The Council of the City of Waterloo, Iowa, met in Regular Session in Council Chambers in the City
Hall at 7:00 P.M., on November 24, 1980. Mayor Rooff in the Chair. On roll call: Present:
Wilharm, Roehr, Penaluna, Dowie, Burton, Bowers. Absent: Getty. Invocation by Councilman
Wilharm.
79562 - Moved by Roehr, seconded by Dowie, that the Agenda, as proposed, for the Regular Session
of November 24, 1980 at 7:00 P.M. be approved. Motion carried.
79563 - Moved by Dowie, seconded by Burton, that the minutes of the Regular Session held November
17, 1980 at 7:00 P.M. be approved. Motion carried.

Don Temeyer, Plan and Program Director, stated that the owners of Lot 18 have signed
an agreement with Ken -Jan. Inc. granting them perpetual rights to use of the alley.
Ken -Jan, Inc. owns all other surrounding property.

in Hagerman Place", be received, placed on file and passed for the first time. Ayes:

79570 - Moved by Dowie, seconded by Penaluna that the rules requiring ordinances to be considered
and voted for passage at two prior meetings, be suspended, the above ordinance recorded
as having been considered and passed for the second and third times, and now placed on

and oral objections and there were none.
Don Temeyer, Plan and Program Director, stated that a hold harmless agreement must be
obtained from the church to protect the City in the event that damage is incurred to the
proposed canopy while the City maintains the sanitary sewer lying within the alley.
Moved by Bowers, seconded by Burton that "an ordinance vacating an alley in Block 32 in
the Original Plat on the west side of the Cedar River with the City's retention of an
easement over the entire described property", be received, placed on file and passed
for the first time. Ayes: Six. Absent: Getty. Motion carried.

Councilman Roehr questioned the Council approving the site plan (which includes a canopy
over the alley) before the ordinance vacating the alley is adopted.
Moved by Roehr, seconded by Wilharm that "resolution approving the site plan for an
addition to the First Congregational Church generally located at the southwest corner of
South Street and West Fourth Street", be adopted, subject to approval of the alley
vacation. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor

on site plan for John Deere Credit Union to be located at the southeast corner of East

79580 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for
written and oral objections and there were none.

been eliminated and that two others still remained.

Deere Credit Union to be located at the southeast corner of Donald Street and Sage

ORAL PRESENTATIONS
Councilman Bowers commended the Waterloo Water Works for showing interest income in the
amount of $62,000 in their financial report for the quarter ending September 30, 1980.

been performed; but that the suggested minimum bid was based on current sales and County
auctions.

property currently owned by the City of Waterloo and generally located at the southeast
corner of the intersection of Shilliam Street and Halstead Street be received, placed
on file and "resolution fixing the time and place of hearing and receiving of bids as'
December 15, 1980 at 7:00 P.M. in the Council Chambers on proposal to sell certain

79582 - Don Temeyer, Plan and Program Director, explained that this was the parcel which was
bid on November 17, 1980, but the offer was denied due to the minimum established bid.
Considering this, a minimum of 75% of the original appraisal should be considered
minimum.

of parcel of property currently owned by the City of Waterloo and generally located at
the intersection of Sixteenth Street and Black Hawk Street, be received, placed on file
and "resolution fixing the time and place of hearing and receiving of bids as December
15, 1980 at 7:00 in the Council Chambers on proposal to sell certain property in Hayes
Addition", be adopted and Clerk instructed to published notice of public hearing with a

location, in view of the fact that River Road experiences a heavy volume of traffic.

79586 - Toni Staack, Recreation Commissioner, presented a proposal which would allow the swimming
pool construction project to remain within the bond issue of $1,300,000. 1) acceptance
of the low base bid of Wendell Lockard Construction, Inc. 2) inclusion of alternate 1
at a cost of $40,200.00; 3) inclusion of Alternate 3 at a reduction of $34,700.00;
