The Council of the City of Waterloo, Iowa, met in Regular Session in Council Chambers in the
City Hall at 7:00 P.M., on January 19, 1981. Mayor Pro Tem, Jack Roehr in the Chair. On roll
call: Present: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invo-
cation by Councilman Getty.
79826 - Moved by Dowie, seconded by Burton, that the Agenda, as amended, for the Regular Session
of January 19, 1981, at 7:00 P.M., be accepted and approved. Motion carried.
79827 - Moved by Burton, seconded by Dowie, that the minutes of the Regular Session held January
12, 1981 at 7:00 P.M. be approved. Motion carried.
Troop 225 from the Knights of Columbus was introduced.
HEARINGS
79828 - Moved by Burton, seconded by Wilharm, that proof of publication of notice of public hear-
ing on proposal to sell and convey an alley bounded by Iowa Street, East Fourth Street,
Argyle Street, and Saxon Street, as published in the Waterloo Courier on the 5th day of
January 1981, be received and placed on file. Motion carried.
79829 - HOLD HEARING - This being the time and place to hold hearing the Mayor Pro Tem called
for written and oral objections and there were none.
Moved by Wilharm, seconded by Bowers, that "Resolution authorizing sale and conveyance
of a portion of an alley of Railroad Addition to James Roland", be received, placed on
file and passed for the first time. Ayes: Seven. Resolution adopted and upon approval
by Mayor Pro Tem, assigned No. 1981-21.
79830 - Moved by Getty, seconded by Bowers, that proof of publication of notice of public hear-
ing on request of Youngblut Construction Co. to rezone from "A-1" Agricultural District
to "C-2" Commercial District as published in the Waterloo Courier January 5, 1981, be
received and placed on file. Motion carried.
79831 - HOLD HEARING - This being the time and place to hold hearing the Mayor Pro Tem called
for written and oral objections and there were none.
Moved by Bowers, seconded by Dowie, that "An Ordinance amending Ordinance No. 2479, as
amended, by adding Subsection No. 185 to Section 2A-5, Rezoning Certain Property", be
received, placed on file and passed for the first time. Ayes: Seven. Motion carried.
ORAL PRESENTATIONS
79832 - Councilman Dowie presented petitions containing 135 signatures for asphalting paving on
certain streets in Cedar Terrace.
Moved by Dowie, seconded by Penaluna, that these petitions be received, placed on file
and referred to the City Engineer's for a report back. Motion carried.
PETITIONS FROM PUBLIC
79833 - Moved by Dowie, seconded by Bowers, that communication from Plan and Program Director
transmitting four applications fox tax abatements as permitted by the Urban Revitali-
zation Bill and recommending approval for properties located at 517 Cottage, 637 Adams,
733 Willow and recommending denial for the property at 316 Glenwood for reasons outlined
in the attached letter, be received, placed on file. Motion carried.
79834 - Don Temeyer, Plan and Program Director, explained that the applications would be forward-
ed to the City Assessor for his determination for tax exemption.
Councilman Burton questioned the procedure of the City Assessor first determining the
value of the exemption before completion of the improvement.
Brenda Miller, Executive Director of Neighborhood Housing Services, explained that pro-
cedures for this process are set by State Legislation.
Moved by Dowie, seconded by Bowers, that "Resolution recommending approval on application
of 517 Cottage Street for tax abatement as permitted by the Urban Revitalization Bill",
be adopted and Clerk instructed to forward said application to the City Assessor for
final determination of tax exemption. Ayes: Six. Nays: Wilharm. Resolution adopted
and upon approval by Mayor Pro Tem, assigned No. 1981-22.

79835 - Moved by Bowers, seconded by Getty, that "Resolution recommending approval on applica-
tion of 637 Adams Street for tax abatement as permitted by the Urban Revitalization Bill",
be adopted and Clerk instructed to forward said application to the City Assessor for
final determination of tax exemption. Ayes: Six. Nays: Wilharm. Resolution adopted
and upon approval by Mayor Pro Tem, assigned No. 1981-23.
79836 - Moved by Bowers, seconded by Getty, that "Resolution recommending approval of applica-
tion of 733 Willow Street for tax abatement as permitted by the Urban Revitalization
Bill", be adopted and Clerk instructed to forward said application to the City Assessor
for final determination of tax exemption. Ayes: Six. Nays: Wilharm. Resolution
adopted and upon approval by Mayor Pro Tem, assigned No. 1981-24.

Staff to deny all future requests that are not located within the Urban Revitalization

79839 - Moved by Dowie, seconded by Bowers, that communication from Finance Director, reporting
the Police and Fire Pension Boards approved the Actuarial Valuation Report of Towers,
Perrin, Forster & Crosby, Minneapolis, Minnesota, to be filed with State Commissioner
of Insurance for payment to the City of $114,329.00 Police Retirement System and
$157,161.00 Fire Retirement System for plan year 7/1/80, be received, placed on file
and "Resolution approving the Police and Fire Pension Boards Actuarial Valuation Report",
adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem, assigned
No. 1981-27.
79840 - Moved by Bowers, seconded by Getty, that the minutes of the Community Development Board
held on December 8, 1980, be received, placed on file and approved. Motion carried.
79841 - Dale Mercer, Community Development Administrator, presented a brief recap of the Board's
past activities

DOCUMENTS
79842 - Jack Roehr, Mayor Pro Tem, indicated that he had an opportunity to discuss the amend-
ment and its affect. He now was satisfied with the amendment.
Moved by Bowers, seconded by Penaluna, that communication from Community Development
Board transmitting first amendment to the contract between Neighborhood Housing Ser-
vices and the City of Waterloo, be received, placed on file an' "Resolution authoriz-
ing the Mayor and City Clerk to execute first amendment to contract between Neighbor-
hood Housing Services and the City of Waterloo", be adopted. Ayes: Six. Nays: Wilharm.

79843 - Moved by Bowers, seconded by Burton, that communication from Community Development
Administrator transmitting an offer of sale from National By -Products, Inc., for pro-
perty in conjunction with Stage V -D and V -F of the local Flood Control Project generally
located at the southerly end of Nevada Street be received, placed on file and "Resolu-
tion accepting and approving certain offers to sell real property to the City and accept-
ing and approving certain deeds from National By -Products, Inc.", be adopted. Ayes:

79845 - Moved by Dowie, seconded by Bowers, that "Resolution fixing date of hearing on proposed
qualified Industrial Development Revenue Bonds, Series 1981 (W. W. Grainger, Inc.) as
February 9, 1981 at 7:00 P.M. in the City Hall Council Chambers", be adopted and Clerk
instructed to publish notice accordingly. Ayes: Seven. Resolution adopted and upon
approval by Mayor Pro Tem, assigned No. 1981-31.
79846 - Larry Burger, City Clerk, explained that the list of records had been reviewed by the
City Attorney's Office and were found adequate to be destroyed. The State Code allows
for such records to be destroyed.
Moved by Bowers, seconded by Burton, that "Resolution authorizing and directing the
Waterloo City Clerk to destroy certain records and papers of the Waterloo Riverfront
Commission dated prior to January 1, 1971, as provided in Section 372.13, Paragraph
5, of the 1977 Code of Iowa", be adopted. Ayes: Seven. Resolution adopted and upon
approval by Mayor Pro Tem, assigned No. 1981-32.
ORDINANCE TO BE ADOPTED
79847 - Moved by Bowers, seconded by Dowie, that "An Ordinance amending Ordinance No. 2644,
known as the Traffic Ordinance by repealing Section 125, Property Damage Accident
Reports, and enacting in lieu thereof new Section 125, Property Damage Accident Re-
ports", be received, placed on file and passed for the first time. Ayes: Seven.
Motion carried.
79848 - Jerry Schaefer, taxicab representative, explained that he had not been informed of the
proposed change, and desired an opportunity to have input into the change.
Moved by Penaluna, seconded by Wilharm, that "An Ordinance amending Chapter 36, Taxicabs,
of the Code of Ordinances of the City of Waterloo, Iowa, by repealing Subsection 36-22,
Vehicles Kept in Clean and Sanitary Condition, and enacting in lieu thereof new Sub-
section 36-22, Vehicles Kept in Clean and Sanitary Condition", be received, placed on
file and deferred until the Attorney's Office has an opportunity to discuss the pro-
posed changes with the cab company. Motion carried.

79849 - Moved by Burton, seconded by Bowers, that communication from Mayor Pro Tem Jack L. Roehr
recommending reappointment of George Meeks and Willie Allen, Sr. to the Human Rights
Commission, with term expiration on January 1, 1984, be received, placed on file and
approved. Motion carried.
79850 - Moved by Wilharm, seconded by Dowie, that the following requests for permission to attend
functions, with expenses allowed not to exceed amounts shown, be received, placed on file
and approved:
