The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 7:00 p.m., on Monday, January 10, 1994. Mayor John R. Rooff in
the Chair. Roll Call: Jordan, Collier, Krizek, Mollenhoff, Anders, Murphy, Getty.
Invocation by: Pastor David Rainey, Gift of Life Ministry
Pledge of Allegiance: Gift of Life Junior Sunday School Class
Mayor Rooff presented a certificate of recognition and proclamation to Nate Mays, Jr.,
President of NECA Car Care, Inc.
Mayor Rooff read a proclamation declaring the Year 1994 Iowa Year of the Family.
Mayor Rooff recognized Randy Shepard, Mitchell Bond and Leonard Zmolek for their work on
construction of a ramp to allow handicap accessibility to the council chambers.

that the Minutes, as proposed, for the Organizational meeting on Monday, January 3,
1994, at 11:00 a.m., and the Minutes, as proposed, for the Regular Session on Monday,
January 3, 1994, at 7:00 p.m., be accepted and approved. Ayes: Seven. Motion
carried.

102394 - Krizek/Anders
that the request of Lockard Development for a site plan amendment for a portion of
the "C-2" Commercial District/"C-Z" Conditional Zoning for future development of
property generally located on the southwest corner of Janney and Fletcher Avenues,
as published in the Waterloo Courier on December 29, 1993, be received and placed on
file. Ayes: Seven. Motion carried.
102395 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for
written and oral objections and there were none.

that "Resolution approving said site plan amendment", be adopted. Ayes: Seven.

that proof of publication of notice of public hearing on request of Virgil Kohagen
to sell and convey property generally located along the rear of Prescotts Drive in
Southland Park for $832.87, as published in the Waterloo Courier on December 29,
1993, be received and placed on file. Ayes: Seven. Motion carried.

that proof of publication of notice of public hearing on request of Petcor N.A.
Corporation for a three-year extension of the "C -Z" Conditional Zoning District for
property generally located along the southerly side of U.S. Highway 20, north of K -
Line Drive for continued use of site as a contractor's storage yard for heavy
construction vehicles and equipment through December 31, 1996, as published in the
Waterloo Courier on December 29, 1993, be received and placed on file. Ayes: Seven.

that rules requiring ordinances to be considered and voted for passage at two prior

that the following ordinance be recorded as having been considered and passed for the

that "an Ordinance amending Ordinance No. 2479, as amended, City Zoning Ordinance by
adding Subsection No. 51 to Section 2A -7N Conditional Rezoning Certain Property,
subject to an annual review of the site", be adopted. Ayes: Seven.

that the petition from residents requesting de -annexation of an area known as
Sherwood Park be deferred until preliminary cost studies are completed based on work

Cedar Valley Corporation in conjunction with F.Y. 1992 Street Reconstruction Program

that communication from Associate Engineer transmitting completion of project and
recommendation of acceptance of work performed by Cedar Valley Corporation in

be received, placed on file and "Resolution approving said document", be adopted.

that "Resolution setting a new date of hearing as January 24, 1994 at 7:00 p.m. in
the City Hall Council Chambers due to error in original legal description on sale and
conveyance to Chicago & North Western Transportation Company for $1,049.00 for
Disposal Parcel Nos. 11, 12, 13, and 50 in conjunction with Martin Luther King Jr.
Drive project and rescinding Resolution Nos. 1992-671 and 1992-672 in their
entirety", be adopted and Acting Clerk/Auditor instructed to publish notice of same.

that "an Ordinance amending the 1993 Code of Ordinances of the City of Waterloo,
Iowa, by repealing Section 14-2, Uniform Fire Code Adopted, and Section 14-3, Life
Safety Code Adopted, of Chapter 14, Fire Prevention and Protection; and enacting in
lieu thereof a new Section 14-2, Uniform Fire Code Adopted, and a new Section 14-3,
Life Safety Code Adopted, of Chapter 14, Fire Prevention and Protection (adopt 1991
Edition of the Uniform Fire Code and 1991 Edition of the Life Safety Code) ", be
received, placed on file, considered and passed for the first time. Ayes: Seven.

a $15,000 grant from the Emergency Shelter Grants Program (ESGP) to repair their roof
