The Council of the City of Waterloo, Iowa, met in Regular Session in Council Chambers in the
City Hall at 7:00 P.M., on April 13, 1981. Mayor Rooff in the Chair. On roll call: Present:
Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invocation by Council-
man Bowers.
80226 - Moved by Roehr, seconded by Dowie, that the Agenda, as amended, for the Regular Session
of April 13, 1981, at 7:00 P.M., be accepted and approved. Motion carried.
80227 - Moved by Burton, seconded by Wilharm, that the minutes of the Regular Session held April
6, 1981 at 7:00 P.M. be approved. Motion carried.

and voted for passage at two prior meetings, be suspended, the above ordinance recorded

80248 - Moved by Dowie, seconded by Penaluna, that petition signed by 60% of area residents
against the request of Cedar Falls Oil Co. to rezone property located at the inter-
section of Howard Avenue and U.S. Highway 218 to "C-1" Commercial District be received
and placed on file. Motion carried.
80249 - HOLD HEARING - This being the time and place of hearing, the Mayor called for written
or oral objections.
Councilman Bowers asked if it was legal to discuss this matter and was advised by Attorney
Vic Kennedy that the public hearing provided the opportunity to discuss the rezoning.
Jerry Jensen stated that the only changes in the site plan was the change in curb cut
location on Howard Avenue which is now located closer to U.S. Highway 218.
Charles Henry, 1932 Locke Avenue, stated that he opposed the site for a gas station due
to the potential for increased traffic.
Sam Beatty, Attorney, stated that the proposed "C-1" Commercial Zoning is a natural pro-
gression given the surrounding zoning classifications. He felt that the lots were most
adequately suited for commercial development.
Charles Mattson, Attorney, for area residents, stated that the commercial rezoning of
the property would adversely affect the residential nature of the neighborhood. With
the "double -wide" curb cut on Howard Avenue, residents expressed that Howard Avenue
would be a major carrier of traffic in and out of the site.
Jerry Jensen, stated that the flow of traffic would be encouraged to use La Porte Road
as an entrance and Howard Avenue as an exit.
Eric Thorson, Asst. City Engineer, stated that the Engineer's Office objected to a curb
cut on La Porte Road due to continued increases in traffic volumes.
Moved by Penaluna, seconded by Roehr, that "An Ordinance amending Ordinance No. 2479, as
amended, by adding Subsection No. 189, Rezoning Certain Property to Section 2A-5" be re-
ceived, placed on file and passed for the first time. Ayes: Dowie, Getty, Penaluna,
Roehr. Nays: Bowers, Burton, Wilharm. Motion NOT carried.
80250 - Moved by Roehr, seconded by Getty, that Proof of Publication of Notice of Public Hearing

ORAL PRESENTATIONS
80256 - A representative of D.H. Blattner & Sons who is presently under contract with the Iowa
Department of Transportation to do grading work on the I-380 and Freeway 520 interchange
asked that he be granted a variance to the noise ordinance. He asked that he be allowed
to run heavy equipment twenty (20 hr.) per day.
This is necessary to meet the construction schedule of Department of Transportation.
He anticipates beginning work in about two weeks with completion scheduled for August
15, 1981.
Moved by Burton, seconded by Bowers, to receive and place on file the above request and
"Resolution granting a variance to Ordinance No. 3094, Noise Ordinance", be adopted.

80257 - Councilman Getty asked that the Sign and Traffic Department investigate the placement
of a 4 -Way Stop at the intersection of Wisconsin Street and Mitchell Avenue.
Moved by Getty, seconded by Dowie, to refer the above matter to the Sign and
Traffic Department for a report back. Motion carried.
PETITIONS FROM PUBLIC
80258 - Mayor Rooff stated that this easement was a requirement of the Department of Housing
and Urban Development and the City Attorney's Office has given approval to the form.
Moved by Burton, seconded by Getty, that communication from Plan and Program Director
transmitting the request of Harry Bookey, Attorney in Fact for Waterloo Housing Part-
ners for an easement addendum for Ridge Village West located at 1620 Downing together
with recommendation of approval be received, placed on file and "Resolution authorizing
the execution of aneasement addendum for Ridge Village West", be adopted. Ayes: Six.

80262 - Bob Heene, Bob's Barricades, indicated that he had received approval from the adjacent
property owner to temporarily use his property and had indicated that he would con-
struct a fence following completion of construction.

making report on a petition filed with the City Council on April 6, 1981 under C.R.#
