HomeMy WebLinkAbout06/01/81June 1, 1981 The Council of the City of Waterloo, Iowa, met in Regular Session at Lincoln School, W. Parker and Burton Avenues at 7:00 P.M., on June 1, 1981. Mayor Rooff in the Chair. On Roll Call: Present: Bowers, Burton, Getty, Penaluna, Roehr, Wilharm. Absent: Dowie. Invocation by Councilman Wilharm. Mayor Rooff explained that the City Council was meeting at Lincoln Elementary School in order to bring the City's business to each of the wards. He thanked all those attending. 80531 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed, for the Regular Session of June 1, 1981, at 7:00 P.M., be accepted and approved. Motion carried. 80532 - Moved by Burton, seconded by Bowers that the minutes of the Regular Session held M 26, 1981 at 7:00 P.M. be approved. Motion carried. Don Temeyer, Plan and Program Director, explained all proposed uses of the bond money totaling $4.26 million. Moved by Wilharm, seconded by Dowie that "Resolution determining to proceed with the issuance and sale of not to exceed $3,970,000.00 General Obligation Bonds of the City of Waterloo", be adopted. Ayes: Seven. Moved by Burton, seconded by Bowers that "Resolution determining to proceed with the issuance and sale of not to exceed $150,000.00 General Obligation Bonds of the City of Waterloo", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-266. ORAL PRESENTATIONS 80565 - Denman Phillips asked what could be done about a problem he was experiencing with a city sidewalk program he is constructing. Mayor Rooff stated that a meeting will be set up with Brice, Petrides, & Associates, Inc., Cedar Falls Construction Company, City Engineer, etc. to address this problem. Moved by Wilharm, seconded by Burton to receive and place on file the above comments. Motion carried. PETITIONS FROM PUBLIC 80566 Moved by Roehr, seconded by Dowie that request of Loren C. Miller for permission to construct a temporary concrete driveway at 3755 Cedar Terrace Drive, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Loren C. Miller and authorizing construction of a temporary concrete driveway at 3755 Cedar Terrace Drive, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by mayor assigned No. 1981-267. 80567 - Moved by Dowie, seconded by Getty that communication from Plan and Program Director transmitting request of Charlie Teague to operate an Auto Salvage Yard as a special permit in an "M-1" Light Industrial District generally located along the eastern boundary of Black Hawk Waste Disposal and north of Rounds and Porter Co. together with Plan and Program Commission's recommendation for approval be received and placed on file and "Resolution setting date of hearing as June 22, 1981 at 7:00 P.M. in City Hall Council Chambers", be adopted and Clerk instructed to publish notice accordingly. June 1, 1981 -4- UNFINISHED BUSINESS 80568 Councilman Bowers reported that the Building & Grounds Committee had carefully considered all proposals for sale of the West Side Library and were recommending that the bid of Swisher and Cohrt be accepted with a deed restriction that if progress is not made on the site within two years that the firm will sell the property back to the City at the cost they originally paid for it. Moved by Bowers, seconded by Burton that the above recommendation be received and placed on file. Motion carried. 80569 Moved by Wilharm, seconded by Dowie that "Resolution approving the bid of Swisher & Cohrt in amount of $58,500.00 for the West Side Library site", be adopted and City Attorney instructed to deliver deed accordingly, with stipulation that if progress is not made on the site within two years that the firm will sell the property back to the City at the cost they originally paid for it. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-269. 80570 Moved by Dowie, seconded by Bowers that communication from Plan and Program Director recommending approval for tax abatement for 202 Ash be received, placed on file and "Resolution recommending approval on application of 202 Ash for tax abatement as permitted by the Urban Revitalization Bill", be adopted and Clerk instructed to forward said application to the City Assessor for final determination of tax exemption. Ayes: Five. Nays: Roehr, Wilharm. Resolution adopted and upon approval by Mayor assigned No. 1981-270. REPORTS 80571 - The Mayor explained that by ordinance the Plan & Program Commission should review all curb cut requests that are denied by the City Engineer and go to the Council for approval. In this case, this procedure was not adhered to. Moved by Roehr, seconded by Penaluna that communication from Plan and Program Director reporting on review of Holiday Gas Station's request for a curb cut at the intersection of Howard Avenue and U.S. Highway No. 218, be received and placed on file. Motion carried. 80572 - Moved by Burton, seconded by Penaluna that communication from Plan and Program Director transmitting Fiscal Year 1982 through 1986 Capital Improvements Program be received, placed on file and approved. Motion carried. 80573 - Moved by Dowie, seconded by Burton that communication from City Engineer transmitting a petition and waiver of assessment for a water service on Kern Street relating to F.Y. 1981 Paving Program, Contract No. 213 be received, placed on file and "Resolution approving the petition and waiver from Michael and Carolyn Norris for property located on E. 42 ft. of Lots 10 and 11, Block 2, East Park Place for copper water service", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-271. DOCUMENTS 80574 - Moved by Wilharm, seconded by Roehr that communication from City Engineer transmitting Supplemental Agreement No. 3 for Engineering Services with Brice, Petrides & Associates, Inc. for U.S. Highway 63 Interceptor Sewer and Pumping Station be received, placed on file, and "Resolution approving Supplemental Agreement No. 3 with Brice, Petrides, & Associates, Inc. for engineering services for U.S. Highway 63 Interceptor Sewer and Pumping Station", be adopted and Mayor and City Clerk authorized to execute said contract on behalf of the City. Resolution adopted and upon approval by Mayor assigned No. 1981-272. 80575 - Moved by Dowie, seconded by Bowers that Change Order No. 1 for work performed in connection with F.Y. 1981 Paving Program, Contract No. 213, by Cedar Valley Corporation, together with City Engineer's recommendation for approval, be received, placed on file, approved and Mayor and City Clerk authorized to execute same. Motion carried. 80576- Questions were raised as to the accommodation of storm water run-off in and around the proposed platted area. Don Temeyer, Plan and Program Director, stated that provisions were being made as a part of the construction plans for storm water run-off. June 1, 1981 -5- 80576 - Continued. Moved by Roehr, seconded by Getty that preliminary plat of Cloverdale Acres Replat No. 2 together with Deed of Dedication, report of City Engineer, report of Brice, Petrides & Associates, Inc., and Plan and Program Commission's recommendation for approval and its recommendation for Council approval, be received, placed on file and "Resolution approving the preliminary plat of Cloverdale Acres Replat No. 2 , Black Hawk County, Iowa", be delayed for one week for further investigation into storm water run-off. RESOLUTIONS TO BE ADOPTED 80579 - Moved by Roehr, seconded by Wilharm that "Resolution authorizing the issuance and sale of $400,000.00 Industrial Revenue Bonds, Series 19816 (Fahr Beverage, Inc. Resolution adopted and upon approval by Mayor assigned No. 1981-275. 80580 - Moved by Dowie, seconded by Burton that "Resolution authorizing the issuance and sale of $700,000.00 Industrial Revenue Bonds, Series 1981 (Crystal Ice and Cold Storage, Inc. Project)", be adopted. Ayes: Seven. Resolution adopted and upon appproval by Mayor assigned No. 1981-276. 80581 - Mayor Rooff explained that these funds, together with Federal funds would be used to expand the existing garage and allow for maintenance of their vehicles. Moved by Getty, seconded by Bowers that "Resolution authorizing the expenditure of $120,000.00 as the City's share for participation in the Capital Assistance Grant to enlarge the garage/office of the Metropolitan Transit Authority of Black Hawk County, Inc.", be adopted. Councilman Penaluna asked if the ordinance could be amended to exclude motorcycles. Discussion followed. Roll Call taken with the following results: Ayes: Three. Nays: Burton, Getty, Roehr, Wilharm. Motion NOT carried. 80591 - Moved by Roehr, seconded by Dowie that "Ordinance amending Ordinance No. 2644, known as the Traffic Code, by repealing Subsections (60), (61), (62) and (64), all La Porte Road, of Section 541, Increasing Speed Limits in Certain Areas; and enacting in lieu thereof new Subsections (60), (61), (62), (63) and (64), all La Porte Road, of Section 541, Increasing Speed Limits in Certain Areas", be received, placed on file and passed for the first time. Ayes: Seven. Motion undeclared. Ralph Anderson, City Engineer, explained that the existing speed limits are different than contained in this ordinance, as the state speeds vary. Moved by Dowie, seconded by Burton to table the first reading of the ordinance for one week. Motion carried. Motion carried. 80593 - Moved by Bowers, seconded by Burton that the City Engineer's preliminary plats, schedule of assessments, estimate of cost, etc. for F.Y. 1982 Oiling Program, Contract No. 224, be received, placed on file and "Resolution adopting preliminary plat and schedule, estimate of cost, etc. for F.Y. 1982 Oiling Program, Contract No. 224", be adopted.
