Moved by Anders, seconded by Collier that the Agenda, as proposed, be approved. Ayes: Six. Absent: Mollenhoff. Motion carried. Reed Craft, Waterloo Water Works, explained the repair and assessment is proposed for six houses served by a private residential line on East Second Street. The six houses share the cost for maintenance of the private line and each also have a connection to the private line which is the home owner's responsibility. There have been three documented incidents of repair to this line between 1969 and 1993, three of the incidents are repair to the mainline in 1969, 1988 and 1995. Mr. Craft explained that this isn't an abnormally high incident of repair and the line doesn't appear to have any major problems. The home owners have asked for the Water Works to establish its own line to replace the private line. It is estimated that the cost to establish a new line would be between eight and ten thousand dollars. This cost would be shared between the Water Works and the property owners at a much higher cost than the repair assessment. The current water kill assessment divides the cost for repair to the line equally between six properties as only two property owners would voluntarily agree to the repair. Mayor Rooff asked Mr. Craft for an estimate on the number of private lines in Waterloo. Mr. Craft indicated that there are approximately 18 private water lines. The problem with establishing a new main line would be the location of the main would require digging along the parking and require replacement of many driveways and sidewalks. Councilperson Anders asked whether Community Development funds could be used to assist this project. Mark Boesen, Community Development Director, indicated that funds probably could be used for this purpose but the current budget would need to be amended or funds could be requested in the FY96 budget. Councilperson Collier reported that he had spoken to the residents and attended a meeting with the Water Works. It was his understanding that after reviewing this item with the Water Works Board of Trustees, it was agreed that the Water Works would repair the line and assess the property owners as the fairest problem resolution. Mr. Messingham, 303 Lafayette, addressed the Council as one of the residents in the area. He reported that since the construction of the new Post Office there have been multiple leaks. Repairs by the Water Works have been to locations beyond the shutoff and assessed to the property owners. Mr. Craft explained that the repair was to replace the connection to the main and to repair the pavebox. Mr. Messingham asked for assistance in replacing the private line from the Council as the residents are mostly low income and live in the Franklin -Gateway area. Vince Heuer, 325 Lafayette, stated that he acquired his property from his mother and so knew about the private line but that many of the property owners weren't aware of this during the purchase of their property because it isn't located on any abstracts. The problem was established in 1910 and he feels that we should find a way to resolve the problem and not perpetuate it. He was dissatisfied with the timeline for repair provided by the Water Works. He received a certified notice on February 1st to get the line repaired by a private contractor by February 17th or the Water Works would proceed with repairs and assessment. After complaining about the process a meeting was held on February 21st and the Council Work Session April 3, 1995 Page 2 and the deadline was extended. He also asked the Council to consider helping the residents to replace the main to stop this perpetual problem. It was the consensus of the Council to table this item on tonight's agenda to allow time for the Water Works, Community Development and the Public Works Committee to review alternatives and speak to the residents. With no further business before the council, it was moved by Getty, seconded by Krizek that the meeting be adjourned at 5:30 p.m. Ayes: Six. Absent: Mollenhoff. Motion carried.
