Mayor Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Bowers. 81538 - Moved by Roehr, seconded by Getty that the Agenda, as amended, for the Regular Session of December 14, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 81539 - Moved by Penaluna, seconded by Dowie that the minutes of the Special Session held November 20, 1981 at 1:30 P.M. be approved. Motion carried. 81540 - Moved by Dowie, seconded by Getty that the minutes of the Special Session and Regular Session of December 7, 1981 be approved. Motion carried. HEARINGS 81541 - Moved by Roehr, seconded by Dowie that proof of publication of notice of public hearing on request of Harold V. Rooff to rezone 1.4 acres generally located east of LaPorte Road between Howard and Locke Avenues from "M-1" Light Industrial District to "C-2" Commercial District as published in the Waterloo Courier on November 27, 1981, be received and placed on file. Motion carried. 81550 - HOLD HEARING - This being the time and place of hearing, the Mayor called for written and oral objections. Maxine Scott asked why the company was requesting an increase in fees and requested more information relating to the financial status of the company. Louis Greco, 715 Stephan, stated that he would like to see the company cover City Council Meetings and School Board Meetings, as provided in their agreement. Moved by Penaluna, seconded by Bowers that the public hearing, on proposed subscriber rate increase for Waterloo Cablevision, Inc. be adjourned until December 21, 1981 at 7:00 P.M. in the City Hall Council Chambers. Motion carried. ORAL PRESENTATIONS 81551 - Don Temeyer, Plan and Program Director, reported that the bid of Gary W. & Carolyn C. Wendel was in order. Moved by Dowie, seconded by Burton that "Resolution authorizing sale and conveyance of property located south of Mitchell Avenue, along Lowell Avenue and known as Lots A, 5 thru 9, Blk. 112, Riverview Addition to Gary W. and Carolyn C. Wendel in the amount of $1,600.00", be adopted and City Attorney instructed to prepare deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-602. 81552 - Mayor Rooff reported that after meeting with various department heads, the following residency requirements for City personnel is being recommended: 1) that emergency personnel can live 30 minutes from the station of employment from the time they are contacted to report for work, and 2) disciplinary actions for not reporting within 30 minutes will comply with the appropriate contract the employee is covered under. The Council will be asked to take formal action on this matter on December 21, 1981. Tom Pierce, President of the Waterloo Fire Fighters, read a statement in support of allowing emergency personnel to determine their own location of residency, with a standard of reasonableness and good judgment. Motion carried. 81553 - Mrs. Bea Allen, 615 Cottage, disagreed with the placement of the Department of Correctional Services building at 300 Iowa Street (See C.R.# 81553 of 12/14/81). She felt it was unfair to place such a facility near the Lily Ferguson Day Care Center. She also disagreed with the tearing down of the Episcopal Church on E. 4th Street to make way for the construction of elderly housing. She also objected to the placement of the Waterloo Recreation Center on the west side and the tearing down of Washington School (on E. 4th Street at Sullivan Park) which was utilized as a Recreation Center. Mayor Rooff stated that the forty (40) member committee investigating the need for a sports complex would be reporting in the very near future of their findings. PETITIONS FROM PUBLIC 81553 - Moved by Getty, seconded by Dowie that request of Ken -Jan, Inc., Wendell Lockard, Waterloo, Iowa, for sale of Disposal Parcel No. 42b -c, 300 Iowa Street, Iowa R-2, in the amount of $12,000.00 together with recommendation of approval from the Community Development Board be received, placed on file and "Resolution setting date of hearing as January 4, 1982 at 7:00 P.M. in the City Hall Council Chambers on above sale to Ken -Jan, Inc., Wendell Lockard, Waterloo, Iowa", be adopted and instruct Clerk to publish notice accordingly. RESOLUTIONS TO BE ADOPTED 81572 - Moved by Roehr, seconded by Getty that "Resolution authorizing the execution of a Memorandum of Agreement by and between the City of Waterloo, Iowa and Ken -Jan, Inc., regarding the issuance of Industrial Revenue Bonds not to exceed $750,000", be adopted. Project) not to exceed $750,000 in City Hall Council Chambers at 7:00 P.M. January 4, 1982", be adopted and Clerk instructed to publish notice accordingly. Ayes: Seven. ORDINANCES TO BE ADOPTED 81574 - Councilman Roehr reiterated his support of Plan II and explained why he preferred the adoption of this plan. Moved by Roehr, seconded by Dowie to receive and file the written and oral report of Councilman Jack Roehr regarding his support of Plan II. Motion carried. 81575 - Councilman Bowers expressed his support for Plan I. If Plan II were adopted, it could be conceivable that all Councilmen could be elected from the West Side. Rev. Don Johnson expressed his support for Plan I and that this plan lacks the natural physical boundaries of U.S. Highway 63 and the Illinois Central Railroad. Such physical boundaries deter many from voting. Don Eibey, 1104 Dundee Avenue, voiced his support for Plan II. Rosie Peterson, representative of the League of Women Voters, supported Plan I as this proposal is more compact and contigious and follows natural boundaries of the City. Rachael Fulton, representative of League of Women Voters -- Voters Services, stated that League members had been appraised of the League's position on redistricting with no negative reaction. Gary Schmitz, 732 Stephan, spoke in support of Plan II. He said that his opposition to Plan I is that his immediate area would be represented by three (3) Councilmen and thus harder to be represented. Bea Allen, 615 Cottage, spoke in support of Plan I. Ruth Anderson, 1503 Newell, spoke in favor of Plan I and argued the Council's adoption of this plan. Stan Kennedy, 1112 Vine Street, was concerned with the decrease in black voters in Ward IV with Plan II, as compared to Plan I. He supported Plan I. Leo Greco, 716 Stephan Avenue, expressed his desire for persons to not label such problems as "minority problems" and start working together. Councilman Wilharm stated his intentions in authoring, Plan II as not being one with religious or racial overtones. Moved by Wilharm, seconded by Bowers to receive and file the above comments. Motion carried. 81576 - Jimmie Porter, Community Enabler, stated that Plan II would have a harmful affect on the black population of the community. He said that it was illegal to draw a redistricting plan based upon future growth patterns. Rather, lines must be drawn to reflect current conditions rather anticipated growth patterns. Maxine Scott asked what apparent support Plan II had received from the general public.
