ASSESSMENT HEARING 102092 - Moved by Buck, seconded by Fox that proof of publication of notice of public hearing on F.Y. 1994 East Park Avenue Ramp Expansion, Contract No. 467, as published in the Waterloo Courier on October 22, 1993 and October 29, 1993, be received and placed on file. Ayes: Six. Absent: Wright. Motion carried. 102093 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections. Don Temeyer, Planning and Development Director, stated that the original ramp was constructed in 1984 and was assessed to surrounding property owners for a 13 -year period. The agreement with the property owners stipulated that if the City collected incremental taxes from the Tax Increment Financing District (TIF) to pay the total cost of the ramp, the remaining assessments would be abated. Five years remain on the assessment. However, a serious need for additional parking area has been identified. Additionally, the City has received a preliminary indication that an Economic Development Administration Grant would be available to assist in financing another level on the ramp. Currently, 67 percent of the property owners and 86 percent of the taxable value in the area have agreed to sign an agreement authorizing the City to extend the original assessment over a 13 -year period to finance this portion of the ramp. John Rathjen, 614 Glencoe Avenue and speaking on behalf of the Waterloo Redevelopment Authority, supported the proposed ramp expansion. Roger Olesen, representing Olesen-Simonsen Realty Co., supported the proposed ramp assessment based upon an acceptable agreement for fire inspections with the Waterloo Fire Department (see CR 102080 of November 8, 1993) and the eventual continuation of the skywalk from the Waterloo Building to Blacks to the ramp. In response to a question from Councilperson Lemke, Mr. Temeyer stated that a current parking deficiency of 250 parking spaces has been identified on the East Side and another approximately 800 stalls short if all vacant property in the downtown was leased. The eventual completion of the parking lot under the viaduct between West Sixth Street and Park Avenue will add approximately 295 spaces. The ramp were provide an additional 163 spaces. Further, he supported the positive image it would bring to the downtown. Milt Roth, 932 Prairie Meadow Court and chair of the committee that developed the proposed ordinance, clarified that the ordinance was not a recommendation of the City, but represented the thoughts of the majority of businesses in the downtown area. He further stated that it was not an anti Frank Hardie Advertising ordinance but was a pro -active approach to revitalization of the downtown. Many have worked hard in developing the ordinance. Brian Nicols, 750 McCoy Road, Evansdale, stated that the ordinance was patterned after a successful demonstration in Galena, Illinois. He stated that with the proposed Silos and Smokestacks Project and specific mention of downtown revitalization in the City's Leap to the Future, the ordinance will assist in both areas. Councilperson Lemke expressed his support of the proposed ordinance. Ayes: Six. Absent: Wright. Motion carried. 102105 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections. Bob Stevenson, City Planner, stated that the Planning, Programming and Zoning Commission had recommended on a vote of six to two that the Church's request to vacate the alley be approved at no cost subject to the church paying for publishing and recording fees. City policy requires that public property be sold based upon the assessed value of surrounding property. The Commission's reason for varying from the policy was that the church had maintained and used the property for over 65 years without knowledge that it was street right of way and only discovered approximately one year ago when the church property was surveyed. He stated that City staff feels that the Commission's recommendation could set a very unreasonable precedent for conveying City property at no cost. In response to a question from Councilperson Lemke, Mr. Stevenson noted that public right of way has been sold to other churches in the community ranging in price from 25 cents to 75 cents per square foot. He noted that property was purchased from Zion Lutheran Church in conjunction with the Sixth Street Corridor Project at a cost of $60,000 for 11 parking spaces. Councilperson Angel suggested that a minimal charge be assessed, perhaps 25 cents per square foot. Mr. Stevenson noted that the church will be utilizing the proposed area for parking and handicap access. Donna Lesyshen, 500 Sheridan Road, an attorney and a member of the First Presbyterian Church, stated that the property in question has been used and maintained by the church since 1925. She contended that the City's policy does not apply in such a case, and that the Council should follow the recommendation of the Planning, Programming and Zoning Commission. She stated that the City cannot give property away but could sell it for a minimal consideration. Jim Walker, 440 Kingbard Boulevard and an elder of the First Presbyterian Church, requested that the City convey the property at no cost. He stated that the church has been a good neighbor and has provided monetary resources and labor to revitalize Lincoln Park after sustaining considerable tree damage during the windstorm of July 1993. Councilperson Dell stated that this church has done a lot for kids in the community.
