Mayor John R. Rooff in the Chair. Roll Call: Jordan, Collier, Krizek, Mollenhoff, Anders, Murphy, Getty. 102535 - Anders/Mollenhoff that the Agenda, as proposed, for the Regular Session on Monday, February 21, 1994, at 4:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. 102536 - Assistant City Attorney Sang -Ki Han stated that labor negotiation strategy is an approved topic of Executive Session as authorized by Iowa Code Section 21.9. Anders/Mollenhoff that the Council adjourn to Executive Session. Ayes: Seven. Motion carried. EXECUTIVE SESSION 102537 - Krizek/Collier that the Council adjourn the Executive Session. Ayes: Seven. Motion carried. 102541 - Mollenhoff/Jordan that proof of publication of notice of public hearing on the "S-1" Shopping Center District site plan for a proposed Toys R Us Store to be generally located between Crossroads Boulevard and LaPorte Road, south of the Bonanza Restaurant, as published in the Waterloo Courier on February 11, 1994, be received and placed on file. Ayes: Seven. Motion carried. 102542 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Murphy/Collier that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission be received and placed on file. Ayes: Seven. Motion carried. 102543 - Anders/Krizek that "Resolution approving said site plan", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-44. 102544 - Mollenhoff/Murphy that proof of publication of notice of public hearing on "S-1" Shopping Center District site plan for a proposed Power Center Phase II to be generally located southwest of the intersection of Flammang Drive and Crossroads Boulevard and east of the Crossroads Hy -Vee Store, as published in the Waterloo Courier on February 11, 1994, be received and placed on file. Bruce Radue (Schenk Engineering), representing Mr. Gerald Schoenfelder, the developer, wanted to go on record that they have not agreed to the 25 percent or any percentage in regard to participation of a traffic signal for this location Getty/Jordan that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission and oral and written comments be received and placed on file. Ayes: Seven. Motion carried. 102546 - Collier/Krizek that "Resolution approving said site plan", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-45. 102547 - Collier/Anders that proof of publication of notice of public hearing on sale and conveyance of former Resolution Trust Corporation property generally located at 316 Butler to Robert and Rose Duncan for $16,000, as published in the Waterloo Courier on February 15, 1994, be received and placed on file. Ayes: Seven. Motion carried. 102548 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Motion carried. 102549 - Anders/Jordan that "Resolution authorizing sale and conveyance of former Resolution Trust Corporation property generally located at 316 Butler Street for $16,000 to Robert and Rose Duncan", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-46. UNFINISHED BUSINESS 102550 - Mollenhoff/Jordan that communication from City Engineer transmitting Change Order Nos. 4 and 5 for a net increase of $2,494.00 for work to be performed by Prairie Construction Co., Inc. in conjunction with Partial Interior Renovation of Former East Side Library (deferred from February 7 and 14, 1994 meeting), be received, placed on file and approved and Mayor authorized to execute same. PETITIONS FROM PUBLIC 102551 - Jordan/Getty that petitions in opposition of the removal of the stoplight and crosswalk located at West Fourth Street and Hubbard Avenue be received and placed on file. DOCUMENTS 102552 - Getty/Jordan that communication from Executive Director of the Waterloo Housing Authority transmitting Change Order No. 1 for a net increase of $7,882.53 for work to be performed by Beck -Ericson, Inc. in conjunction with Waterloo Housing Authority Family Housing Development Construction of 10 Family Public Houses, be received, placed on file and approved and Mayor authorized to execute same. RESOLUTIONS TO BE ADOPTED 102555 - Mollenhoff/Krizek that "Resolution setting date of hearing as March 7, 1994 at 7:00 p.m. in the City Hall Council Chambers on sale and conveyance of former Resolution Trust Corporation property generally located at 716 West 9th Street to Joan M. Brockway for $26,000", be adopted and Acting Clerk/Auditor instructed to publish notice of same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1994-49. 102556 - Jordan/Collier that "Resolution approving Revision #1 to the Waterloo Housing Authority 1993- 1994 Operating Budget for Ridgeway Towers Apartments, 225 W. Ridgeway Avenue, Project No. IA050003 to procure security camera system and ADA compliance of public restrooms", be adopted. Ayes: Seven. BILLS PAYMENT 102560 - Krizek that "Resolution approving Schedule A918, pp. 1-60, in the amount of $1,468,740.01, dated February 21, 1994, a copy of which is on file in the Clerk/Auditor's office, with the deletion of Warrant Voucher 85831 in the amount of $569.48", be adopted. NEW BUSINESS 102561 - Anders/Mollenhoff that communication from City Planner transmitting request for a time extension from December 31, 1993 to December 31, 1994 to allow Peterson Contractors, Inc. an opportunity to complete work on the East Lake Bike Trail, Contract No. 437, be received, placed on file and "Resolution approving said request", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1994-55. 102562 - Krizek/Collier that communication from Mayor John Rooff transmitting recommendation of appointment of Bob Molinaro to the Community Development Board effective immediately to replace J. February 21, 1994 Page 4 Travel Requests 102563 - Getty/Jordan that the following travel requests, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Jim Knavel, Street Foreman, Decker, Equipment Operator I Iowa 35th Annual Workshop in costs not to exceed $390.00, Herb Thompson, Street Foreman, and Bobby , to attend Asphalt Paving Association of Des Moines, Iowa on March 3-4, 1994, with including the use of city vehicle. 2. Willie Keller and Dave Mohlis, Police Officers, to attend Advanced Technical Traffic Accident Investigative Training in Johnston, Iowa on April 18-29, 1994, with costs not to exceed $1,250.00, including the use of city vehicle. 3. John Daws, Police Officer, to meet with President and Cabinet Members in Washington, D.C. to discuss the D.A.R.E. Program on February 25-26, 1994, with costs not to exceed $522.00. 4. Dean Woelber, Paramedic, to attend 5th Annual Fire School in Ames, Iowa on February 26-27, 1994, with costs not to exceed $137.50. Ayes: Seven. Motion carried. MISCELLANEOUS 102564 - Anders/Murphy that the following beer and liquor license permit applications be received, placed on file and approved and endorsed applications be forwarded to the Iowa Beer and Liquor Control Department: 1. BONDS 102565 - Getty/Collier that the report of the City Attorney and list of bonds filed with the Clerk/Auditor's office through February 18, 1994, be received, placed on file and report and bonds approved. Ayes: Seven. Motion carried. ORAL PRESENTATIONS 102566 - Bruce Kaesser, 1730 Easton Avenue, asked about the status of his garbage exemption. Mr. Kaesser was informed it would be on the Finance Committee agenda of Monday, February 28, 1994, and that he would receive a letter as to the time. Charlotte Yuza requested that the City Council take a serious look at installing traffic lights at Orange Road and the west entrance to Hawkeye Community College, and also at Orange Road and Highway 21. Her 6 year old daughter, Ashley, was hit by a car on February 8, 1994 at the intersection of Orange Road and the west entrance to Hawkeye Community College. She has heard that the City was interested in doing a survey on traffic at these intersections. She presented a copy of a "Traffic Parking Study for Hawkeye Community College" prepared by Shive-Hattery Engineers on December 14, 1993. It was pointed out that the City of Waterloo did erect "School Bus Stop Ahead" signs on both sides of the school to at least inform people that school buses do stop there as a temporary solution until a study is done. Jordan/Mollenhoff to receive and place on file the "Traffic Parking Study For Hawkeye Community College" prepared by Shive-Hattery Engineers and refer the document to the City Engineer for review and report back as soon as possible.
