Mollenhoff.
Also present: Police Chief Koehrsen, Fire Chief Magsamen, Paul
Hoffey, Cedar Falls Public Safety Director, Black Hawk County
Sheriff Captain John Meyer
Moved by Mollenhoff, seconded by Murphy that the Agenda, as
proposed, be approved. Ayes: Seven. Motion carried.
Police Chief Koehrsen updated the Council on the proposed 28E
agreement for a Consolidated Public Safety Communications Center.
A committee has been diligently working on the final draft of the
28E agreement to satisfactorily meet the needs of all the entities
involved in a consolidated dispatch center. Both the Police Chief
and Fire Chief recommend the Council approve the 28E agreement to
allow a board to be established to manage the entity created by the
28E agreement. However, there are a number of concerns that have
been raised during this process.
At the time the agreement was written the overall intent was to
merge all trained dispatchers for the cities of Waterloo and Cedar
Falls and Black Hawk County under the direction of the nine member
board established to operate the consolidated dispatch center. A
dispute has arisen between the bargaining units of the three
entities with regard to seniority rights for duty assignments. The
three units are all members of the Teamsters Local but the
Sheriff's unit has alleged that their contract supersedes all
others and gives their members super seniority for shift
assignment. Chief Koehrsen expressed his concern for safeguarding
the jobs and seniority rights of all dispatchers during this
merger.
Captain Meyer with the Black Hawk County Sheriff's department
stated that Public Safety Communications Board will have the right
to set policies and procedures for staffing the center. He has met
with the twenty-five full-time dispatchers from all entities.
There are thirty-five positions to be filled, including dispatch
positions and positions such as booking officer or control
technician. As employees of the Black Hawk Sheriff's office the
dispatchers would fall under the contractual agreement that has
just been signed but this could be renegotiated if both parties are
in agreement. The current contract does allow management the right
to set schedules by other methods than seniority for the betterment
of the center.
City Attorney Jim Walsh informed the council that the 28E agreement
needs to be passed to allow the board time to implement policies
and procedures necessary for training and staffing of the center.
He stated that the issues that have been raised could be superseded
by the language in Article Five of the 28E agreement which states
that the bargaining contract supersedes Board policies and
procedures.
Motion by Mollenhoff, second by Jordan to place the 28E agreement
on the February 13th council meeting agenda for approval.
Further discussion continued as Councilperson Murphy stated that
the Teamster representative position was taken to avoid complaints
being lodged against the organization in Federal mediation.
Councilperson Krizek asked for an explanation of the assessment
calculations presented in the agreement. Captain Meyer stated that
he prepared the assessment percentages based on taxable valuation,
population figures and calls for service. The costs assessed are
a result of the assessment percentage multiplied by the total

personnel costs. Captain Meyer assured the council that no
additional operational costs would be assessed. Captain Meyer
emphasized the need to establish the 911 budget for certification
before March 15th or the $ .50 surcharge will need to be voted on
again.
Councilperson Mollenhoff called for the question. Ayes: Seven
Vote on the placement of the 28E agreement on the agenda was as
follows, Ayes: Six Nay: Murphy.
With no further business before the council, it was moved by Getty,
seconded by Mollenhoff that the meeting be adjourned at 5:32 p.m.
Ayes: Seven. Motion carried.
