HomeMy WebLinkAboutMinutes- 10/19/81October 19, 1981 The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council Chambers, Waterloo, Iowa at 7:00 P.M., on October 19, 1981. Mayor Rooff in the Chair. On Roll Call: Present: Getty, Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Invocation by Councilman Getty. - 81261 - Moved by Roehr, seconded by Wilharm the Agenda, as amended, for the Regular Session of October 19, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 81262 - Moved by Burton, seconded by Bowers that the minutes of the Regular Session held October 12, 1981 at 7:00 P.M. be approved. Motion carried. Mayor Rooff introduced Troop 116 from Blackhawk School and welcomed them to the meeting. HEARINGS 81263 - Moved by Roehr, seconded by Penaluna that proof of publication of notice of public hearing on site plan for Twin Pines (Southland Park) as published in the Waterloo Courier on October 12, 1981, be received and placed on file. Motion carried. 81264 - Moved by Bowers, seconded by Getty to receive and place the recommendation of the Plan and Program Commission. Motion carried. 81265 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections. Councilman Roehr questioned the street widths within the proposed area as being only 20 ft. He felt that this may present a problem for emergency vehicles. Don Temeyer, Plan and Program Director, stated that the streets will be private and that if they were ever accepted into the city street system in the future they would need to be upgraded to City standards. For each dwelling unit, 1.85 parking spaces are being provided. The Police and Fire Departments had been advised of the proposed development, but no adverse comments were aired. Moved by Roehr, seconded by Penaluna that the public hearing be adjourned until Monday, October 26, 1981 and instruct the Technical Committee to review the street widths in light of emergency requirements of the Police and Fire Departments. Ayes: Seven. Motion carried. 81266 - Moved by Roehr, seconded by Dowie that proof of publication of notice of public hearing on proposed support retail space for the West Side Parking Ramp Expansion as published in the Waterloo Courier on August 28, 1981, be received and placed on file. Motion carried. 81267 - Several questions were asked including the price per square foot that developers would be asking of occupants. Mayor Rooff stated that this matter would be addressed at the time the developer is selected. Don Temeyer, Plan and Program Director, presented a brief explanation of the project. He asked that the deadline for proposal sub:li sion be extended to Monday, October 26, 1981 to allow potential developers addition,, time for application submission. Councilman Wilharm stated that he hoped that the affected businesses would be properly relocated without unusual economic loss. October 19, 1981 Page 2 81267 - Continued. Moved by Dowie, seconded by Roehr to adjourn the public hearing until Monday, October 26, 1981 at which time applications will be received. Motion carried. ORAL PRESENTATIONS The Mayor asked for oral presentations and there were none. PETITIONS FROM PUBLIC 81268 - Moved by Bowers, seconded by Roehr that request of Local 46 United Food and Commercial Workers International Union/AFL-CIO, for sale of Disposal Parcel No. I -35p, Iowa P-7, in the amount of $75,000 be received, placed on file and "Resolution setting date of hearing as November 9, 1981 at 7:00 P.M. in the City Hall Council Chambers on above sale to Local 46 United Food and Commercial Workers International Union/AFL-CIO",be adopted and instruct Clerk to publish notice accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-518. 81269 - Moved by Roehr, seconded by Dowie that request of John Rooff, Jr. and John Rooff, III, 1509 Commercial Street, for sale of Disposal Parcel No. I-22, Iowa R-7, in the amount of $1,700 be received, placed on file and "Resolution setting date of hearing as November 9, 1981 at 7:00 P.M. in the City Hall Council Chambers on above sale to John Rooff, Jr. and John Rooff, III", be adopted and instruct Clerk to publish notice accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-519. 81270 - Moved by Penaluna, seconded by Bowers request of Hewey L. Willhite for permission to construct a temporary concrete driveway at 227 Easton Avenue, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Hewey L. Willhite and authorizing construction of a temporary concrete driveway at 227 Easton Avenue, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-520. 81271 - Moved by Dowie, seconded by Penaluna that communication from Plan and Program Director transmitting request of 0. E. Olsen for the sale ad conveyance of property generally located along Lowell Avenue, just south of Mitchell Avenue, be received, placed on file and "Resolution setting date of hearing as November 9, 1981 at 7:00 P.M. in the City Hall Council Chambers on proposal to sell and convey property located along Lowell Avenue, just south of Mitchell Avenue", be adopted and Clerk instructed to publish notice of hearing with minimum bid set as $750.00. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-521. UNFINISHED BUSINESS 81272 - A representative of Lutheran Mutual Insurance Company asked that his company be declared eligible for inclusion into the City's deferred compensation plan. Roger Mogle, Personnel Director, stated that currently only one slot remains on the City's computer payroll deduction system, however, if the City were to convert its payroll system to one similar to the County's, additional companies could be added to the deferred compensation system. Mike Freland, Great Americn Insurance Company, stated that he had contacted, 105 parties for inclusion into his plan. October 19, 1981 81272 - Continued. Page 3 Moved by Wilharm, seconded by Roehr that request of Mike Freland, Great American Life Insurance Co. for inclusion in City's payroll deduction system for deferred compensation be received, placed on file, and approved, with authorization given to converting the City's payroll system to accommodate additional companies for inclusion in the City's deferred compensation plan. Ayes: Seven. Motion carried. 81273 - Moved by Roehr, seconded by Penaluna that communication from City Engineer recommending that the bid of Lehman Trucking & Excavating, Inc. of Waterloo, Iowa in the amount of $34,003.00 for the F.Y. 1981 Warren Drive Storm Sewer Outlet, Contract No. 209 be received, placed on file, and "Resolution awarding contract to Lehman Trucking & Excavating, Inc. of Waterloo, Iowa in the amount of $34,003.00 for F.Y. 1981 Warren Drive Storm Sewer Outlet, Contract No. 209", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-522. REPORTS 81274 - Moved by Bowers, seconded by Dowie that minutes of the Community Development Board Meeting held on September 9, 1981 be received and placed on file. Motion carried. DOCUMENTS 81275 - Dennis Gentz, Engineer's Office, stated that this was for access road adjacent to the proposed dental clinic. Moved by Dowie, seconded by Getty that construction plans for paving, intersection detail, and storm sewer for access road serving E. Donald Street with City Engineer's recommendation for approval be received, placed on file and approved. Ayes: Getty, Penaluna, Roehr, Burton, Dowie. Nays: Wilharm, Bowers. Motion carried. RESOLUTIONS TO BE ADOPTED 81276 - It was explained that rescinding this resolution was necessary due to the need to conduct a public hearing prior to application submission. Moved by Bowers, seconded by Wilharm that "Resolution rescinding Resolution No. 1981-508 of October 12, 1981 relating to filing of an application for a grant with the Urban Mass Transportation Act", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-523. 81277 - Moved by Roehr, seconded by Wilharm that "Resolution setting date of hearing as November 9, 1981 on the Draft Environmental Analysis for the Ground Transportation Center", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-524. 81278 - Dennis Gentz, Engineer's Office, stated that streets included in these abandonments were streets no longer included in the respective programs. Work had been proposed, but had been deleted at the public hearing due to neighborhood objection. Moved by Penaluna, seconded by Bowers that "Resolution deleting certain abandoned streets from the Resolution of Necessity for F.Y. 1981 Paving Program, Contract No. 213", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-525. October 19, 1981 Page 4 81279 - Moved by Bowers, seconded by Roehr that "Resolution deleting certain abandoned streets from the Resolution of Necessity for F.Y. 1982 Oiling Program, Contract No. 225", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned N. 1981-526. 81280 - It was explained that due to the omission of the meeting place in the legal description, the notice must be republished and a new date of hearing set. Moved by Dowie, seconded by Getty that "Resolution fixing; a date for hearing as November 16, 1981 at 7:00 P.M. in the City Hall Council Chamb_-rs on proposed Industrial D velJinment Revenue ;1J, Series 1981 (Keiper-Iiten Partnership Project)", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-527. ORDINANCES TO BE ADOPTED 81281 - There was general discussion regarding the need to change the Shaulis Road speed limit as proposed in the ordinance. Moved by Bowers, seconded by Penaluna that "an Ordinance amending Ordiance No. 2644, known as the Traffic Ordinance, by repealing Subsection (88) Shaulis Road of Section 541, Increasing Speed Limits in Certain Areas, and Subsection (43) Hammond Avenue of Section 543, Thru Streets; that new Subsections (88) Shaulis Road, (88a) Shaulis Road and (88b) Shaulis Road of Section 541, Increasing Speed Limits in Certain Areas, and new Subsection (43) Hammond Avenue of Section 543, Thru Streets are hereby enacted in lieu thereof; that new Subsection (89a) Shaulis Road is hereby added to Section 543, Thru Streets"., be received, placed on file and action delayed until October 26, 1981. Motion carried. 81282 - There was general discussion relating to the Mayor's proposed salary incrase. Councilman Dowie introduced a compromise proposal in the form of a motion. It was moved by Dowie, seconded by Penaluna to amend the salary ordinance of the Mayor to include the following: The Mayor shall receive an annual salary of $33,540 beginning January 1, 1982. The Mayor's salary shall be increased on January 1, 1983, by a percentage equal to the average percentage increase of the following City positions: Library Director, Conway Manager, Community Development Administrator, Recreation Director, Parks Director, Police Chief, Fire Chief, Airport Director and City Engineer. Ayes: Seven. Motion carried. 81283 - Moved by Dowie, seconded by Getty that "an ordinance establishing the salary of the Mayor of the City of Waterloo, Iowa beginning January 2, 1982, as amended, and repealing Ordinance No. 3036", be received, placed on file, considered and passed for the third time. Ayes: Seven. Motion carried. 81284 - Moved by Dowie, seconded by Bowers that "an ordinance establishing the salary of the Mayor of the City of Waterloo, Iowa beginning Janaury 2, 1982, as amended, and repealing Ordinance No. 3036", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3165. October 19, 1981 81285 - Moved by Bowers, seconded by Burton Page 5 that "An Ordinance fixing the compensation of Council Members of the City of Waterloo, Iowa beginning January 2, 1982, and repealing Ordinance No. 3037", be received, placed on file, considered and passed for the third time. Ayes: Seven. Motion carried. 81286 - Moved by Bowers, seconded by Penaluna that "An Ordinance fixing the compensation of Council Members of the City of Waterloo, Iowa beginning January 2, 1982, and repealing Ordinance No. 3037", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3166. BILLS -PAYMENTS 81287 - Moved by Roehr, seconded by Wilharm that "Resolution authorizing the payment of the following statement for work completed by contractor and amount indicated together with recommendation for approval: Downtown 80's Project, Phase III, Communication Network Systems $4,600.00", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-528. NEW BUSINESS 81288 - Moved by Burton, seconded by Bowers that communication from Mayor Leo P. Rooff recommending appointment of James E. Giesen to the Civil Service Commission with term expiration April 4, 1984 to fill unexpired term of Ross Randall be received, placed on file and approved. Motion carried. 81289 - Moved by Bowers, seconded by Getty that communication from Superintendent of Streets reporting retirement of Fred Garland effective October 8, 1981, and entitlement of 192 hours vacation pay and 960 hours sick pay be received, placed on file and "Resolution approving payment of $8,547.84 vacation and sick pay to Fred Garland, Street Department", be adopted. Ayes: Seven. Motion carried. 81295 - Moved by Getty, seconded by Bowers that for clarification the Council Member salary ordinance adopted under C.R. #8126 indicates that salary changes commence January 1 of each year and not July 1.
