June 5, 1995 Unfinished Business - continued 104898 - Collier/Jordan Page 2 that "an Ordinance amending the 1993 Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 16-12, Rubbish and Trash Near Buildings, or in Cellars or Alleys Prohibited; May be Abated as a Nuisance; Open Burning Prohibited, of Chapter 16, Garbage and Refuse; and enacting in lieu thereof a new Section 16-12, Rubbish and Trash Near Buildings, or in Cellars or Alleys Prohibited; May be Abated as a Nuisance; Open Burning Prohibited, of Chapter 16, Garbage and Refuse (allowing burning of yard waste)", be received, placed on file, considered and passed for the third time. Prior to a vote on the above motion, the following comments were heard. Mayor Rooff read a letter of objection from Dr. Richard Winegarden. The council submitted letters from Rob Lepsch, and the Visiting Nurses Association stating their opposition of open leaf burning. Letters in support of open burning were received from Darlyne Peterson, Kenneth Wilson, Iva Hall, Lois Yerkers and Ronald Weiss. A petition was also submitted with nineteen signatures in favor of burning and two residents opposed to open burning. Councilperson Jordan stated his past position was in opposition to open burning personally due to family health concerns but during the past year many citizens have requested the right to burn. He feels that the council must make economically sound decisions in response to citizen's requests. Councilperson Jordan expressed his opinion that the people of Waterloo will act responsively to the needs of those with health problems and that the return to burning will be a win-win situation. Randy Stultz, Chairperson of the Solid Waste Commission, commended the City of Waterloo for establishing the ban on burning policy. The hazards of burning include uncontrolled fire and contamination to the environment. The Solid Waste Commission has requested the City Council postpone the final reading on this ordinance until the end of July to allow the Commission to work with the City administration and to prepare some alternatives to burning. Jeff Essmann, 338 Crestridge Drive, objected to the suggestion by the Solid Waste Commission to postpone this reading. The Solid Waste Commission may be worried about the environment but could be more worried about the revenue this would bring to the landfill. Marilyn Metzger, 644 W. Donald, stated that people are already using wood burning stoves and the ability to burn yard waste isn't any different to the environment as wood burning stoves are. Bill Dotzler, 210 Poplar, was asked to speak on behalf of the Visiting Nurses Association representing both indigent and unhealthy citizens of the community. First he informed the council that his mother requested he state her support of open burning. She would like to burn twigs or branches. Dotzler explained that wood burning is cleaner and doesn't release the particulate matter into the air that leaf burning does. The particulate matter is the contamination to the air that causes health problems to those with breathing difficulties. The Visiting Nurses Association supports a delay as requested. There is concern about allowing open burning during the summer weather when persons with breathing difficulties can't close their houses in the heat without air conditioning. Many of the indigent patients are unable to afford air conditioning and so this would cause additional stress on their health. Mary Haasis, 116 Courtland, informed the council that even with a ban on burning citizens are burning items in their barbecue to avoid the ban, so it is not strictly enforced. Marlene Krueger, 1616 Hyperion, reported that it was hard to come for a third night but felt it was important to represent people with asthma. There are no smoking signs throughout City Hall and even in restaurants, these signs reflect the protection of peoples rights to be free from smoke. At times good leaders have to take unpopular stands to protect all citizens. The council should also consider the economic impact to the Fire Department for the additional calls which will result from open burning. Randy Stultz rebutted the statement by Mr. Essman by informing the public that the Solid Waste Commission loses money on composting on leaves. Pierre Denault, 225 Lovejoy, expressed disappointment with a system where health concerns are overshadowed by political concerns. He questioned the leadership of the Mayor if the Mayor failed to veto this ordinance change. Ernie Boykin, PO Box 1438, informed the council that she was called to assist a friend during an asthma attack that was caused by paint fumes. There are many causes for breathing problems and open burning isn't the only cause. She supports the council representing its constituents by voting for what the citizenship is requesting. Resolution adopted and upon approval by Mayor assigned No. 1995-339. 104918 - Getty/Jordan that "Resolution approving request from Iowa Northland Regional Council of Governments (INRCOG) to authorize commencement of condemnation proceedings for Brinker property in conjunction with completion of trail system between George Wyth Memorial State Park and U.S. 218 (Greenhill Road)", be adopted. Craig Brinker, 4523 Foulk Rd, is a member of the family inhabiting this property since the 1800's. He stated that if this condemnation is approved lawsuits will be filed on at least three legal precedences. He believes biking is a fad and the number of riders on the Cedar Valley Nature Trail is decreasing. No member of the Cedar Valley Lakes Board has directly contacted the family with an offer, but they have always used an intermediary. Historically the family has never disposed of property unless under threat of condemnation. Mr. Brinker dropped off an offer to the Mayor and he requests the council vote no to condemnation and save all parties money. Mayor Rooff reported that he had acted as an intermediary for the Cedar Valley Lakes Board but that he was unable to reach an agreement for them with Mr. Brinker. After working on this issue since shortly after taking office there doesn't seem to be an opportunity for settling it unless the proceedings continue. The family and Cedar Valley Lakes Board can still continue negotiations beyond this point. Following discussion a vote was taken on the above motion with the following result. Ayes: Six. ORAL PRESENTATIONS 104942 - Cindy Woody, 721 Belle Street, introduced herself as the representative of the newly formed Cedar Terrace Neighborhood Association. She asked for assistance from the Mayor and Council in dealing with the businesses along the access routes into Cedar Terrace. Several business properties are unsightly and should be cleaned up for visual and environmental concerns. She submitted a petition with two hundred twelve signatures requesting the businesses clean up their properties. Councilperson Collier reported that he received several phone calls expressing thanks to the Mayor and Council for their assistance in working with residents on the drug problems throughout the City. Forest Dillavou, 1725 Huntington Road, was reminded with the passing away of Leonard Katoski how much he enjoyed using the City park system, he requested that the Mayor look into developing the park system back to the standards set by Leonard Katoski. Councilperson Krizek reminded citizens of the Fifth Ward Table Talk scheduled for Tuesday, June 6th at West Intermediate School. Ernie Boykin, PO Box 1438, commended School Liaison Officer Carrol Kienol for his work with East High School and the neighboring community in dealing with kids that are hanging around the school and church properties.
