UNFINISHED BUSINESS
104869 - Getty/Collier
that "an Ordinance amending the 1993 Code of Ordinances of the City of Waterloo,
Iowa, by repealing Section 16-12, Rubbish and Trash Near Buildings, or in Cellars
or Alleys Prohibited; May be Abated as a Nuisance; Open Burning Prohibited, of
Chapter 16, Garbage and Refuse; and enacting in lieu thereof a new Section 16-12,
Rubbish and Trash Near Buildings, or in Cellars or Alleys Prohibited; May be Abated
as a Nuisance; Open Burning Prohibited, of Chapter 16, Garbage and Refuse (allowing
burning of yard waste)", be received, placed on file, considered and passed for the
second time.
Prior to a vote on the above motion, the following comments were heard.
Councilperson Collier submitted a petition of 500 signatures in favor of burning.
Councilperson Getty stated that he is placing 100 signatures in favor on file.
Letters in favor of allowing burning of yard waste were received from Shirley
Heiple, Raymond Fencl and William Dedic. Craig Redshaw, Marlene Krueger and Linda
Rekward submitted letters stating their opposition to open burning.
Councilperson Mollenhoff stated that he had received many letters and phone calls
about this issue. He stated his belief that the department most affected by the
open burning issue is the Fire Department and that the Fire Chief's position on this
issue should provide input to the Council.
Councilperson Anders reported that he has heard many pros and cons about this issue
and feels that there should be a compromise reached by providing a method to get rid
of yard waste without burning. Councilperson Anders requested the mover and
seconder of the motion withdraw the motion from the table so that the item could be
tabled until a later date as alternatives are investigated.
Without a withdrawal of the motion, it was moved by Anders, seconded by Mollenhoff
to amend the original motion to establish a limit to burning and instruct staff to
seek alternative methods of disposal. Mayor Rooff called for a vote on the
amendment to the original motion. Ayes: Three. Nays: Jordan, Murphy, Getty,
Collier. Motion not carried.
104870 - Before a vote on the original motion to consider and pass for the second time, Mayor
Rooff asked that anyone in the audience who would like to speak address the council
at this time. Mayor Rooff invited participants who have not spoken on this issue
before to step to the microphone first.
Jewel Kohler, 724 Midland, reported that she had to burn last year to get rid of a
snake and would prefer to do it legally in the future. She stated that burning of
brush needs to be approved by the Council.
Tom Hall, 303 Logan Ave, expressed his approval of burning if it is kept in barrels
to contain the fire.
Eddie Herbert, 3233 Burton Ave, made a statement in favor of burning for his
customers. He recommends that there be an established time for burning so that
persons with breathing problems could prepare alternative plans.

ORAL PRESENTATIONS
104888 Mayor Rooff reminded the public of the upcoming Ward Table Talks and stated that
notices of times would be available in the paper.
Elaine Jaquith, 810 Cornwall, asked the Mayor and Council to state their position
on the policy being proposed for the public access channel, cable channel two,
shutting off access to the public. She stated that the Cable Commission shouldn't
be allowed to deny public access to citizens or to prohibit uses by citizens. City
Attorney James Walsh stated that the Mayor and Council have delegated their
authority to the Cable Commission and haven't had any such item placed before them
for a vote. Ms. Jaquith requested that she be given adequate notice if any such
changes are made as she has time and funds invested in her programming and needs to
be able to plan for future shows.
Jim O'Reagan, 1723 Logan Ave, asked permission to speak about the burning issue as
he was unable to attend during the voting and open discussion period. As chairman
of the committee on burning he spent a year studying this issue. Most people in his
neighborhood seem to mulch but don't attempt to burn or frequently use leaf bags..
He would support no change to the ordinance as it stands.
Councilperson Krizek recommended that further study of the issue be done during the
two week period before the next council meeting.
