Call: Dell, Fox, Angel, Wright, Budak, Brown. Absent: Buck. Invocation by: Councilperson Tony Budak Pledge of Allegiance: Troop 11 --Tim Perry, Jared McCammon, James Mishler, Ryan McCammon 97271 - Moved by Angel, seconded by Fox that the Agenda, as amended, for the Regular Session on April 15, 1991, at 7:00 p.m., and the Minutes of the Regular Session on April 8, 1991, at 7:00 p.m., be accepted and approved. Motion carried. Mayor McKinley presented Certificates of Recognition to five members of the West High School Bowling Team for winning the 22nd Annual Boys State Bowling Team. HEARINGS 97272 - Moved by Dell, seconded by Wright that proof of publication of notice of public hearing on the site plan request of Venture Store for property generally located on the west side of Crossroads Boulevard and north of Flammang Drive, as published in the Waterloo Courier on April 5, 1991, be received and placed on file. Motion carried. 97273 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Brown, seconded by Dell that the hearing be closed and recommendation of approval of the Planning, Programming and Zoning Commission be received and placed on file. Motion carried. 97274 - Moved by Dell, seconded by Fox that "Resolution approving the site plan for Venture Store for property generally located on the west side of Crossroads Boulevard and north of Flammang Drive", be adopted. Ayes: Six. Absent: Buck. Resolution adopted and upon approval by Mayor assigned No. 1991-198. PETITIONS FROM PUBLIC 97275 - Moved by Angel, seconded by Brown that communication from City Planner transmitting request of the U.S. Postal Service to rezone from "C-2" Commercial District to "C -Z" Conditional Zoning District property located at 3551 University Avenue on the southeast corner of University Avenue and South Hackett Road, together with recommendation of denial of the Planning, Programming and Zoning Commission, be received, placed on file and "Resolution setting date of hearing as May 6, 1991 at 7:00 p.m. in the City Hall Council Chambers on the above described request", be adopted and Clerk/Auditor instructed to publish notice of same. Resolution adopted and upon approval by Mayor assigned No. 1991-199. 97276 - Moved by Angel, seconded by Brown that communication from Assistant City Engineer transmitting request from Cedar Valley Corporation for a variance of Chapter 25.5 of the Noise Ordinance from April 15, 1991 to September 27, 1991 in conjunction with F.Y. 1991 Street Reconstruction Program, Contract No. 400, together with recommendation of approval, be received, placed on file and "Resolution approving above described request", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1991-201. 97278 - Moved by Angel, seconded by Brown that communication from City Engineer transmitting request of Warren Transport for a temporary concrete driveway to be located at the 300 block of Vaughn Street, together with recommendation of approval, be received, placed on file and "Resolution approving said request", be adopted. DOCUMENTS 97279 - Moved by Budak, seconded by Angel that communication from Assistant City Engineer transmitting construction plans for Hess Road sanitary sewer extension to Black Hawk County Landfill and Treatment Agreement DNR Form 29 (Dec. 86) with the Department of Natural Resources, together with recommendation of approval, be received, placed on file and approved and Mayor authorized to execute same. RESOLUTIONS TO BE ADOPTED 97280 - Moved by Wright, seconded by Angel that "Resolution by the City Council of the City of Waterloo, Iowa, as the Waterloo Housing Authority, adopting submission of an application to the U.S. Department of Housing and Urban Development for Comprehensive Improvement Assistance Program Funds for Modernization of Ridgeway Towers, IA -50-3", be adopted. Ayes: Six. Absent: Buck. Resolution adopted and upon approval by Mayor assigned No. 1991-203. 97281 - Moved by Wright, seconded by Angel that "Resolution amending Resolution No. 1990-649 approving the Final Plat of Waterloo Country Club First Addition in the City of Waterloo, Iowa", be adopted. BILLS PAYMENT 97282 - Moved by Angel, seconded by Wright that "Resolution approving Schedule A918, pp. 1-51, in the amount of $269,485.25, dated April 15, 1991, copies of which are on file in the Clerk/Auditor's Office", be adopted. NEW BUSINESS 97283 - Moved by Fox, seconded by Dell that communication from Public Works Director transmitting recommendation of appointment of Gary Simmons to the position of Water Pollution/Flood Control Superintendent, Tim Shea to the position of Wastewater Facilities Supervisor, and Jack Loynachan to the position of Operations Coordinator for the Water Pollution/Flood Control Department, effective immediately, be received, placed on file and approved. Motion carried. 97286 - Moved by Fox, seconded by Dell that communication from Superintendent of Water Pollution/Sewer Departments transmitting recommendation of appointment of Terry Corcoran to the position of Operator I for the Water Pollution Control Plant, subject to passing of physical examination, be received, placed on file and approved. Motion carried. 97287 - Moved by Fox, seconded by Dell that communication from City Engineer transmitting recommendation of appointment of Curtis Neff to the position of Engineer Technician, subject to passing physical examination, be received, placed on file and approved. Motion carried. Travel Requests 97288 - Moved by Brown, seconded by Wright that the following travel requests, with expenses not to exceed amount shown, be received, placed on file and approved: 1. John Meyer, Public Works Director, to attend Designing Stormwater Quality Management Practices Seminar at Madison, Wisconsin, on June 10-13, 1991, with costs not to exceed $1,045.00. 2. Heinz A. Hofmann, Police Sergeant, to attend Driver Instructor Training Program in Artesia, NM on April 22 -May 3, 1991, with costs not to exceed $602.00, including the use of city vehicle. Motion carried. BONDS Page 4 97290 - Moved by Angel, seconded by Dell that the report of the City Attorney and list of bonds filed with the Clerk/Auditor through April 15, 1991, be received, placed on file and report and bonds approved. Motion carried. ORAL PRESENTATIONS 97291 - Kathy Oberle, 710 Forest Avenue, asked whether the city owned the property located at 522 West Ninth Street. She explained that it is in bad disrepair and a hazard to the neighborhood. She also questioned the expenditure of the Fire Department for travel expenses to Waverly, Iowa, which was a recent topic of the "Call the Courier". She stated that this was not a wise use of taxpayers' money if the employees' lodging was paid for while attending the seminar. Assistant Fire Chief Frank Magsaman stated that several members of the department did attend an overnight seminar in Waverly with all expenses paid by the city. Ms. Oberle also questioned a recent mailing to all garbage customers advising them of safe ways to dispose of yard waste. She stated that several households had received duplicate copies and questioned this additional cost. John Meyer, Public Works Director, stated that the notices were generated utilizing current garbage customer lists through the Black Hawk County Data Processing Department. This duplication is being investigated. Moved by Brown, seconded by Budak that the above oral comments be received and placed on file and the Council adjourn at 7:25 p.m. Motion carried. Larry P.
