Mayor Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Bowers. 81297 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of October 26, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 81298 - Moved by Burton, seconded by Bowers that the minutes of the Regular Session held October 19, 1981 at 7:00 P.M. be approved. Motion carried. HEARINGS & BIDS 81299 - Moved by Wilharm, seconded by Burton that proof of publication of notice of public hearing on proposed plans, specifications, form of contract, estimate of costs, etc., for the construction of Lincoln-Ackermant Area Storm Sewer and Sanitary Sewer Improvements, Stage III, Contract No. 227 as published in the Waterloo Courier on October 16, 1981 be received and placed on file. Motion carried. 81300 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Wilharm that "Resolution confirmingthe approvalof pp plans, specifications, etc., for the construction of Lincoln-Ackermant Area Storm Sewer and Sanitary Sewer Improvements, Stage III, Contract No. 227", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-530. 81301 - Moved by Roehr, seconded by Bowers that "Resolution ordering construction of Lincoln-Ackermant Area Storm Sewer and Sanitary Sewer Improvements, Stage III, Contract No. 227", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-531. 81302 - Moved by Wilharm, seconded by Getty that proof of publication of notice to contractors of invitation for bids of construction of Lincoln-Ackermant Area Storm Sewer and Sanitary Sewer Improvements, Stage III, Contract No. 227 as published in the Waterloo Courier on October 16, 1981 be received and placed -on file. Motion carried. 81306 HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Dowie that the sealed bid from Katherine Cross Mosley in the amount of $600.00 be received, placed on file, and referred to Plan and Program Department for review and recommendation. Motion carried. 81307 Don Temeyer, Plan and Program Director, reported that the above bid was in order. Moved by Wilharm, seconded by Dowie that "Resolution authorizing sale and conveyance of property west of the intersection of Ankeny and John Streets along the east side of Virden Creek to Katherine Cross Mosley in the amount of $600.00", be adopted and City Attorney instructed to prepare deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-532. HEARINGS 81308 Moved by Roehr, seconded by Penaluna that proof of publication of notice of public hearing on proposed support retail space for the West Side Parking Ramp Expansion as published in the Waterloo Courier on October 20, 1981, be received and placed on file. Motion carried. 81309 HOLD HEARING - This being the time and place for hearing the Mayor called for written and oral objections and there were none. Moved by Dowie, seconded by Bowers to receive and place on file the following proposals, instruct the Clerk to open and refer to the Plan and Program Department for review and recommendation: 1) Ken -Jan, Inc. 2) Conway Plaza Development Co. Motion carried. October 26, 1981 Page 3 81310 A representative of Celebrity Homes, Inc. spoke on behalf of allowing the site plan to be passed. He stated the Fire Department had no problem with 20' streets. Councilman Roehr stated that the Police Chief would recommend wider streets and warned of future problems if the City took in the addition for public streets. Moved by Dowie, seconded by Bowers that "Resolution approving the site plan for proposed development of Twin Pines (Southland Park)", be adopted. Ayes: Getty, Penaluna, Bowers, Burton, Dowie. Nays: Roehr, Wilharm. Resolution adopted and upon approval by Mayor assigned No. 1981-533. ORAL PRESENTATIONS `r 81310 Keevin Backhoff, Manager of Metropolitan Ambulance Service expressed a concern that the A Metropolitan Ambulance Service has been left out of negotiations between the City and the hospitals on ambulance service for Waterloo. Mayor Rooff stated that he was not in charge of the meeting and that she should contact the doctors that are. The Mayor continued that he needed some dollar amounts on her proposal and that he would guarantee Metropolitan Ambulance would have a chance to be heard. Moved by Penaluna, seconded by Bowers to receive and place on file the above comments. Motion carried. UNFINISHED BUSINESS 81311 Moved by Bowers, seconded by Roehr that communication from Associate Civil Engineer reporting on paving request in the Maywood neighborhood area referred to under C.R. #81230 of 10/12/81 and recommending denial of request until storm sewer study is completed for this area, be received, placed on file and approved. Motion carried. 81312 Moved by Getty, seconded by Burton that "an Ordinance amending Ordiance No. 2644, known as the Traffic Ordinance, by repealing Subsection (88) Shaulis Road of Section 541, Increasing Speed Limits in Certain Areas, and Subsection (43) Hammond Avenue of Section 543, Thru Streets; that new Subsections (88) Shaulis Road, (88a) Shaulis Road and (88b) Shaulis Road of Section 541, Increasing Speed Limits in Certain Areas, and new Subsection (43) Hammond Avenue of Section 543, Thru Streets are hereby enacted in lieu thereof; that new Subsection (89a) Shaulis Road is hereby added to Section 543, Thru Streets", be received, placed on file and passed for the first time. Ayes: Seven. Motion carried. 81313 - Moved by Roehr, seconded by Wilharm that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. October 26, 1981 REPORTS 81315 - Moved by Bowers, seconded by Getty Page 4 that Fiscal Year 1981 Annual Report for the Waterloo City Plan and Program Commission and the Waterloo City Zoning Commission be received and placed on file. DOCUMENTS 81316 - Moved by Penaluna, seconded by Bowers that communication from Associate Civil Engineer requesting acceptance of Section I, Sanitary Sewer Extension in Southtown for Max Guernsey (Section 11-88-13) together with two-year maintenance bond for sewer for said improvements be received, placed on file and approved. Motion carried. 81319 - Moved by Roehr, seconded by Penaluna that contract, performance bond and certificate of insurance for Contract No. 209, together with recommendation for approval, be received, placed on file and "Resolution approving contract and bond of Lehman Trucking & Excavating, Inc., Waterloo, Iowa, for F.Y. 1981 Warren Drive Storm Sewer Outlet, Contract No. 209 in the amount of $34,003.00", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-537. RESOLUTIONS TO BE ADOPTED 81320 - Moved by Getty, seconded by Bowers that "Resolution setting date of hearing on proposed 1982 Budget Estimate for the Waterloo Water Works as November 9, 1981 at 7:00 P.M. in City Hall Council Chambers", be adopted and instruct Clerk to publish notice accordingly. Resolution adopted and upon approval by Mayor assigned No. 1981-538. 81321 - Moved by Roehr, seconded by Bowers that "Resolution transferring from the Federal Revenue Sharing Fund the sum of five hundred twenty two thousand two hundred forty-nine dollars ($522,249.00) to the General Fund", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1981-539. 81322 - Moved by Dowie, seconded by Burton that "Resolution transferring from the Sewer Rental Fund the sum of four hundred seventy thousand dollars ($470,000.00) to the Debt Service Fund", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1981-540. Ayes: Seven.
