Mayor John R. Rooff in the Chair. Roll Call: Jordan, Collier, Krizek, Mollenhoff, Anders, Murphy, Getty. Invocation by: Reverend George Howard, Christian Fellowship Baptist Church, 7th & Wellington Streets Pledge of Allegiance: Youth Group Community Baptist Church, Mary Reed, Leader Recognition of Week: Covenant Medical Center, Ray Burfeind, President Mayor Rooff recognized and congratulated Councilperson Scott Jordan on being named the "1993 Volunteer of the Year" by the Up-Downtowners. Mayor Rooff thanked Louis Cutwright, Building Official, for the new "wood scrolled" nameplates on the council table. 102621 - Mollenhoff/Collier that the Agenda, as proposed, for the Regular Session on Monday, March 14, 1994, at 7:00 p.m., be accepted and approved. Ayes: Seven. Motion carried. 102622 - Murphy/Jordan that the Minutes, as proposed, for the Regular Session on Monday, March 7, 1994, at 7:00 p.m., be accepted and approved. Ayes: Seven. HEARINGS 102623 - Murphy/Collier that proof of publication of notice of public hearing on request of Deere and Company to vacate, sell and convey Westfield Avenue (formerly Miles Street) for $10,413.00, as published in the Waterloo Courier on March 7, 1994, be received and placed on file. Ayes: Seven. Motion carried. 102624 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Getty/Mollenhoff that the hearing be closed. Ayes: Seven. Motion carried. 102625 - Jordan/Anders that "an Ordinance vacating Westfield Avenue (formerly Miles Street)", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 102626 - Murphy/Collier that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 102627 - Krizek/Collier that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 102628 - Collier/Jordan that "an Ordinance vacating Westfield Avenue (formerly Miles Street)", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4006. 102629 - Mollenhoff/Krizek that "Resolution authorizing sale and conveyance of Westfield Avenue (formerly Miles Street) to Deere and Company for $10,413.00", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-75. 102630 - Collier/Jordan that "Resolution approving an Addendum to Agreement with Deere & Company in conjunction with construction of Relocated Westfield Avenue, sewers and other improvements", be adopted and Mayor and Acting Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-76. REPORTS 102634 - Jordan/Krizek that communication from Administrative Assistant transmitting revised travel policy be deferred for one week. Ayes: Seven. Motion carried. DOCUMENTS 102635 - Anders/Murphy that communication from City Engineer transmitting an agreement with the Iowa Northern Railway Company for railroad signal improvements at West llth Street and the Iowa Northern Railway Company tracks north of northbound Washington Street, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Acting Clerk/Auditor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-78. 102636 - Jordan/Collier that communication from Personnel Director transmitting recommendation to authorize Mayor to sign and execute the addendum to the collective bargaining agreement between the City of Waterloo and International Association of Fire Fighters Local #66 for a two-year wage settlement, be received, placed on file and "Resolution approving said Addendum", be adopted and Mayor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-79. RESOLUTIONS TO BE ADOPTED 102637 - Mollenhoff/Jordan that "Resolution authorizing the City Clerk to certify necessary debt service tax levy to pay interest on General Obligation Bonds to be issued in Fiscal Year 1994 for the City of Waterloo", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-80. ORDINANCES TO BE ADOPTED 102638 - Anders/Mollenhoff that "an Ordinance amending the 1991 Traffic Code by repealing Subsection (73) Washington Street/Highway 218 of Section 541, Increasing Speed Limits in Certain Areas; and enacting in lieu thereof a new Subsection (73) Washington Street/Highway 218 of Section 541, Increasing Speed Limits in Certain Areas (increasing speed limit on Washington Street/U.S. Highway 218 from West 8th Street to Mitchell Avenue from 35 mph to 45 mph)", be received, placed on file, considered and passed for the first time. NEW BUSINESS 102647 - Jordan/Collier to instruct City Engineer to prepare plans, specifications, form of contract, etc. for F.Y. 1994 Concrete and Structure Repair Program, Contract No. 468, be received, placed on file and approved. Resolution adopted and upon approval by Mayor assigned No. 1994-84. 102654 - Getty/Collier that "Resolution setting date of hearing on plans, specifications, form of contract, etc., and taking of bids as March 28, 1994, at 7:00 p.m. in the City Hall Council Chambers on the above project", be adopted and Acting Clerk/Auditor instructed to publish notice of hearing accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-85. 102655 - Murphy/Collier that the final schedule of assessment in conjunction with the reconstruction of Relocated Westfield Avenue, sewer and other improvements be received and placed on file. Motion carried. 102656 - Jordan/Collier that "Resolution authorizing the levying of assessments in the amount of $146,592 to Deere & Company in conjunction with Relocated Westfield Avenue", be adopted. Travel Requests 102657 - Getty/Murphy that the following travel request, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Richard Grimm, Street/Sanitation Department Superintendent, to attend the 42nd Annual American Public Works Association's Public Works Conference in Ames, Iowa on March 17-18, 1994, with costs not to exceed $151.75, including the use of city vehicle. Ayes: Seven. Motion carried. 102658 - Mollenhoff/Krizek that the following travel request, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Simmons, Water Pollution/Flood Control Superintendent, to meet with Iowa representatives regarding a site specific grant in the 1994 Appropriation Legislation in Washington, D.C. on March 16-18, 1994, with costs not to exceed $1,241.90. Motion carried. 102664 - Anders/Murphy that "Resolution recommending that the Park Board decline to enter into a lease for the Municipal Stadium with Waterloo Professional Baseball, Inc. unless fair compensation is received by the City", be deferred indefinitely. Ayes: Seven. Motion carried. ORAL PRESENTATIONS 102665 - Tom Powers, President of International Association of Fire Fighters Local #66, presented the following statement. Waterloo's Fire Fighters and city representatives recently completed several rounds of intense and spirited contract negotiations. The end product of those "give and take" sessions was under consideration this evening. A fair and equitable agreement will balance the needs of our families and the financial well being of the city. In the face of last year's freeze, we, of course, hope for higher gains, but as taxpayers we are also sensitive to the financial conditions of our city and the determined efforts of this governing body to reduce operating costs. I would personally like to thank everyone involved in our contract settlement, Personnel Director Jim Rodemeyer and Assistant City Attorney Sang Ki -Han. We now look forward to moving ahead with this partnership toward other common goals, such as the expansion and enhancement of all levels of protection to the citizens of this community and the entire Cedar Valley area.
