96825 - Moved by Buck, seconded by Wright
that the Agenda, as proposed, for the Regular Session on January 14, 1991, at
7:00 p.m., and the Minutes of the Regular Session on January 7, 1991, at 7:00
p.m., be accepted and approved. Motion carried.
HEARINGS
96826 - Moved by Angel, seconded by Wright
that proof of publication of notice of public hearing on request of Kathy Long
to vacate, sell and convey the westerly 115 feet of Wyandotte Street, as
published in the Waterloo Courier on January 2, 1991, be received and placed on
file. Motion carried.
96827 - HOLD HEARING --This being the time and place of public hearing, the Mayor called
for written and oral objections and there were none.

that the hearing be closed and the recommendation of approval of the Planning,
Programming and Zoning Commission, be received and placed on file. Motion
carried.
96828 - Moved by Fox, seconded by Dell
that "an Ordinance vacating the westerly 115 feet of Wyandotte Street, subject
to signing sanitary sewer easement agreement", be received, placed on file,
considered and passed for the first time. Ayes: Seven. Motion carried.
96829 - Moved by Budak, seconded by Brown
that rules requiring ordinances to be considered and voted for passage at two
prior meetings, be suspended. Ayes: Seven. Motion carried.
96830 - Moved by Dell, seconded by Buck
that the following ordinance be recorded as having been considered and passed
for the second and third times and now placed on its final adoption. Ayes:

96831 - Moved by Wright, seconded by Angel
that "an Ordinance vacating the westerly 115 feet of Wyandotte Street, subject
to signing sanitary sewer easement agreement", be adopted. Ayes: Seven.

96832 - Moved by Angel, seconded by Buck
that "Resolution authorizing sale and conveyance of the westerly 115 feet of
Wyandotte Street to Kathy Long in the amount of $254.38, plus costs", be
adopted and City Attorney instructed to prepare and deliver a deed accordingly.

that communication from City Planner transmitting recommendation to rescind
Resolution No. 1990-531 authorizing the vacation, sale and conveyance of
unimproved Eola Street, Hutchman Avenue and the portion of Creston Avenue
between Osage Avenue and Dubuque Road to Phillip Hamilton due to an incorrect
legal description and requesting that a new date of hearing be set, be
received, placed on file and "Resolution setting date of hearing as February 4,
1991, at 7:00 p.m. in the City Hall Council Chambers on the above request", be
adopted and Clerk/Auditor instructed to publish notice of same. Ayes: Seven.

that communication from Community Development Administrator transmitting
recommendation of award of contract to American Demolition Corp. of Cedar
Rapids, Iowa, in the amount of $533,400 for the F.Y. 1991 Rath Demolition
Project, Phase I, be received, placed on file and "Resolution approving said
contract", be adopted. Ayes: Seven.

Transportation application to Adopt -A -Highway for litter removal along Highway
57 Interchange at U.S. Highway 218 and Highway 57, be received, placed on file

execute same. Ayes: Seven.

that communication from Transportation Program Manager transmitting a
Professional Service Agreement with Brice, Petrides -Donohue Co. for

II CRS, IX -6560(4)--79-07, together with recommendation of approval, be
received, placed on file and "Resolution approving said agreement", be adopted
and Mayor authorized to execute same. Ayes: Seven.

that communication from City Engineer transmitting recommendation of approval
of Appraisal Contract with Al Little (Appraisal Associates) in the amount of
$550.00 in conjunction with the Crossroads Drainage Improvement Project, be
received, placed on file and "Resolution approving said contract", be adopted
and Mayor authorized to execute same. Ayes: Seven.

that communication from City Engineer transmitting Detour Agreement with Iowa
Department of Transportation in conjunction with the resurfacing of Highway 63
from Almond Street to Arlington Street, FN -63-6(56)--21-07, together with
recommendation of approval, be received, placed on file and tabled for one
week. Motion carried.
RESOLUTIONS TO BE ADOPTED
96840 - The Mayor announced that the time had arrived for discussion on a proposed
resolution of clarification concerning the upcoming referendum on the local
option sales and services tax. He stated that the resolution was to clarify
that any sanitary sewer replaced as a part of the reconstruction/repair or
replacement of existing streets would be paid for from sanitary sewer funds and
not from the sales tax revenues.
Vonnie Jackson, 1838 Howard Avenue, objected to the resolution and questioned
the need for the clarification.
Kathy Oberle, 710 Forest Avenue, stated that her interpretation of this
resolution was that it would allow for the construction of the Fifth and Sixth
Street Extension project.
Mayor McKinley responded by stating that the local option sales and services
tax would allow for the reconstruction of existing City streets that are in
poor condition. Currently, the City spends approximately $1.5 million per year
(General Obligation Bond funds) for repair of the City's major arterial
streets.
Moved by Buck, seconded by Brown
that "Resolution of Intent clarifying Resolution No. 1990-566 calling for a
public referendum to authorize the imposition of the local sales and services
tax in the City of Waterloo, Iowa, at the rate of one percent (1%) to be
effective April 1, 1991", be adopted. Ayes: Seven.
Resolution adopted and upon approval by Mayor assigned No. 1991-15.
ORDINANCES TO BE ADOPTED
96841 - Moved by Buck, seconded by Wright
that "an Ordinance amending the 1988 Traffic Code by adding a new Subsection
(290a) Webster Street to Section 551, Parking Prohibited at all Times on
Certain Streets (prohibiting parking on Webster Street on the south side from
Ankeny Street to North Barclay Street)", be received, placed on file,
considered and passed for the second time.
Prior to a vote on this ordinance, City staff was instructed to inform adjacent
property owners of the proposed parking change prior to the third reading of
the ordinance.
A vote was taken on the above ordinance with the following results: Ayes:
Seven. Motion carried.

that "Resolution approving Schedule A918, pp. 1-57, in the amount of
$1,218,130.16, copies of which are on file in the Clerk/Auditor's Office", be
adopted. Ayes: Seven.

that communication from Transportation Program Manager transmitting request to
sell excess right-of-way generally located off Ansborough Avenue between
Devonshire Drive and West Fourth Street in conjunction with Ansborough Avenue,
IX -6615(3)--79-07, be received, placed on file and "Resolution setting date of
hearing as February 4, 1991 at 7:00 p.m. in the City Hall Council Chambers on
the sale of said excess right-of-way to the highest bidder with a minimum bid
of $150,000", be adopted and Clerk/Auditor instructed to publish notice of
same. Ayes: Seven.

Travel Requests
96844 - Moved by Brown, seconded by Wright
that the following travel request, with expenses not to exceed amount shown, be
received, placed on file and approved:
1. Kevin Blanshan, Associate Planner, to attend IWRA Course on Introduction
to Property Management in Plymouth, Minnesota on February 11 and 12, 1991,
with costs not to exceed $470.00, including the use of City vehicle.

that the report of the City Attorney and list of bonds filed with the
Clerk/Auditor through January 14, 1991, be received, placed on file and report
and bonds approved. Motion carried.
ORAL PRESENTATIONS
96847 - Roger Martin, 1324 South Street, referenced a $25 parking ticket violation he
received for parking in the 600 block of West Fifth Street, a priority one snow
route. He had received the ticket and did not have prior warning of the
proclamation of the snow emergency since he is a truck driver and had just
re-entered town.
Mayor McKinley explained that the Public Works Committee had reviewed the
procedures enacted during the recent snow emergency (January 10-11, 1991). The
Mayor stated that the snow declaration ordinance states that no car should be
parked on snow routes during a snow emergency. Cars are not allowed to park on

any street until after the emergency has been declared canceled. Police Chief
Koehrsen stated that it is necessary that snow emergency routes be kept clear
and free of traffic to allow the timely removal of snow and provide emergency
access to all portions of the community.

that the above oral comments be received and placed on file and the Council
adjourn at 7:43 p.m. Motion carried.
