Mayor John R. Rooff in the Chair. Roll Call: Anders, Jordan, Murphy, Getty, Krizek, Collier, Mollenhoff. Invocation by: Joyce Wilder, Ambassadors for Christ Church Pledge of Allegiance: Dennis Girsch, Troop 17, Kingsley School Recognition of Week: John Deere Community Credit Union, Jean Trainor, CEO 105747 - Mollenhoff/Jordan that the Agenda, as amended, for the Regular Session on Monday, November 6, 1995 at 7:00 p.m., be accepted and approved. Ayes: Seven. Motion carried. 105748 - Jordan/Collier that the Minutes, as proposed, for the Regular Session on Monday, October 23, 1995 at 7:00 p.m., be accepted and approved. Ayes: Seven. Motion carried. Mayor Rooff read a Proclamation declaring the week of November 5-11, 1995 as Radiologic Technology Week. Mayor Rooff recognized the promotion of Mike Zimmerman to the position of Fire Inspector and Jeff Hedrington and Carl Reninger to the position of EMS Coordinator. Mayor Rooff received a Certificate of Appreciation from LAFNOW Neighborhood Association. HEARINGS 105749 - Krizek/Collier that proof of publication of notice of public hearing on request of BDC Investments to vacate the eight foot utility easements generally located on either side of the southwesterly line of Lot 13, in Richland Park to allow construction of the Factory Card Outlet Store on Flammang Drive, as published in the Waterloo Courier on October 24, 1995, be received and placed on file. Ayes: Seven. Motion carried. 105750 - HOLD HEARING --This being the time and place of public hearing the Mayor called for oral and written objections and there were none. Murphy/Jordan that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission be received and placed on file. Ayes: Seven. Motion carried. 105751 - Jordan/Collier that "an Ordinance vacating the eight foot utility easements located on either side of the southwesterly line of Lot 13 in Richland Park", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 105752 - Murphy/Jordan that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 105753 - Krizek/Collier that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 105754 - Mollenhoff/Collier that "an Ordinance vacating the eight foot utility easements located on either side of the southwesterly line of Lot 13 in Richland Park", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4133. 105755 - Anders/Murphy that proof of publication of notice of public hearing on request of Powers Manufacturing to vacate, sell and convey the alley generally located between E. llth Street and vacated Union Street, southerly of Lafayette Street for $3,979.50, plus costs, as published in the Waterloo Courier on October 24, 1995, be received and placed on file. Ordinance adopted and upon approval by Mayor assigned No. 4134. 105761 - Mollenhoff/Collier that "Resolution authorizing sale and conveyance of the alley generally located between E. llth Street and vacated Union Street, southerly of Lafayette Street to Powers Manufacturing for $3,979.59, plus costs", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. UNFINISHED BUSINESS 105762 - Mollenhoff/Collier that communication from Building Official transmitting recommendation of award of contract in the amount of $109,991.00 to Greenley Development Co. of Independence, Iowa in conjunction with the 1995 Accessibility Remodeling Projects, be received, placed on file and "Resolution approving award of said contract", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1995-678. PETITIONS FROM PUBLIC 105673 - Jordan/Collier that communication from City Engineer transmitting request of Howard M. Van Note for a waiver for a concrete driveway to be located at 321 Belle Street, together with recommendation of approval, be received, placed on file and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1995-679. 105764 - Mollenhoff/Anders that communication from Jack W. Overlie appealing decision by the Waterloo Historic Preservation Commission denying request to construct a 24 x 32 foot detached garage with vinyl siding on property located at 326 Highland Boulevard and located in the Highland Historic District, be received, placed on file and "Resolution setting date of hearing as November 20, 1995 at 7:00 p.m. in the City Hall Council Chambers on the above described appeal", be adopted and City Clerk instructed to publish notice of same. DOCUMENTS 105765 - Anders/Mollenhoff that lease agreement with Carco, Inc. dba Iowa Tube Bending and Fabricating for use of storage building located at 504 Clay Street for the period of November 1, 1995 through November 30, 1995, be received, placed on file and "Resolution approving said lease agreement", be adopted and Street Superintendent authorized to execute same. RESOLUTIONS TO BE ADOPTED 105767 - Getty/Collier that "Resolution approving renewal of Annual Contributions Contract (A.C.C.) No. IAO50V00025 to replace two Section 8 Housing Voucher Contracts No. IA05V00012/0013 which expire on November 30, 1995", be adopted and Mayor authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1995-683. 105768 Mollenhoff/Collier that "Resolution authorizing the placement of the Bishop Avenue North Extension on the Federal Functional Classification map in order to fund the construction of Bishop Avenue between Martin Luther King, Jr. Drive and Newell Street using Revitalize Iowa's Sound Economy (RISE) and State Transportation (STP) funds", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1995-684. 105769 - Anders/Jordan that "Resolution authorizing and directing the City Clerk to destroy certain records and papers as provided in Section 372.13(5) of the 1995 Code of Iowa", be adopted. ORDINANCES TO BE ADOPTED 105770 - Getty/Collier that "an Ordinance amending the 1993 Code of Ordinances of the City of Waterloo, Iowa, by repealing Article I, Taxicabs, of Chapter 36, Vehicles for Hire; and enacting in lieu thereof a new Article I, Taxicabs and Limousines, to Chapter 36, Vehicles for Hire", be received, placed on file, considered and passed for the third time. Motion carried. 105771 - Collier/Jordan that "an Ordinance amending the 1993 Code of Ordinances of the City of Waterloo, Iowa, by repealing Article I, Taxicabs, of Chapter 36, Vehicles for Hire; and enacting in lieu thereof a new Article I, Taxicabs and Limousines, to Chapter 36, Vehicles for Hire", be adopted. NEW BUSINESS 105773 - Krizek/Collier that communication from Waterloo Water Works General Manager transmitting request of William C. and Jeanne Russell to certify $1,462.80 for work performed by the waterloo Water Works at 926-928 Commercial Street, be received, placed on file and "Resolution approving said request", be adopted and City Clerk instructed to notify the Black Hawk County Treasurer of same. Ayes: Seven. Motion carried. ORAL PRESENTATIONS 105777 - Pierre Denault, 205 Lovejoy, thanked all elected officials for their service to the community on the eve of the election. Denault reported his concern for the public health as a result of open burning. The allowance of open burning shows a disregard for the health concerns of persons with breathing problems. The public should be aware that open burning can hurt the health of the public. He suggested persons suffering as a result of open burning document the complaints and file them with the appropriate regulatory agency or join in a lawsuit. Ernie Boykin, PO Box 1438, rose to give thanks to the members of the Rooff Team. She noted that she has kept a list of the promises made by the team and feels satisfied with their effort to meet those promises.
