On Roll Call: Present: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Invocation by Councilman Bowers. 80494 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of May 26, 1981, at 7:00.P.M., be accepted and approved. Motion carried. 80495 - Moved by Burton, seconded by Dowie that the minutes of the Regular Session held May 18, 1981 at 7:00 P.M. be approved. Motion carried. HEARINGS AND BIDS 80496 Moved by Bowers, seconded by Burton that proof of publication of notice of public hearing on proposal to sell and convey the West Side Library as published in the Waterloo Courier on May 15, 1981, be received and placed on file. Motion -carried. 80497 - HOLD HEARING - This being the time and place for hearing the Mayor called for written and oral objections and there were none. Moved by Wilharm, seconded by Roehr that bids be received, placed on file and instruct Clerk to open and read and refer to the Plan and Program Department and Building and Grounds Committee for report back June 1, 1981. Motion carried. Clerk reported that the following sealed bids were received: BIDDER AMT. OF CERTIFIED CHECK AMT. OF BID 1) Family Alter Broadcast 2) Swisher & Court 3) Grout Museum of History & Science $3,200.00 $32,000.00 5,850.00 58,500.00 5,000.00 50,000.00 Margo Dundun, spokesperson for the Grout Museum, explained their proposed plans for expansion if their bid was accepted for the parcel. She indicated that the present library structure would be renovated in the interior for a planitarium facility. She explained that the museum continues to show growth in tourism and popularity. In addition, the museum has recently purchased the parcel adjacent to the library which fronts onto West Fourth Street. HEARING 80498 - Moved by Dowie, seconded by Bowers that proof of publication of notice of public hearing on site plan for a parking lot for Allen Hospital property generally located north of Donald Street between Logan Avenue and Heath Street as published in the Waterloo Courier on May 8, 1981, be received and placed on file. Motion carried. 80499 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Burton, seconded by Penaluna that "Resolution approving the site plan for Allen Memorial Hospital Corporation Parking Lot, Auditor Barnes Plat No. 1 to be located north of Donald Street between Logan Avenue and Heath Street", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-244. 80500 - Moved by Bowers, seconded by Burton that proof of publication of notice of public hearing on entering into a lease -purchase option contract for the purpose of acquiring complete telephone systems for the City of Waterloo as published in the Waterloo Courier on May 20, 1981, be received and placed on file. Motion carried. 80501 HOLD HEARING - .,pis being the time and pla, to hold hearing the Mayor called for written and oral objections and there were none. Moved by Wilharm, seconded by Bowers that "Resolution relating to the holding of a public hearing and instituting proceedings to take additional action for the making of and authorizing the execution and delivery of a lease -purchase option contract for the purpose of acquiring complete telephone systems necessary to equipment and improve various City -owned facilities; the execution and delivery of a certain security agreement with the City as thereunder; and related matters", be adopted and Mayor and City Clerk authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-245. X ORAL PRESENTATIONS The Mayor called for oral presentations and there were none. PETITIONS FROM PUBLIC 80502 - Moved by Dowie, seconded by Penaluna that request of John Russell for Council on its motion to rezone from C-2�� Commercial District to "C-3" Central Business District a parcel of land generally located northeasterly of the intersection of East Seventh and Water Streets together with Zoning Commission's recommendation for approval, be received, placed on file, and "Resolution setting date of hearing as June 15, 1981 at 7:00 P.M. in the City Hall Council Chambers", be adopted, and Clerk instructed to publish notice accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-246. 80503 Moved by Bowers, seconded by Burton that request of Joe W. Buckley for permission to construct a temporary asphalt driveway at 231 Auburn Street, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Joe W. Buckley and authorizing construction of a temporary asphalt driveway at 231 Auburn Street, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-247. 80504 Moved by Roehr, seconded by Getty that request of Elmer Mennenga for permission to construct a temporary asphalt driveway at 225 Auburn Street, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to Elmer Mennenga and authorizing construction of a temporary asphalt driveway at 225 Auburn Street, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-248. 80505 Don Temeyer, Plan and Program Director, stated that the parcel in question is the only City right-of-way remaining within the block and that approval of the adjacent property owner had been received. Moved by Wilharm, seconded by Roehr that communication from Plan and Program Commission transmitting request of The National Bank of Waterloo to remove concrete on alley adjacent to their downtown branch be received, placed on file and approved. Motion carried. 80506 - Moved by Roehr, seconded by Bowers that "Resolution recommending approval of application of 202 Ash for tax abatement as permitted by the Urban Revitalization Bill", be tabled for one week. Motion carried. 80507 Moved by Roehr, seconded by Penaluna that communication from Plan and Program Director transmitting request of Daniel Lee Oliver for sale and conveyance of property generally located at the northeast corner of Mobile and Shilliam Streets, be received, placed on file and "Resolution setting date of hearing as June 15, 1981 at 7:00 P.M. in the City Hall Council Chambers on proposal to sell and convey property located at the northeast corner of Mobile and Shilliam Streets", be adopted and minimum bid established at $500.00. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-249. May 26, 1981 -2- REPORTS 80508 Moved by Bowers, seconded by Burton that the minutes of the Community Development Board Meeting held on April 7, 1981, be received and placed on file. Motion carried. 80509 Moved by Bowers, seconded by Getty that communication from City Engineer making recommendation on the award of F.Y. 1981 Fowler Street Sanitary Sewer Program, Contract No. 216, to Lehman Trucking & Excavating, Inc. in the amount of $59,933.00 be received, placed on file, and "Resolution awarding F.Y. 1981 Fowler Street Sanitary Sewer Program, Contract No. 216 to Lehman Trucking & Excavating, Inc. in the amount of $59,933.00", be adopted and instruct Clerk to return unsuccessful bids. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-250. DOCUMENTS 80510 - Moved by Roehr, seconded by Wilharm that contract for engineering services for Contract No. 226 be received, placed on file and "Resolution approving the contract for Schenk Engineering Company of Waterloo, Iowa, for F.Y. 1982 Cedar Terrace Area Paving Program, Contract No. 226", be adopted and Mayor and City Clerk authorized to sign said contract on behalf of the City. Resolution adopted and upon approval by Mayor assigned No. 1981-251. 80511 - Moved by Wilharm, seconded by Dowie that construction plans for sanitary sewerage facilities for Alexandra Circle, Southtown together with Treatment Agreement Form WQ-59 from the Department of Environmental Quality and City Engineer's recommendation for approval subject to final acceptance of plans by the Department of Environmental Quality, be received, placed on file, recommendation approved and Mayor and City Clerk authorized to execute same. Motion carried. RESOLUTIONS TO BE ADOPTED 80512 - Moved by Dowie, seconded by Roehr that "Resolution setting date of hearing as June 8, 1981 in City Hall Council Chambers for the adoption of the amended budget for the City of Waterloo for Fiscal Year 1981", be adopted and Clerk instructed to publish notice accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-252. 80513 - Moved by Roehr, seconded by Bowers that "Resolution abolishing two positions in the Office of the City Clerk", be adopted and Clerk instructed to make notification. ORDINANCES TO BE ADOPTED 80514 Moved by Dowie, seconded by Burton that "an Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Subsection (f) of Section 34-54, Basic Charge and Rates Established; Basis of Determination; Increase of Rates and Charges for Delinquent Payments, of Chapter 34, Utilities; and enacting in lieu thereof new Subsection (f) to Section 34-54, Basic Charge and Rates Established; Basis of Determination; Increase of Rates and Charges for Delinquent Payments, of Chapter 34, Utilities", be received, placed on file and passed for the first time. Ordinance adopted and upon approval by Mayor assigned No. 3143. 80518 - Moved by Burton, seconded by Bowers that "An Ordinance amending Ordinance No. 2644, known as the Traffic Ordinance, by adding Subsection 19.1, Motorized Bicycle or Motor Bicycle, to Section 3, Words and Phrases Defined; and by repealing Section 85, Operation of Motorcycles, and Enacting in lieu thereof new Section 85, Operation of Motorcycles and Motorized Bicycles", be received, placed on file and passed for the second time. NEW BUSINESS 80521 Moved by Bowers, seconded by Roehr that communication from Fire Chief reporting retirement of Arthur F. Ecklund effective June 15, 1981 and entitlement of 5 weeks vacation pay, six (6) twenty-four hour vacation days, and 219 days sick leave be received, placed on file and "Resolution approving payment of $11,750.18 vacation and sick pay to Arthur F. Ecklund, Fire Department", be adopted. Ayes: Seven.
