Motion carried. 80462 - HOLD HEARING - This being the time and place to hold hearing, the Mayor called for written and oral objections. Don Temeyer, Plan and Program Director, stated that the Zoning Commission's recommendation for denial was based upon the existence of surrounding "M-1" Light Industrial Zoning and that residential zoning was in conflict with the proposed land use plan. Chuck Mattson, attorney for applicant, stated that the intentions of the owner were to remodel the existing building, with the trailer to be used for storage of computer hardware and software. The two (2) structures would be connected by a breezeway. This would be used as a temporary structure for two to three years. Moved by Getty, seconded by Burton that request of Kathryn Kunz, owner of real estate located at 2530 Falls Avenue and The Computer Center, Inc. at same address to permit the placement, installation and use of a mobile home in conjunction with the existing building located behind said real estate together with sketch of proposed location be received, placed on file and "Resolution approving the location of a mobile home at 2530 Falls Avenue for said Kathryn Kunz and The Computer Center, Inc.", be denied. Ayes: Seven. Motion carried. 80467 - Moved by Penaluna, seconded by Bowers that communication from City Engineer transmitting petitions from residents requesting inclusion in the F.Y. 1982 Oiling Program, Contract No. 225 be received, placed on file and instruct the Engineer to proceed accordingly. Motion carried. 80468 - Moved by Roehr, seconded by Dowie that request of William E. Brown for permission to construct a temporary asphalt driveway at 3140 West Fourth Street, without regard to sidewalk grade together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, approved and "Resolution granting permission to William E. Brown and authorizing construction of a temporary asphalt driveway at 3140 West Fourth Street, irrespective of a later official grade", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1981-235A 80469 - The Mayor reported that in testing the sound level of Cedar Valley when cutting paving the level was only 2 decibels above the allowable maximum. In an open area, free of buildings that tend to act as echo chambers, the level probably would not exceed the maximums. Discussion followed on the times of day which their operation had been in progress and that the noise ordinance had specific hours in which it was forbidden to operate. Generally, it was the opinion that the applicant abide by time limits and guidelines of the ordinance. Moved by Bowers, seconded by Burton that request of Cedar Valley Corporation for variance to Noise Ordinance, Ordinance No. 3094, referred to under C.R. #80417 of May 11, 1981 be received, placed on file and "Resolution authorizing variance to Noise Ordinance No. 3094 to Cedar Valley Corporation", be denied and Deputy Clerk instructed to send a letter to Cedar Valley Corporation informing them of the Council's action. Ayes: Five. Nays: Dowie, Penaluna. Motion carried. REPORTS 80470 - Bruce Bottorff stated that the increase would not exceed the amount allowed by statute. Moved by Roehr, seconded by Penaluna that communication from Director of Water Pollution Control Plant transmitting recommendation for increase in sewer rental fees in the amount of 7 cent increase per one hundred cubic feet in excess of minimum rate be received, placed on file, approved and instruct City Attorney to submit an ordinance accordingly. Ayes: Seven. Motion carried. 80471 - Moved by Burton, seconded by Dowie that communication from City Engineer recommending acceptance of sanitary sewer for Diagonal Road Sanitary Sewer Extension, together with two-year maintenance bond for said improvement, be received, placed on file and approved with effective date of bond being that of date of Council approval. Moved by Bowers, seconded by Dowie that "Resolution authorizing the execution of a Memorandum of Agreement by and between the City of Waterloo, Iowa and Dynamic Tool Company regarding the issuance of Qualified Industrial Development Revenue Bonds, Series 1981 and fixing date of hearing on said issuance as June 8, 1981 at 7:00 P.M. in the City Hall Council Chambers", be adopted. ORDINANCES TO BE ADOPTED 80480 Moved by Getty, seconded by Wilharm that "an Ordinance amending the Traffic Ordinance (No. 2644) by repealing Subsections (9), (9a) and (10), all Broadway Street, (22), (23), (24) and (25), all Dubuque Road, of Section 541, Increasing Speed Limits in Certain Areas, and enacting in lieu thereof new Subsections (9), (9a), (10) and (10a), all Broadway Street, (23), (24) and (25), all Dubuque Road, to Section 541, Increasing Speed Limits in Certain Areas; and by adding Subsections (70a) and (70b), Martin Road, to Section 541, Increasing Speed Limits in Certain Areas", be received, placed on file and passed for the first time. MISCELLANEOUS 80485 - Councilman Getty asked about the fire lane ordinance that had been discussed on May 4, 1981 (see C.R.# 80402). He was told that a meeting would be taking place to study how such an ordinance could be enforced.
