Members absent: Murphy.
Moved by Krizek, seconded by Mollenhoff that the Agenda, as
proposed, be approved. Ayes: Five. Absent: Murphy, Jordan.
Motion carried.
Mayor Rooff began the meeting by reading a letter from Marian
Turner requesting that the council address the need for safety
standards in the vehicle for hire ordinance. Mrs. Turner
questioned whether the liability limit of $300,000 is adequate for
this type of service and asked that the procedure for filing
complaints against a company be better spelled out. After the
letter was read it was moved by Mollenhoff, seconded by Krizek to
receive and place on file the letter by Marilyn Turner. Ayes:
Five Absent: Murphy, Jordan. Motion carried.
Members of the public attending the meeting were asked for their
input on the proposed vehicle for hire ordinance. Red Dralle,
representing Red's Limo Service, stated his objection to including
limousines in the definition of vehicle for hire. The limousine
services are not providing the same service as the taxicabs and he
doesn't feel they should be regulated in the same manner. The
Department of Transportation has issued a license to operate his
service and he stated that the City's ordinance is a duplication of
the state regulation.
Jordan now present at 3:07 p.m.
Deann Downs, representing 1st Class Coaches, stated that in her
opinion, to be fair limousine and shuttle services should have a
business license, certificate of insurance and verification of
licensed drivers but recommends that the rest of the ordinance
provisions don't apply to limousine services.
Discussion was heard on the comparison of the Iowa Department of
Transportation regulations for licensing charter carriers and the
vehicle for hire ordinance. Areas of duplication include the
certificate of insurance, verification of financial condition and
vehicle safety regulations.
Councilperson Anders stated his support of the removal of shuttle
and limousine services from the vehicle for hire ordinance. Staff
discussed the need to have some form of verification to assure that
all vehicle for hire businesses do carry adequate insurance and all
drivers hired by the carriers are licensed. The City Attorney was
directed to compare the regulations for licensing by the Department
of Transportation and to report on any deviations from the City
ordinance.
The vehicle safety standards as proposed were reviewed by the
Mayor and Council. Staff reviewed many ordinances and regulation
of safety standards varied from an extreme of requiring no vehicles
older than five years in St. Paul, Minnesota to no regulation of
safety standards or requirements of inspections. Captain Beener
stated that even the State of Iowa does not provide a required
safety inspection for vehicle registration any longer and he would
not support the City doing safety inspections on vehicles. The
police department will make visual inspections now but few indepth
inspections are ever done. This issue has been discussed by
previous administrations and the problem of subjective
determinations with regard to appearance were a stumbling block to
adoption at that time. City Attorney Sang-ki Han was directed to
review the standards set forth to determine if they were compatible
to the Iowa Department of Transportation regulations.
With no further discussion on the matter, it was moved by Krizek,
seconded by Jordan to adjourn the meeting at 3:55 p.m. Ayes: Six.

City Planner Don Temeyer provided estimates for the Columbus Drive
storm sewer project. City Engineer Eric Thorson stated that the
storm sewer capacity problem was identified during the 1993 flood
as the flow has increased off the Columbus High School site due to
expansion of the campus. The flow runs downhill from southeast to
northwest and there is only one storm sewer servicing the area
which then empties into the nearby creek. Currently the storm
system is not taking five year flow because of the development on
the Columbus site. The engineering staff have designed plans which
improve the storm water system to handle a five year flow.
There are three possible alternatives for improved capacity in the
storm sewer system. Alternate number one would require
installation of a relay pipe from Rudi Place to a manhole on the
subdivision property line which would require movement of a
building. This is the most expensive alternative and would also be
the most disruptive to the area residents.
Alternate two would install a line through the Columbus School
property to divert the drainage off the campus to the creek through
the school property. The storm sewer pipe would require a deep
installation and would also be quite expensive at a cost of
$149,263.
The third alternative is the least expensive by installing a new
line from the manhole on the subdivision line to the creek along
Columbus Drive. The new line would be placed under the street
which would then be resurfaced and the line would then continue
over to dump the storm water flow into the creek.
Councilperson Getty asked if there were disaster recovery funds
available for this project. Temeyer reported that there weren't
funds available now due to the Sherwood Park project but if state
disaster funds are received for demolition then federal funds could
be made available.
Mayor Rooff directed Don Temeyer to continue to identify funds that
would be available for this project and asked the Engineers Office
to review the storm sewer problems through out the City that need
immediate attention. A work session will be scheduled in two weeks
to receive staff updates.
With no further discussion on this matter it was moved by Getty,
seconded by Anders to adjourn the meeting at 4:15 p.m. Ayes: Six.
