Mayor Albert C. Manning, Jr. in the Chair. Roll Call: Dell, Fox, Angel, Buck, Wright, Brown. Absent: Budak. Invocation by: Councilperson Dave Buck Pledge of Allegiance: David Kline, Troop #17 98807 - Moved by Buck, seconded by Angel that the Agenda, as amended, for the Regular Session on Monday, January 27, 1992, at 7:00 p.m., and the Minutes of the Regular Session on Tuesday, January 21, 1992, at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS AND BIDS 98808 - Moved by Angel, seconded by Buck that proof of publication of notice of public hearing on plans, specifications, form of contract, etc. and taking of bids for Relocated Westfield Avenue Construction, Contract No. 419, as published in the Waterloo Courier on January 10, 1992, be received and placed on file. Motion carried. 98809 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were' none. Moved by Brown, seconded by Wright that "Resolution confirming the approval of plans, specifications, form of contract, etc., in conjunction with said project", be adopted. Ayes: Six. Absent: Budak. Resolution adopted and upon approval by Mayor assigned No. 1992-27. 98810 - Moved by Fox, seconded by Dell that "Resolution ordering construction", be adopted. Ayes: Six. Absent: Budak. Resolution adopted and upon approval by Mayor assigned No. 1992-28. 98811 - Moved by Buck, seconded by Brown to receive, file and instruct Deputy Clerk/Auditor to open and read bids and refer to City Planner for review and recommendation (award delayed): Base Bid Base Bid Bidder Bid Bond + Alt. HEARINGS 98812 - Moved by Dell, seconded by Brown that proof of publication of notice of public hearing on revisions to the Waterloo Traffic Code, as published in the Waterloo Courier on January 10, 1992, be received and placed on file. Motion carried. 98813 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. January 27, 1992 Page 2 Hearing - continued 98814 - Moved by Angel, seconded by Wright that "an Ordinance adopting the 1991 Traffic Code for the City of Waterloo, Iowa, be received, placed on file, considered and passed for the first time. Ayes: Six. Absent: Budak. Motion carried. 98815 - Moved by Buck, seconded by Dell that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended. Ayes: Six. Absent: Budak. Motion carried. 98816 - Moved by Dell, seconded by Angel that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Six. Absent: Budak. Motion carried. 98817 - Moved by Brown, seconded by Buck that "an Ordinance adopting the 1991 Traffic Code for the City of Waterloo, Iowa", be adopted. Ayes: Six. Absent: Budak. Ordinance adopted and upon approval by Mayor assigned No. 3842. DOCUMENTS 98818 - Moved by Brown, seconded by Buck that communication from City Planner/Transportation Program Manager transmitting Certification of Completion and Final Acceptance of Agreement for work performed by IPS Electric, Midwest Gas in conjunction with Ansborough Avenue North Reconstruction, IX -6615(7)--79-07, together with recommendation of approval, be received, placed on file and "Resolution approving said document", be adopted and Mayor authorized to execute same. Ayes: Six. Absent: Budak. Resolution adopted and upon approval by Mayor assigned No. 1992-29. RESOLUTIONS TO BE ADOPTED 98819 - Councilperson Brown questioned the proposed penalty. It was reported that this penalty is a mandatory imposition required by Chapter 123 of the State Code of Iowa. This penalty is a violation of the Alcoholic Beverages Division of the Department of Commerce and must be imposed either by the local authority or the State of Iowa. Moved by Brown, seconded by Buck that "Resolution imposing a $300 penalty for sale of an alcoholic beverage to persons under the legal age limit for the following establishments: Cadillac Lanes, Inc., 650 LaPorte Road; Ware and McDonald Oil Co dba as Wareco, 1355 Lafayette Street; and Midtown Foods, 710 Broadway Streets", be adopted and Deputy Clerk/Auditor authorized to notify said establishments. Ayes: Six. Absent: Budak. Resolution adopted and upon approval by Mayor assigned No. 1992-30. 98820 - Forest Dillavou, 718 Nevada Street, asked why the City of Waterloo is in the real estate business and questioned the need for the City to buy the property and then sell it to Deere and Company. Don Temeyer, Planning and Development Director, stated that the City will be selling the property to Deere and Company at the same price as we are purchasing it from the state. The property is excess right of way and would not be of value to anyone except the adjacent property owner which will be the buyer. Resolution adopted and upon approval by Mayor assigned No. 1992-31. 98821 - Moved by Brown, seconded by Buck that "Resolution setting date of hearing as February 17, 1992 at 7:00 p.m. in the City Hall Council Chambers on the sale and conveyance of property generally located between McKinley Street and Jefferson Street, and south of Westfield Avenue to Deere and Company", be adopted and Deputy Clerk/Auditor instructed to publish notice of said hearing. Ayes: Six. Absent: Budak. Resolution adopted and upon approval by Mayor assigned No. 1992-32. 98822 - Moved by Brown, seconded by Buck that "Resolution authorizing submission of an application to the Iowa Department of Transportation for Revitalize Iowa's Sound Economy (R.I.S.E.) funding in the amount of $130,000 for Tower Park Access Road, Phase II - East Segment", be adopted and Mayor authorized to execute same. Ayes: Six. Absent: Budak. Resolution adopted and upon approval by Mayor assigned No. 1992-33. ORDINANCES TO BE ADOPTED 98823 - Moved by Fox, seconded by Angel that "an Ordinance dividing the City of Waterloo, Iowa, into wards and precincts and repealing Ordinance No. 3824", be received, placed on file, considered and passed for the second time. BILLS PAYMENT 98831 - Moved by Angel, seconded by Wright that "Resolution approving Schedule A918, pp. 1-47, dated January 27, 1992, in the amount of $934,685.68, copies of which are on file in the Clerk/Auditor's Office", be adopted. Travel Requests 98832 - Moved by Brown, seconded by Wright that the following travel requests, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Paul Huting, Superintendent of Resources, to attend annual Great Lakes Park Training Institute in Angola, Indiana on February 24-26, 1992, with costs not to exceed $350.00, including the use of city vehicle. 2. Rick Tagtow, Director of Parks and Forestry, to attend International Society of Arboriculture - Midwestern Chapter Annual Conference and Trade Show in Bismark, North Dakota on February 12-14, 1992, with costs not to exceed $315.00, including the use of city vehicle. 3. Todd Derifield, Forestry Coordinator, to attend International Society of Arboriculture Midwestern Chapter Annual Conference and Trade Show in Bismark, North Dakota on February 12-14, 1992, with costs not to exceed $315.00. 4.
