HomeMy WebLinkAbout09/05/95COUNCIL WORK SESSION September 5, 1995 5:30 p.m. Large Conference Room Members present: Mayor Rooff, Anders, Jordan, Getty, Krizek, Collier, Murphy. Members absent: Mollenhoff. Moved by Anders, seconded by Jordan that the Agenda, as proposed, be approved. Ayes: Five. Absent: Murphy, Mollenhoff. Motion carried. Ordinance No. 4082, amending the 1991 Traffic Code as it pertains to parking on the parking, was reviewed. Mayor Rooff stated that the new ordinance is hurting existing businesses by restricting their customer and employee parking. Councilperson Getty stated that the ordinance was designed to improve the city's appearance without creating a hardship for businesses that rely on the public parking areas. The intent of the ordinance was to keep business owners from working on cars and conducting business on city property. Many businesses in the city using the parking area rely on the property for customer and employee parking or to display merchandise. Councilperson Getty suggested that perhaps a grandfather clause could be added to the ordinance for businesses already parking on the parking, but not allow them to repair vehicles. Assistant City Attorney Sang -Ki Han suggested that the council use the permit system now in place. When the council is satisfied that the business has met all the criteria a permit would be issued. Councilperson Collier questioned the liability for the city. Mr. Han responded that we could ask the business to indemnify the city after they meet the criteria of the ordinance. Murphy now present at 5:44 p.m. Police Chief Bernie Koehersen stated that he too supported the permit system as it documents the city's efforts in allowing the variance. Violators could be fined up to $100. Dave Van Dee, Assistant City Planner, stated that retail business are using the parking, not just car lots, and that retail business have evening customers. Don Temeyer, City Planner, stated that zoning laws will allow enforcement of new applicants. Councilperson Murphy suggested that a waiver similar to the driveway waivers be required of each applicant. Councilperson Anders suggested that current businesses be grandfathered, but no repair work be allowed on the parking for future applicants. The consensus of the council was to have the Assistant City Attorney prepare the following revisions to the ordinance: no repair work on the parking, no signs would be required, no protruding or overhanging of vehicles on the parking, and no parking beyond normal business hours. Mayor Rooff suggested that we should differentiate between residential and businesses. A work session will be scheduled for September 11, 1995 to review the proposed changes. With no further business before the council, it was moved by Murphy, seconded by Collier that the meeting be adjourned at 6:22 p.m. Ayes: Six. Absent: Mollenhoff. Motion carried.
