Mayor Rooff in the Chair. On Roll Call: Present: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Invocation by Councilman Getty. 80649 - Moved by Roehr, seconded by Getty that the Agenda, as proposed, for the Regular Session of June 15, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 80650 - Moved by Burton, seconded by Dowie that the minutes of the Regular Session held June 8, 1981 at 7:00 P.M. be approved. Motion carried. HEARINGS AND BIDS 80651 - Moved by Dowie, seconded by Burton that proof of publication of notice of public hearing on proposal to sell and convey property generally located at the intersection of Shilliam and Mobile Streets as published in the Waterloo Courier on May 29, 1981 be received and placed on file. Motion carried. 80652 - HOLD HEARING - This being the time and place of public hearing the Mayor called for written and oral objections and there were none. Moved by Wilharm, seconded by Bowers that bids be received, placed on file and instruct Deputy Clerk to open and read and refer to the Plan and Program Department for report back. Deputy Clerk reported that the following sealed bid was received: BIDDER AMT. OF BID Daniel Lee Oliver $500.00 Motion carried. HEARINGS 80653 - Moved by Roehr, seconded by Penaluna that proof of publication of notice of public hearing to rezone property located northeasterly of the intersection of E. 7th and Water Streets as published in the Waterloo Courier on May 29, 1981, be received and placed on file. Motion carried. 80654 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Don Temeyer, Plan and Program Director, reported that the request would be an extension of the "C-3" Central Business District zoning and that the proposed zoning would allow warehousing. The requestor proposes the construction of a new warehousing structure. Attorney Paula Larson spoke in favor of the request. Moved by Dowie, seconded by Penaluna that "an Ordinance amending Ordinance No. 2479, as amended, by adding Subsection No. 189, Rezoning Certain Property to Section 2A-5", be received, placed on file and passed for the first time. Ayes: Seven. Motion carried. 80655 - Moved by Penaluna, seconded by Dowie that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Four. Nays: Bowers, Getty, Wilharm. Motion NOT carried. The Mayor called for oral presentations and there were none. PETITIONS FROM PUBLIC 80656 - Moved by Roehr, seconded by Wilharm that request of Eddie Watkins ror permission to construct a temporary asphalt driveway at 1290 St. Andrews Avenue, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Eddie Watkins and authorizing construction of a temporary asphalt driveway at 1290 St. Andrews Avenue, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-306. 80657 Moved by Bowers, seconded by Burton that request of Ronald A. Peterson for permission to construct a temporary asphalt driveway at 467 South Hackett Road, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Ronald A. Peterson and authorizing construction of a temporary asphalt driveway at 467 South Hackett Road, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-307. 80658 - Moved by Roehr, seconded by Wilharm that request of Arnold Judas for permission to construct a temporary asphalt driveway at 736 Cedar Bend Street, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Arnold Judas and authorizing construction of a temporary asphalt driveway at 736 Cedar Bend Street, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-308. 80659 Moved by Burton, seconded by Bowers that request of Juanita M. Jennings for permission to construct a temporary asphalt driveway at 1167 Locke Avenue, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Juanita M. Jennings and authorizing construction of a temporary asphalt driveway at 1167 Locke Avenue, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-309. 80660 - Councilman Burton inquired if the petitioner was requesting that only his one half portion of the alley be paved. City Engineer, Ralph Anderson, answered that clarification was needed on this point. Moved by Burton, seconded by Wilharm that request of Robert Sieglaff to pave alley adjoining property located at 914 W. 3rd Street, be received, placed on file and action deferred for one week for further investigation by the City Engineer. Motion carried. 80661 Moved by Burton, seconded by Dowie that communication from Plan and Program Commission transmitting site plan for Calvary Cathedral Church for Phase I Addition for existing structure located at 3929 Richland Drive be received, placed on file and "Resolution fixing the time and place of hearing as July 6, 1981 at 7:00 P.M. in the City Hall Council Chambers on site plan proposal for Calvary Cathedral Church for Phase I Addition", be adopted and Deputy Clerk instructed to publish notice of hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-310. REPORTS 80662 - Moved by Dowie, seconded by Burton that minutes of the Community Development Board Meeting of May 12, 1981 be received and placed on file. Motion carried. DOCUMENTS 80663 - Mayor Rooff stated that the City would be selling General Obligation Bonds on July 16, 1981 to cover the cost of purchasing the former A&P Grocery Store. Chris Harshberger, Director of Hawkeye Valley Area Agency on Aging, stated that the facility would house several agencies that deliver services to the elderly and that the building would be used to deliver actual services to the elderly. Moved by Bowers, seconded by Penaluna that communication from Plan and Program Director transmitting proposed contract with Hawkeye Valley Area Agency on Aging for the purchase of the A&P Store generally located at the intersection of E. 7th & Franklin Streets, together with recommendation of approval, be received, placed on file and "Resolution authorizing the Mayor and Deputy Clerk to sign said contract on behalf of the City of Waterloo and to make payment in the amount of $162,000.00 for purchase of former A&P Grocery Store", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-311. 80664 - Moved by Roehr, seconded by Bowers that communication from Community Development Board transmitting Seventh Year Community Development Block Grant Application, together with recommendation for approval, be received, placed on file and "Resolution approving and providing for the execution of Housing and Community Development Block Grant Contract No. B -81 -MC -19-0008 by and between the City of Waterloo and the U.S. Department of Housing and Urban Development", be adopted and instruct Mayor and Deputy City Clerk to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-312. 80665 - Moved by Dowie, seconded by Roehr that communication from City Engineer recommending acceptance of storm sewer for Kimball Avenue Storm Sewer, Granger's Second Addition, together with two-year maintenance bond for said improvement be received, placed on file and approved with effective date of bond being that of Council approval. Motion carried. 80666 - Moved by Penaluna, seconded by Burton that communication from City Engineer recommending acceptance of sanitary sewer extension for Calhoun Street Sanitary Sewer Extension, Dave's Addition, together with two-year maintenance bond for said improvement be received, placed on file and approved with effective date of bond being that of Council approval. Motion carried. 80667 - Moved by Burton, seconded by Bowers that communication from City Engineer recommending acceptance of sanitary sewer extension for Dearborn Sanitary Sewer Extension, Harriet Hutchins Addition, together with two-year maintenance bond for said improvement be received, placed on file and approved with effective date of bond being that of Council approval. Motion carried. 80668 - Moved by Bowers, seconded by Dowie that contract, performance bond and certificate of insurance for Contract No. 224, from Denman Phillips Construction Co. be received, placed on file and "Resolution approving contract and bond of Denman Phillips Construction Co. of Waterloo, Iowa, for F.Y. 1981 Sidewalk Repair Program No. 2 in the amount of $9,532.85", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-313. 80669 - Moved by Roehr, seconded by Wilharm that communication from Engineering Department transmitting Agreement for Repair and Maintenance of Municipal Extensions of Primary Roads, together with recommendation for approval, be received, placed on file and "Resolution approving and providing for the execution of an agreement with the Iowa Department of Transportation for Repair and Maintenance of Municipal Extension of Primary Roads", be adopted and instruct Mayor to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-314. June 15, 1981 RESOLUTIONS TO BE ADOPTED 80670 - Moved by Burton, seconded by Bowers that "Resolution amending the Community Development Block Grant Program Budget by transferring funds in the amount of $6,000.00 from Community Development Block Grant Contingencies to Public Works, Facilities, and Site Improvements (Fowler Street Sewer)", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-315. 80671 Moved by Dowie, seconded by Burton that "Resolution amending the Community Development Block Grant Program Budget by transferring funds in the amount of $50,000.00 from Downtown UDAG Contingencies to Public Improvements", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-316. 80672 Moved by Roehr, seconded by Bowers that "Resolution designating the official meeting place of the City Council of the City of Waterloo for July 6, 1981, at 7:00 P.M. as Castle Hill Elementary School", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1981-317. 80673 Moved by Wilharm, seconded by Dowie that "Resolution establishing a policy of Annual Recertifications of all residents of Ridgeway Towers, Project No. IA -50-3", be adopted. ORDINANCES TO BE ADOPTED 80674 - Moved by Roehr, seconded by Wilharm that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Six. Nays: Burton. Motion carried. (Amendment of Ordinance No. 1971, by repealing Section 102 of Article I Eligibility.) 80675 - General discussion involved whether the requirements for eligibility for Journeyman Heating and Air Conditioning Licenses were adequate. James Boesen, Heating Inspector, expressed concern for the need for stringent requirements. Moved by Roehr, seconded by Wilharm that "an Ordinance amending City Ordinance No. 1971 of Waterloo, Iowa, as amended, by repealing in its entirety Section 102 of Article I Eligibility, and enacting in lieu thereof a new Section 102 of Article I Eligibility", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3150. 80676 Moved by Bowers, seconded by Burton that "an ordinance amending Ordinance No. 2479, as amended, known as the Zoning Ordinance by enacting a new Subsection B.3 to Section 2A-8 under Part IV "A-1" Agricultural District", be received, placed on file and passed for the third time. Ayes: Seven. Motion carried. 80677 Moved by Getty, seconded by Wilharm, that "An ordinance amending Ordinance No. 2479, as amended, known as the Zoning Ordinance by enacting a new Subsection B.3 to Section 2A-8 under Part IV "A-1" Agricultural District", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3151. 80678 - City Engineer, Ralph Anderson, stated that the cost of striping this portion of Jefferson Street (use of removable striping) is estimated to cost $1,200.00 - $1,500.00. Moved by Wilharm, seconded by Getty that "an Ordinance amending Ordinance No. 2644, known as the Traffic Ordinance, by repealing Subsection (4) Jefferson Street of Section 542, One -Way Streets and Alleys, in its entirety, and enacting in lieu thereof new Subsection (4) Jefferson Street to Section 542, One -Way Streets and Alleys", be received, placed on file and passed for the first time. Ayes: Six. Nays: Roehr. Ordinance adopted and upon approval by Mayor assigned No. 3152. NEW BUSINESS 80681 Moved by Roehr, seconded by Wilharm that communication from Fire Chief requesting Council approval of the following promotions in the Waterloo Fire Department effective June 15, 1981, be received, placed on file and approved: Capt. Virgil P. Cutsforth to the rank of Division Chief Capt. Herman Wenzel to the rank of Division Chief Lt. Robert G. Rohle to the rank of Captain Motion carried.
