Ayes: Six. 104762 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections. Norlan Odem, 120 W. 21st Street, stated he has lived in the area for fifty years and is not happy that the request to convey the alley will cut off his access to Jefferson Street. He parks a trailer in his backyard and he would be willing to purchase half of the alley which adjoins his property. Mr. Odem stated that he tried to contact the Planning Department but didn't receive notice of this meeting until 4:00 p.m. this afternoon. Carl Schuler stated that he had not been notified of the of an offer. However he was in attendance when the date Planning and Zoning Commission. He has no objection to the alley to Mr. Odem but asked if Mr. Odem would help to City Planner Don Temeyer informed the council that he Schuler for over a year on the purchase of this property. Ayes: Six. Absent: Mollenhoff. Motion carried. 104774 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for oral and written objections and there were none. John Dunakey, of the Iron Horse Property Management and Chicago Central Railroad, informed the Mayor and Council that he received the notice through certified mail and objected to the manner of the notice and inspection. He inspected the property with City Engineering staff and he didn't understand why the grates in the sidewalk could deviate in height more than the sidewalks that were marked for repair. The hole left by a tree removal in the grated area is more of a hazard than the sidewalk condition. The problems with the sidewalk area are caused by City trucks which park on the curb to change the flags in the light pole stands. The weight of the truck causes the sidewalk to tip. Paul Huting, Parks Superintendent, agreed to look into the replacement of the grates or trees with the Engineering Department. May 8, 1995 Page 4 Hearings - continued Leonard Kemmer, 326 State Street, reported he had no complaint about the sidewalk repair program, but his street and gutter are higher than the sidewalk which causes water to stand on the sidewalk accelerating its deterioration. City Engineer Eric Thorson stated that the property owner is responsible for the maintenance of the easement area between the sidewalk and the street and that Mr. Kemmer could build up this area if he wished. Mayor Rooff asked Mr. Thorson to look at the easement to see if the City could assist with this problem. Mr. Schuler, 133 Polk, is opposed to having to replace a sidewalk square that doesn't have a crack but isn't settled so is listed as unstable. The inspector found mud under the sidewalk but why should he be required to replace it. Associate Engineer Jim Ellis reported that he had inspected this sidewalk and it was undermined, there wasn't bedding under the sidewalk so it was deemed unsafe. Councilperson Collier agreed to look at this sidewalk with the resident and City Engineer. Murphy/Jordan that the hearing be closed and oral and written comments be received and placed on file. RESOLUTIONS TO BE ADOPTED 104783 - Murphy/Collier that "Resolution approving submission of a Consolidated Plan and one-year Action Plan to the Department of Housing and Urban Development for federal assistance under Title I of the Housing and Community Development Act of 1964, as amended", be adopted and Mayor authorized to execute same. Prior to a vote on the above motion, the following comments were heard. Councilperson Getty asked if these funds could be allocated to different programs during the year. Community Development Director Mark Boesen reported that there are procedures for change. A public hearing would need to be held for any plan amendments with citizen participation and then it must be submitted to H.U.D. for approval. The public hearing process can address several proposed funding changes at one time. Councilperson Getty expressed his wish that the Consolidated Plan document had been presented earlier to allow the Council a longer period of time for reviewing the plan. Following discussion a vote was taken on the above motion with the following result. Ayes: Six. Absent: Mollenhoff.
