Mr. Mayor,
Point of Order
On 2-5-18 this Council voted 4-3 (in the negative) on Consent Agenda
item 1-B-4 and in so doing "Breached the Rules". The breach is an
infraction of a "continuing nature.
When Council took action on this item (motion), the Rules regarding the
Consent Agenda were violated as: 1.) 1-B-4 was not extracted from the
Consent Agenda to be considered separately; 2.) By not extracting, it
remained with all the other items to be voted YES or NO "en masse" (or
as a whole).
Next, for the Council to take the action it did, and given the discussion
(specifically by Councilperson Klein — "it is a Budget issue and not
being bound by another Council's decision"), this Council would have
first had to rescind the prior Council Action of 8-28-17. Also, their
action on 2-5-18 required a 2/3 vote of the Council as no prior notice
was given of any motion having anything to do with rescinding the 8-28-
17 vote. The vote was 4-3 not meeting the 2/3 threshold.
Mr. Mayor, I remind you that Waterloo's Code of Ordinances Title I,
Chapter 4—3 — H states: "Parliamentary Rules to Govern: In all cases
not provided herein, the usual parliamentary rules which govern
parliamentary bodies shall govern the City Council where they are
applicable. (Rev. Ord 1117; Comp 1941, p.0-6)
Therefore, because you have had 3 weeks to rule this action out of order
and not made that decision, I now CALL the Breach and Infractions by
this Council on 2-5-18 Re: Consent Agenda motion 1-B-4 "OUT OF
ORDER". According to Parliamentary Rules you are to make a decision
at this time.
