The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa at 7:00 P.M., on September 21, 1981. Mayor Pro Tem Roehr in the
Chair. On Roll Call: Present: Getty, Roehr, Wilharm, Burton, Dowie. Absent: Penaluna,
Bowers. Invocation by Councilman Wilharm.
81130 - Moved by Burton, seconded by Dowie
that the Agenda, as amended, for the Regular Session of September 21, 1981, at 7:00
P.M., be accepted and approved. Motion carried.
81131 - Moved by Wilharm, seconded by Burton
that the minutes of the Regular Session held September 14, 1981 at 7:00 P.M. be
approved. Motion carried.
HEARINGS & BIDS
81132 - Moved by Getty, seconded by Dowie
that proof of publication of notice of public hearing on proposed plans,
specifications, form of contract, estimate of costs, etc., for the construction of F.Y.
1981 Pinehurst Drainage Improvements, Contract No. 228 and taking of construction bids,
therefore, as published in the Waterloo Courier on September 14, 1981 be received and
placed on file. Motion carried.
81133 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for
written and oral objections and there were none.

that "Resolution confirming the approval of plans, specifications, etc., for the
construction of the F.Y. 1981 Pinehurst Drainage Improvements, Contract No. 228", be
adopted. Ayes: Five. Absent: Penaluna, Bowers.

that "Resolution ordering construction of F.Y. 1981 Pinehurst Drainage Improvements,

PETITIONS FROM PUBLIC
81137 - Don Temeyer, Plan and Program Director, reported that the Plan and Program Commission
had not formally reviewed the site plan, but would do so prior to the Council's public
hearing. A concern that they will address will be whether the entire campus should
hook up to sanitary sewer.

that communication from Plan and Program Commission transmitting site plan for Hawkeye
Institute of Technology to construct a Business and Health Building located northwest
of Hawkeye Center Building and north of Technical Arts Building be received, placed on
file and "Resolution fixing the time and place of hearing as October 5, 1981 at 7:00
P.M. at City Hall Council Chambers, Waterloo, Iowa on site plan proposal for Hawkeye
-Institute of Technology for addition of Business and Health Building", be adopted and
Clerk instructed to publish notice of hearing. Ayes: Five. Absent: Penaluna,
Bowers.

that request of Richard E. Smith for permission to construct a temporary asphalt
driveway at 525 Hartman Avenue, without regard to sidewalk grade together with $3.00
for recording waiver, and City Engineer's recommendation for approval subject to the
provisions of his letter be received, placed on file, approved and "Resolution granting
permission to Richard E. Smith and authorizing construction of a temporary asphalt
driveway at 525 Hartman Avenue, irrespective of a later official grade", be adopted.

UNFINISHED BUSINESS
81139 - Moved by Dowie, seconded by Wilharm
that communication from Sign & Traffic Department on closing of alley between Howard
Avenue, Plymouth Avenue, Wisconsin Street and LaPorte Road referred to 9/14/81 and
recommending that the alley be left open be received, placed on file, and alley left
open with a review of the traffic flow situation in three - four months and Larry
Reisinger informed of the Council's action. Motion carried.
81140 - Don Temeyer, Plan and Program Director, explained their recommendation would be to
reduce the request for rezoning to that area bounded by W. 15th Street, W. 18th Street,
Black Hawk Street, and the Cedar River. This rezoning reclassification would allow Mr.
Charles Heene to locate his business on W. 16th Street and vacated River Road and would
exclude all City -owned property from rezoning.
Councilman Burton stated that as a result of rezoning the property to "M-1" Light
Industrial District no new homes could be constructed in this zoned district; however,
this would not exclude residences from improving existing structures.
Attorney Hultman stated no new hearing needed to be scheduled if the request is
reduced, as the published notice included more than the reduced request.

that communication from Zoning Commission on rezoning from "U-1" Unclassified District
to "M-1" Light Industrial District (W. llth & 18th Streets) referred to under C.R.
#81107 of 9/14/81 be received and placed on file. Motion carried.

that Annual Report of the Waterloo Fire Department for F.Y. periods from January 1,
1980 - June 30, 1981 be received, placed on file and approved. Motion carried.

that communication from Professional Services of Iowa transmitting their proposal for
bus bench placement in the City of Waterloo referred to under C.R. 81053 of 9/8/81 be

that Change Order No. 1 for work performed in connection with F.Y. 1981 Rachael Street
Storm Sewer, Contract No. 212, together with City Engineer's recommendation for
approval, be received, placed on file, approved and Mayor and City Clerk authorized to

RESOLUTIONS TO BE ADOPTED
81145 John Fister, Attorney for Advanced Heat Treat Corp., explained that the firm would be
heat treating metals. Based upon a marketing survey, this proves to be a needed
business.
Councilman Wilharm stated that the City does have an ordinance in affect requiring that
prior to issuance of industrial revenue bonds that the company supply detailed
financial information to the City.
Mr. Fister stated that they would be willing to supply the necessary documentation
prior to week's end.

that "Resolution authorizing the execution of a Memorandum of Agreement by and between
the City of Waterloo, Iowa and Advanced Heat Treat Corporation, regarding the issuance
of Industrial Revenue Bonds not to exceed $400,000", be adopted. Ayes: Five. Absent:
Penaluna, Bowers.

that "Resolution fixing date of hearing as October 12, 1981 at 7:00 P.M. at West High

Treat Corporation) not to exceed $400,000", be adopted and instruct Clerk to publish
notice of hearing. Ayes: Five. Absent: Penaluna, Bowers.
