HomeMy WebLinkAbout08/17/81August 17, 1981 The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council Chambers, Waterloo, Iowa at 7:00 P.M., on August 17, 1981. Mayor Rooff in the Chair. On Roll Call: Present: Getty, Roehr, Wilharm, Bowers, Burton. Absent: Dowie, Penaluna. Invocation by Councilman Getty. 80948 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of August 17, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 80949 - Moved by Wilharm, seconded by Bowers that the minutes of the Regular Session held August 10, 1981 at 7:00 P.M. be approved. Motion carried. HEARINGS 80950 - Moved by Roehr, seconded by Wilharm that proof of publication of notice of public hearing on vacation of an easement located along the west lot line of Lot 18, Bonds Addition as published in the Waterloo Courier on August 7, 1981 be received and placed on file. Motion carried. 80951 - Moved by Wilharm, seconded by Roehr to receive and place on file the recommendation of approval from the Plan and Program Commission. Motion carried. 80952 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Getty that "an ordinance vacating the east two feet of the west eight feet of the north 66.13 feet of Lot 18, Bonds Addition, be received, placed on file and passed for the first time. Ayes: Five. Absent: Penaluna, Dowie. Motion carried. 80953 - Moved by Getty, seconded by Roehr that proof of publication of notice of public hearing on proposal to sell and convey real property located at the intersection of Carl and Newell Streets as published in the Waterloo Courier on August 3, 1981, be received and placed on file. Motion carried. 80954 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. The Deputy Clerk reported that one sealed bid had been received from 0. L. Love. The bid was opened with the bid in the amount of $525.00. Moved by Roehr, seconded by Wilharm to refer the above offer to buy to Plan and Program Department for review and recommendation. Motion carried. ORAL PRESENTATIONS 80955 - Dassine Melcher, 752 Sherman Avenue, spoke against the rezoning of property located east of Logan Avenue Plaza and north of Donald Street from "R-2" One and Two Family Residence District to "R-4" Multiple Family Residence District. She stated that the request had been reduced in size since the time of review by the Zoning Commission. Moved by Getty, seconded by Bowers to receive and place on file the above comments. Motion carried. 80956 - Councilman Burton presented two (2) petitions from area residents favoring the closing of Delane Avenue from Martin Road to Sergeant Road. Moved by Burton, seconded by Wilharm to receive and place on file the above petitions. (public hearing to be held on 8/24/81). Motion carried. 80957 - Mayor Rooff reported that a study of the intersection of Independence Avenue and Idaho Street had been completed (See C.R. of 80922 of 8/10/81). A possible solution to the situation will be attempted by painting crosswalks on the streets. The intersection will be monitored in the future. 80958 - It was reported that the bid of 0. L. Love was in order, except that the offer had not been signed by the bidder. Moved by Bowers, seconded by Wilharm that the above recommendation be received, placed on file and "Resolution authorizing the sale and conveyance of Lot 1, Block 3, Peek's 2nd Addition, City of Waterloo, Black Hawk County, Iowa to Ocie L. and Sarah Love in the amount of $525.00", be adopted subject to the bidder signing the bid sheet. Ayes: Five. Absent: Penaluna, Dowie. Resolution adopted and upon approval by Mayor assigned No. 1981-410. PETITIONS FROM PUBLIC 80959 - Moved by Roehr, seconded by Wilharm that request of R. P. Jaehrling for permission to construct a temporary asphalt driveway at 603 Hanna Blvd., without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to R. P. Jaehrling authorizing construction of a temporary asphalt driveway at 603 Hanna Blvd. irrespective of a later official grade", be adopted. Ayes: Five. Absent: Penaluna, Dowie. Resolution adopted and upon approval by Mayor assigned No. 1981-411. REPORTS 80960 - Moved by Wilharm, seconded by Bowers that minutes of the Community Development Board Meeting held on July 14, 1981 be received and placed on file. Motion carried. 180961 - Moved by Wilharm, seconded by Roehr that report of the Sign & Traffic Department on intersection study completed on Donald Street between Logan Avenue and East Fourth Street as requested by the City Council on 7/27/81 under C.R.#80857 be received, placed on file and approved. Motion carried. 80962 - In response to a question from Councilman Getty, Asst. City Attorney Kennedy stated that in a conversation with the five (5) defendents (Dolan, Helgesen, Beener, Shafer and Shoenfelder) he had recommended that they seek an outside attorney; however, in no way did this mean that the City would pay the expenses incurred for legal fees. Moved by Bowers, seconded by Burton that communication from five defendants of law suit requesting payment of legal fees incurred by the five (5) Police Officers be received, placed on file and denied. Ayes: Five. Absent: Penaluna, Dowie. Motion carried. DOCUMENTS 80963 - Moved by Roehr, seconded by Getty that communication from City Engineer transmitting construction plans for storm sewer facilities serving Heartland Hills together with recommendation of approval be received, placed on file and approved. Motion carried. ORDINANCES TO BE ADOPTED 80964 - City Engineer Anderson reported that this would legally change Jefferson Street to one-way. Moved by Burton, seconded by Getty that "an ordinance amending Ordinance No. 2644, known as the Traffic Ordinance, by Repealing Subsection (4) Jefferson Street of Section 542, One -Way Streets and Alleys, in its entirety, and enacting in lieu thereof new Subsection (4) Jefferson Street to Section 542, One -Way Streets and Alleys", be received, placed on file and passed for the first time. Ayes: Five. Absent: Penaluna, Dowie. Motion carried. 80965 - Moved by Getty, seconded by Bowers that "an ordinance amending Ordinance No. 2479, as amended, by adding Subsection No. 190, Rezoning Certain property to Section 2A-5", be received, placed on file and tabled for one week. Motion carried. BILLS - PAYMENT 80966 - Moved by Roehr, seconded by Bowers that "Resolution authorizing the payment of the following statements for work completed by consulting engineer and amount indicated together with recommendation for approval: Sewer System Evaluation Survey, Brice, Petrides & Associates, Inc. -- $22,651.70", be adopted. Ayes: Five. Absent: Penaluna, Dowie. Resolution adopted and upon approval by Mayor assigned No. 1981-412. August 17, 1981 -2- NEW BUSINESS 80967 - Moved by Burton, seconded by Getty that that the following requests for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: City Engineer to attend APWA Congress, Atlanta, Georgia, September 12-17, 1981 -- $910.00 Administrative Assistant to attend Life Safety Code Seminar, Chicago, Illinois, October 13-16, 1981 -- $710.00, plus use of City vehicle. Fire Marshall to attend Life Safety Code Seminar, Chicago, Illinois, October 13-16, 1981 -- $710.00 (Sharing ride) Ayes: Five. Absent: Penaluna, Dowie. Motion carried. Motion carried. BONDS 80971 - Moved by Wilharm, seconded by Bowers that communication from City Clerk on returning cash bond in the amount of $500.00 received from Circus Vargas for a circus held on August 6-9, 1981 together with recommendation to return an amount of $280.00 together with attached billings be received, placed on file and approved. Motion carried. 80972 - Moved by Bowers, seconded by Burton that report of City Attorney and list of bonds filed with Clerk through August 17, 1981, be received, placed on file and report and bonds approved.
