Mayor Rooff in the Chair. On Roll Call: Present: Penaluna, Roehr, Wilharm, Bowers, Burton, Dowie. Absent: Getty. Invocation by Councilman Bowers. 81156 - Moved by Dowie, seconded by Penaluna that the Agenda, as amended, for the Regular Session of September 28, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 81157 Moved by Dowie, seconded by Penaluna that the minutes of the Regular Session held September 21, 1981 at 7:00 P.M. be approved. Motion carried. HEARINGS & BIDS 81158 - Moved by Roehr, seconded by Wilharm that proof of publication of notice of public hearing to sell and convey real property located south and west of John Street extended, along the west side of Virden Creek as published in the Waterloo Courier on September 15, 1981, be received and placed on file. Motion carried. 81159 - Moved by Wilharm, seconded by Dowie to receive and place on file the Plan and Program Commission's recommendation. Motion carried. 81160 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Wilharm that the sealed bid from Warren E. Ledtje, Sr. in the amount of $951.00, be received, placed on file, and referred to Plan and Program Department for review and recommendation. Motion carried. 81161 - Moved by Bowers, seconded by Burton that "Resolution authorizing sale and conveyance of property south and west of John Street extended, along the west side of Virden Creek to Warren E. Ledtje, Sr. in the amount of $951.00", be adopted. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor assigned No. 1981-480. HEARINGS 81162 - Moved by Penaluna, seconded by Roehr that proof of publication of notice of public hearing on proposal to vacate, sell and convey a portion of Archer Avenue to Jesse Lyons as published in the Waterloo Courier on September 15, 1981 be received and placed on file. Motion carried. 81163 - Moved by Bowers, seconded by Penaluna to receive and place on file Plan and Program Commission's recommendations. Motion carried. 81164 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Wilharm that "an ordinance vacating that portion of sixty (60) foot right-of-way of Archer Avenue lying east of the right-of-way of Colorado Street and west of the right-of-way line of U.S. Highway 20", be received, placed on file and passed for the first time. September 28, 1981 Page 2 ORAL PRESENTATIONS 81166 Gary Schmitz, 732 Stephan, requested that the traffic lights on the corner of Highway 218 and Falls Avenue bt:: changed so that all traffic stops when the walk light is on. Schmitz continued that .re children from Blessed Sacrament, Edison and Central High use the crossing which creas a dangerous situation. Mayor Rooff stated that he will check with the State to see if the City could change the lights on a U.S. Hi ,away. Moved by Wilharm, seconded by Roehr to receive and place on file the above oral presentation and refer it to the Mayor for a report back. Motion carried. Motion carri ;. 81173 - Councilman Roenr spoke t;: behalf of allowing a setback line at 1033 Wi 1. Jr Avenue. Vic Kennedy, City Attor:.:y advised the Council that in his opinion the City Council had no authority to grant a variance. Moved by Dowie, seconded by Roehr that request Oji James Ishman to reduce building setback line at (1033 Wilbur Avenue) -- Waterloo Fire txtinguisher, Inc. be received and placed on file and tabled for two weeks. Motion carried. September 28, 1981 UNFINISHED BUSINESS 81174 - Moved by Dowie, seconded by Burton Page 3 that "Resolution determining to proceed with the issuance and sale of not to exceed $300,000 in aggregate principal Industrial Development Revenue Bonds (Parrott & Wood Project) of the City of Waterloo", be adopted. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor assigned No. 1981-481. 81175 - Moved by Roehr, seconded by Dowie that communication from City Engineer recommending that the bid for the F.Y. 1981 Pinehurst Drainage Improvements, Contract No. 228 be received, placed on file and delayed one week. Motion carried. REPORTS 81176 - Moved by Burton, seconded by Bowers that report. of Sign and Traffic Department on Shaulis Road and its speed limits be received, placed on file and approved. Motion carried. 81177 Moved by Dowie, seconded by Burton that communication from City Engineer transmitting Completion Report and Final Acceptance of Work for the F.Y. 1981 Fowler Street Sanitary Sewer Program, Contract No. 216 be received, placed on file and "Resolution approving the Completion Report and Final Acceptance of Work for the F.Y. 1981 Fowler Street Sanitary Sewer Program, Contract No. 216 and authorizing payment of $4,736.83 and withholding 10% ($5,622.47) of the total contract price ($56,224.70)", be adopted. Motion carried. 81179 - Moved by Roehr, seconded by Penaluna that construction plans for sanitary sewerage facilities serving Charm Drive Extension, Southland Park together with Treatment Agreement Form WQ 59 from the Department of Environmental Quality and City Engineer's recommendation for approval subject to final acceptance of plans by the Department of Environmental Quality be received, placed on file, recommendation approved and Mayor and City Clerk authorized to execute same. RESOLUTIONS TO BE ADOPTED 81180 - Moved by Burton, seconded by Dowie that "Resolution designating the official meeting place of the City Council of the City of Waterloo for October 12, 1981, at 7:00 P.M. as West High School", he adopted. Resolution adopted and upon approval by Mayor assigned No. 1981-483. 81181 Moved by Dowie, seconded by Bowers that communication from Plan and Program Director transmitting the application of Dynamic Tool Company located at 3906 West Airline Highway requesting partial exemption from property tax together with recommendation of approval be received, placed on file, September 28, 1981 81181 - Continued.
