00 P.M., on April 6, 1981. Mayor Rooff in the Chair. On roll call: Present:
Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invocation by Council -
80163 - Moved by Roehr, seconded by Dowie, that the Agenda as amended, for the Regular Session
of April 6, 1981, at 7:00 P.M. be approved. Motion carried.
80164 - Moved by Burton, seconded by Bowers, that the minutes of the Regular Session held March
23, 1981 at 7:00 P.M. be approved. Motion carried.
Mayor Rooff introduced the Boy Scout Troop from Den 1, Pack 1 of Irving School.
80165 - Kathy Braun, of the Waterloo Community Betterment Council presented a check in the
amount of $100.00 and a plaque to the City of Waterloo for the community's involvement
in voluntary work.
Moved by Wilharm, seconded by Burton, that check in the amount of $100.00 from the Iowa
Development Commission Foundation, Inc., for voluntarism given to the City of Waterloo,
be received, placed on file and Mayor Rooff instructed and directed to endorse said
check and return same to the Waterloo Community Betterment Council to carry on their
work. Motion carried.

80166 - Moved by Roehr, seconded by Dowie, that proof of publication of notice of public hearing
on installation of an emergency generator at City Hall and taking of installation bids,
therefore, as published in the Waterloo Courier on March 20, 1981, be received and placed
on file. Motion carried.
80167 - Moved by Bowers, seconded by Getty, to receive, place on file, instruct City Clerk to
open following sealed bids and refer to Civil Defense for report back:

80168 - Moved by Roehr, seconded by Burton, that proof of publication of notice to property
owners on public hearing on a proposed Resolution of Necessity for F.Y. 1981 Paving
Program, Contract No. 213, be received and placed on file. Motion carried.
80169 - HOLD HEARING - This being the time and place for hearing the Mayor called for written
and oral objections. The City Clerk reported no written objections on file.
The Mayor called for objections on Hartman Avenue and there were none.
The Mayor called for objections on Upton Avenue and there were none.
The Mayor called for objections on Lincoln Street and there were two (2).
The Mayor called for objections on Reed Street and there were none.
The Mayor called for objections on Kern Street and there were two (2).
After receiving or hearing written and oral objections, the Mayor declared the time for
receiving of objections to be closed. After reviewing all the objections received, the
Council found and determined that no remonstrance, pursuant to the provisions of Section
384.51 of the State Code of Iowa, was filed with the Council, pertaining to the proposed
improvement as set out in said Resolution of Necessity as originally proposed.

1981 Paving Program, Contract No. 213", be adopted. Ayes: Seven. Resolution adopted

detailed plans and specifications and directing Attorney to prepare form of contract
and notice to bidders on the "Waterloo, Iowa, F.Y. 1981 Paving Program, Contract No.
213", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor,

form of contract, form of proposal, preliminary estimate of cost, etc., and notice to

and "Resolution ordering bids, approving plans, specifications and form of contract and
notice to bidder, fixing amount of bid security and ordering Clerk to publish notice

80174 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for
written and oral objections and there were none.
Moved by Bowers, seconded by Burton, that "Resolution authorizing the sale and convey-
ance of certain excess right-of-way to James L. Rooff and Ramona E. Rooff, for $2,900.00
and authorizing the Mayor and City Clerk to execute and deliver a deed for same", be
adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No.
1981-140.
ORAL PRESENTATIONS
80175 - Sandy Wyant, 1317 Jefferson Street, stated her opposition to the operation of Bob's
Barricades (ready mix concrete operation) next to her residence, in particular the
closeness of the operation to her home. She also presented a petition from area
residents opposing the business, as well as pictures of the operation.
Don Temeyer, Plan and Program Director, explained that the site had been zoned "M-1"
Light Industrial and that the petition of opposition had not been filed at the time of
the rezoning consideration.
Moved by Dowie, seconded by Burton, that the above matter be referred to the Plan and
Program staff with a report back on April 13, 1981. Motion carried.
80176 - Ken Dooley, 192 Greenwood, complained of the kegger party that took place in Sherwood
Park over the past weekend. The Police Department did respond to his complaint, but
the party continued far into the evening. He expressed his concern that similar situa-
tions may exist throughout the summer.
In addition, he asked that the City investigate garbage billings since several of his
properties were not charged for the service until he contacted the Water Works.
Mayor Rooff thanked him for his honesty.
Moved by Wilharm, seconded by Dowie, that the above remarks be received and placed on
file. Motion carried.
80177 - Attorney Hultman stated that proper procedure in awarding the bid for police cars would
be to place it on next week's agenda, thereby giving proper notice to all affected par-
ties.
Moved by Roehr, seconded by Dowie, that the awarding of a bid on eleven (11) police
cars (referred to the full Council from the Finance Commission on April 6, 1981) be
placed on the City Council agenda for April 13, 1981. Motion carried.

80178 - Moved by Roehr, seconded by Getty, that communication from Plan and Program Director
requesting the sale and conveyance of the property formerly occupied by the West Side
Library generally located at the intersection of West Fourth and South Streets, be re-
ceived, placed on file and "Resolution setting date of hearing as April 27, 1981 at
7:00 P.M. in the City Hall Council Chambers on proposal to sell and convey the site
formally occupied by the West Side Library", be adopted and minimum bid established at
$78,750.00 (75% of appraisal) and bidders requested to submit written proposals on site

80179 - Moved by Bowers, seconded by Penaluna, that communication from Plan and Program Director
transmitting request of Joe Minard Construction Co. to purchase a parcel of property
generally located between Huntington Road and Sager Avenue and borders the Cedar Falls -
Waterloo City limits together with recommendation of approval, be received, placed on
file and "Resolution setting date of hearing as April 27, 1981 at 7:00 P.M. in the City
Hall, Council Chambers", be adopted, and Clerk instructed to publish notice, with
minimum bid being that of appraisal price. Ayes: Seven. Resolution adopted and upon

80180 - Moved by Burton, seconded by Dowie, that request of Percy Burt for sale of parcel of
property currently owned by the City of Waterloo and generally located at the southeast
corner of the intersection of Shilliam and Halstead Streats be received, placed on file
and "Resolution fixing the time and place of hearing and receiving of bids as April 27,
1981 at 7:00 P.M. in the Council Chambers on proposal to sell certain property in
Shilliam's Third Subdivision", be adopted and Clerk instructed to publish notice of
public hearing, with a minimum $3,000.00 plus costs. Ayes: Seven. Resolution adopted

80181 - Moved by Roehr, seconded by Bowers, that communication from Plan and Program Commission
transmitting the site plan for Tract B, Southland Park, be received, placed on file and
"Resolution fixing the time and place of hearing as April 27, 1981 at 7:00 P.M. in the
City Hall Council Chambers on site plan proposal in Tract B, Southland Park", be adopted
and Clerk instructed to publish notice of hearing. Ayes: Seven. Resolution adopted and
upon approval by Mayor, assigned No. 1981-144,
80182 - Don Temeyer, Plan and Program Director, reported that the Board of Adjustment had denied
the request of Leon Wirtjes for a variance for a lot behind 420 Bourland and that the
opinion of the staff was that the City Council could not legally take action on this
item. The applicant's only alternative is to appeal the case to district court, ask
the Board of Adjustment for reconsideration or change the ordinance to reflect lesser
width and lot requirements. Attorney Hultman concurred with this interpretation.
Moved by Wilharm, seconded by Bowers, that request of Leon K. Wirtjes, Diversified Real
Estate Co., Inc., for City Council to approve a variance for a lot behind 420 Bourland
Avenue in regard to lot width and square footage of said lot, be received, placed on
file and denied. Motion carried.
80183 - Moved by Penaluna, seconded by Bowers, that request of Metropolitan Patient Transfer,
Inc., to raise current rates for service as shown on the attached sheet, be received,
placed on file and "Resolution approving rate increases for Metropolitan Patient Trans-
fer, Inc.", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor,
assigned No. 1981-145._
REPORTS
80184 - Mayor Rooff reported that after consultation with Department of Transportation officials
that the concept of a belt -line road around the City was an acceptable alternate to the
proposed freeway. The plan would result in reduced construction costs and an excelerated
time -table.
Moved by Wilharm, seconded by Bowers, that this progress report from Mayor Leo Rooff on
the status of the Interstate I-380 Substitution Plan be received, placed on file and
"Resolution agreeing to the concept of the I-380 Substitution Plan of a Belt -line road
around the City and that said plan be forwarded to the Iowa Department of Transportation
for review and consideration", be adopted. Ayes: Seven. Resolution adopted and upon
approval by Mayor, assigned No. 1981-146.
80185 - Don Temeyer, Plan and Program Director, reported that word from Iowa Department of Trans-
portation on advance acquisition of this property had not been received, but was expected
in the next few days.

Black Hawk County Criminal Justice Information System transmitting agreement forming
a joint controlling board for maintaining a Black Hawk County Criminal Justice Informa-

execute an agreement in connection with the Black Hawk County Criminal Justice Infor-

80196 - Hugh Field, Board Representative, stated that this agreement would allow their employees
to be covered by the Iowa Public Employees Retirement System and allow the City to levy
$.54 per $1,000.00 of valuation for our subsidy to MET outside the General Fund.

allow for the organization of Metropolitan Transit Authority as provided in Chapter 28E
of the State Code of Iowa, be received and placed on file, and "Resolution authorizing
