Mayor John R. Rooff in the Chair. Roll Call: Jordan, Collier, Krizek, Mollenhoff, Anders, Murphy, Getty. Invocation by: Reverend Steve Hein, Pastor at Westminster Presbyterian Church Councilperson Collier requested everyone to join him in a moment of silence for a great Civil Rights Leader, Dr. Martin Luther King, Jr. Pledge of Allegiance: Boy Scout Troop No. 13, William Bengston, Leader --Aaron Bengston, Jesse Fettkether, Nathan Harmon, Brian Petullo, Mike Petullo, Tim Poots Mayor Rooff presented a certificate of recognition and proclamation to Fitzgerald's Grill & Pub, 360 E. Krizek/Jordan that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission and written and oral comments be received and placed on file. Motion carried. 102426 - Murphy/Krizek that "an Ordinance vacating property formerly dedicated for paralleling Airport Boulevard, south of the Boy Scout building", be on file, considered and passed for the first time. Ayes: Seven. 102427 - Jordan/Mollenhoff street purposes received, placed Motion carried. that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 102428 - Collier/Murphy that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 102429 - Mollenhoff/Collier that "an Ordinance vacating property formerly dedicated for street purposes paralleling Airport Boulevard, south of the Boy Scout building", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4000. 102430 - Murphy/Jordan that "Resolution authorizing sale and conveyance of property formerly dedicated for street purposes paralleling Airport Boulevard, south of the Boy Scout building, to Larry Drager for $1,800.00", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. January 18, 1994 Page 2 REPORTS 102431 - Murphy/Jordan that communication from Community Development Administrator transmitting request for a time extension from January 1, 1994 to February 28, 1994 to allow Peterson Contractors, Inc. an opportunity to complete all work on the Rath Demolition Project, Phase II, except the final placement and grading of the topsoil and seeding which would be extended to June 1, 1994, be received, placed on file and approved. DOCUMENTS 102432 - Mollenhoff/Anders that communication from Assistant City Engineer transmitting an agreement with the Department of Correctional Services, 314 East Sixth Street, to construct a lift station on public right of way between the sidewalk and property line near their building, together with recommendation of approval, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Acting Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1994-15. 102433 - Getty/Mollenhoff that communication from City Engineer transmitting Contingency Allowance Change Order No. 2 for a net increase of $638.00 for work to be completed by Prairie Construction Co., Inc., in conjunction with Partial Interior Renovation of Former East Side Library, Contract No. 465, be received, placed on file and approved and Mayor authorized to execute same. Motion carried. 102434 - Getty/Murphy that communication from City Engineer transmitting Change Order Nos. 2 and 3 for a net increase of $14,989.00 for work to be completed by Prairie Construction Co., Inc. in conjunction with Partial Interior Renovation of Former East Side Library, Contract No. 465, be received, placed on file and approved and Mayor authorized to execute same. Motion carried. 102435 Murphy/Collier that communication from Executive Director of Waterloo form of Memorandum of Agreement between the Waterloo Valley Area Agency on Aging for case management of 25 for the Hope for Elderly Independence Program be "Resolution approving said agreement", be adopted and authorized to execute same. Housing Authority transmitting Housing Authority and Hawkeye eligible frail elderly persons received, placed on file and Mayor and Acting Clerk/Auditor Resolution adopted and upon approval by Mayor assigned No. 1994-16. 102436 Anders/Jordan that communication from Executive Director of Waterloo Housing Authority transmitting form of Memorandum of Agreement between the Waterloo Housing Authority and Hawkeye Valley Area Agency on Aging for case management of 15 eligible frail elderly tenants at Ridgeway Towers, 225 W. Ridgeway, for the Congregate Housing Services Program be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Acting Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1994-17. 102437 - Jordan/Murphy that communication from Acting Fire Chief transmitting final Change Order for a net increase of $2,989.84 for work to be completed by Huff Contracting in conjunction with Hazardous Material Regional Training Center be received, placed on file and approved and Mayor authorized to execute same. Motion carried. 102438 - Mollenhoff/Getty that communication from Planning and Development Director transmitting Preliminary Plat of Crossroads Plat No. 6, together with deed of dedication and approval of the Planning, Programming and Zoning Commission, be received, placed on file and "Resolution approving said preliminary plat", be adopted. January 18, 1994 RESOLUTIONS TO BE ADOPTED 102439 - Murphy/Mollenhoff Page 3 that "Resolution setting date of hearing as February 7, 1994 at 7:00 p.m. in the City Hall Council Chambers on the sale and conveyance of property generally located at 2206 Clearview to Mrs. Ruby Oden for $20,000", be adopted and Acting Clerk/Auditor instructed to publish notice of same and City Attorney instructed to prepare necessary documents to accept the deed for 57 Mulberry Street previously sold to Mrs. Oden. ORDINANCES TO BE ADOPTED 102440 - Mollenhoff/Anders that "an Ordinance amending the 1993 Code of Ordinances by repealing Section 2-28, Addressing the Chair, of Division 2, Rules of Order, of Article II, The Council, of Chapter 2, Administration; and enacting in lieu thereof a new Section 2-28, Addressing the Chair, of Division 2, Rules of Order, of Article II, The Council, of Chapter 2, Administration (addressing the chair)", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 102441 - Collier/Krizek that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 102443 - Mollenhoff/Collier that "an Ordinance amending the 1993 Code Addressing the Chair, of Division 2, Rules Chapter 2, Administration; and enacting Addressing the Chair, of Division 2, Rules Chapter 2, Administration (addressing the of Ordinances by repealing Section 2-28, of Order, of Article II, The Council, of in lieu thereof a new Section 2-28, of Order, of Article II, The Council, of chair)", be adopted. Ordinance adopted and upon approval by Mayor assigned No. 4001. 102444 - Anders/Murphy that "an Ordinance amending the 1991 Traffic Code as it pertains to daily lot fees, monthly parking, city parking lots, no turn allowed at red lights at certain intersections, speed limits in certain areas, loading zone on Walnut Street on the north side in the 300 block, prohibiting parking at all times on certain streets, no parking between signs on Heartland Hills on the west side in the 1200 block, no parking here to corner on sections of Bayard Street, W. Fifth Street, W. Fourth Street, Independence Avenue, E. Second Street and Sixth Street (W), Brookeridge, Dale Street, Locke Avenue, and St. Francis Drive", be received, placed on file, considered and passed for the first time. Ayes: Seven. Peg Moses, Human Rights Commissioner, to attend Urban Potential/E.E.O. Seminar in Waterloo on February 17-18, 1994, with costs not to exceed $295.00. 2. Jim Sullivan, Maintenance Electrician, to attend seminar on fundamentals of actuated and pretimed controller operation and the theory and operation of loop detectors, in Spencer, Iowa on March 16-17, 1994, with costs not to exceed $170.00, including the use of city vehicle. 3. Randy Heiberger, Signal Technician II, and Charles G. Linker, Signal Technician Foreman, to attend seminar on the intersection detector count station and fast techniques for developing coordination plans to include traffic responsive set up in St. Peters, Missouri on February 23-24, 1994, with costs not to exceed $170.00, including the use of city vehicle. BONDS 102452 - Murphy/Jordan that the report of the City Attorney and list of bonds filed with the Clerk/Auditor through January 18, 1994, be received, placed on file and report and bonds approved. Ayes: Seven. Motion carried. ORAL PRESENTATIONS 102453 - Mayor Rooff stated that the Waterloo Police Tactical Unit was called out today. This was their 67th mission since 1989 without incident. Councilperson Getty stated he was unhappy with the condition of our streets, with no sand being applied to them. He had several calls today in regard to various intersections. He stated the intersections are a catastrophe waiting to happen as they are very slick. Councilperson Krizek stated she had the same questions as Councilperson Getty, and she was told the street department was sanding. She stated she came from a meeting at the airport, and there was no sand on the streets she had traveled, which were fairly heavy traveled roads. John Meyer, Public Works Director, responded that with the wind chill we have had, the sand was simply freezing on the trucks and the trucks had to be parked indoors. He stated they will be going out tonight at midnight with warm sand, warm trucks and will be addressing the situation and have sand at the intersections for the morning commute. He will have basically 8 loads that will do all the priority streets but not the residential. Councilperson Mollenhoff stated he, as well as Councilperson Krizek, would suggest we call the members of the press to issue a public service message so the public could be informed as to what is happening. It would be a user friendly move on the city's part. Getty/Murphy that the above oral comments be received and placed on file. Ayes: Seven. Motion carried.
