Mayor Rooff in the Chair. On roll call: Present: Wilharm, Roehr, Penaluna, Dowie, Burton, Bowers. Absent: Getty. Invocation by Councilman Wilharm. 79562 - Moved by Roehr, seconded by Dowie, that the Agenda, as proposed, for the Regular Session of November 24, 1980 at 7:00 P.M. be approved. Motion carried. 79563 - Moved by Dowie, seconded by Burton, that the minutes of the Regular Session held November 17, 1980 at 7:00 P.M. be approved. Motion carried. HEARINGS 79564 - Moved by Roehr, seconded by Penaluna that proof of publication of notice of public hear- ing on proposal to sell a parcel of land in Westfield Virden Urban Renewal Area, Project R-7 to Don Gardner Construction as published in the Waterloo Courier on November 7, 1980, be received and placed on file. Motion carried. Motion carried. 79569 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Don Temeyer, Plan and Program Director, stated that the owners of Lot 18 have signed an agreement with Ken -Jan. Inc. granting them perpetual rights to use of the alley. Ken -Jan, Inc. owns all other surrounding property. Moved by Penaluna, seconded by Bowers that "an ordinance vacating an alley in Block 17, in Hagerman Place", be received, placed on file and passed for the first time. Ayes: Six. Absent: Getty. Motion carried. 79570 - Moved by Dowie, seconded by Penaluna that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Four. Nays: Wilharm and Burton. Absent: Getty. Motion not carried. 79571 - Moved by Roehr, seconded by Bowers that proof of publication of notice of public hearing on proposal to vacate an alley in Block 32 on the west side of the Cedar River, as published in the Waterloo Courier on November 7, 1980, be received and placed on file. Motion carried. 79572 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Don Temeyer, Plan and Program Director, stated that a hold harmless agreement must be obtained from the church to protect the City in the event that damage is incurred to the proposed canopy while the City maintains the sanitary sewer lying within the alley. Moved by Bowers, seconded by Burton that "an ordinance vacating an alley in Block 32 in the Original Plat on the west side of the Cedar River with the City's retention of an easement over the entire described property", be received, placed on file and passed for the first time. Ayes: Six. Absent: Getty. Motion carried. 79574 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Don Temeyer, Plan and Program Director, stated that additional easements will be dedicated when the area is platted. Moved by Burton, seconded by Wilharm that "an ordinance vacating the telephone easement in a part of the W2 of the SW -4 of Section 33-89-13", be received, placed on file and passed for the first time. Motion carried. 79575 - Moved by Burton, seconded by Bowers that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ordinance adopted and upon approval by Mayor assigned No. 3113. 79577 - Moved by Bowers, seconded by Burton that proof of pbulication of notice of public hearing on site plan for an addition to First Congregational Church generally located at the southwest corner of South Street and West Fourth Street as published in the Waterloo Courier on November 7, 1980, be received and placed on file. Motion carried. 79578 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Councilman Roehr questioned the Council approving the site plan (which includes a canopy over the alley) before the ordinance vacating the alley is adopted. Moved by Roehr, seconded by Wilharm that "resolution approving the site plan for an addition to the First Congregational Church generally located at the southwest corner of South Street and West Fourth Street", be adopted, subject to approval of the alley vacation. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor assigned No. 27362. 79579 - Moved by Burton, seconded by Dowie that proof of publication of notice of public hearing on site plan for John Deere Credit Union to be located at the southeast corner of East Donald Street and Sage Road as published in the Waterloo Courier on November 7, 1980, be received and placed on file. Motion carried. 79580 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Don Temeyer, Plan and Program Director, stated that two entrances on Donald Street had been eliminated and that two others still remained. Moved by Bowers, seconded by Wilharm that "resolution approving the site plan for John Deere Credit Union to be located at the southeast corner of Donald Street and Sage Road", be adopted. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor assigned No. 27363. ORAL PRESENTATIONS Councilman Bowers commended the Waterloo Water Works for showing interest income in the amount of $62,000 in their financial report for the quarter ending September 30, 1980. PETITIONS FROM THE PUBLIC 79581 Don Temeyer, Plan and Program Director, stated that an appraisal of the property had not been performed; but that the suggested minimum bid was based on current sales and County auctions. Moved by Roehr, seconded by Dowie that request of Percy Burt for sale of parcel of property currently owned by the City of Waterloo and generally located at the southeast corner of the intersection of Shilliam Street and Halstead Street be received, placed on file and "resolution fixing the time and place of hearing and receiving of bids as' December 15, 1980 at 7:00 P.M. in the Council Chambers on proposal to sell certain property, in Shilliam's Third Subdivision", be adopted and Clerk instructed to publish notice of public hearing,,L4th a minimum price of $3,000.0" plus costs. November 24, 1980 -3- 79582 - Don Temeyer, Plan and Program Director, explained that this was the parcel which was bid on November 17, 1980, but the offer was denied due to the minimum established bid. Considering this, a minimum of 75% of the original appraisal should be considered minimum. Moved by Penaluna, seconded by Bowers that request of Bearing Service Co., Inc, for sale of parcel of property currently owned by the City of Waterloo and generally located at the intersection of Sixteenth Street and Black Hawk Street, be received, placed on file and "resolution fixing the time and place of hearing and receiving of bids as December 15, 1980 at 7:00 in the Council Chambers on proposal to sell certain property in Hayes Addition", be adopted and Clerk instructed to published notice of public hearing with a minimum price of $6,525.00, plus costs. Resolution adopted and upon approval by Mayor assigned No. 27365. 79583 - Moved by Wilharm, seconded by Burton that request of Bob's Barricades, Inc, for Council on its motion to rezone from "C-2" Commercial District to "M-1" Light Industrial District approximately 60 x 140 foot of land located on the northwest corner of Jefferson Street and West Twelfth Street together with City Zoning Commission's recommendation for denial, be received, placed on file, and "resolution setting date of hearing as December 15, 1980 at 7:00 P.M. in the City Hall, Council Chambers", be adopted, and Clerk instructed to publish notice. Ayes: Six. Absent: Getty. Resolution adopted and upon approval by Mayor assigned No. 27366. 79584 - Moved by Roehr, seconded by Wilharm that request of E. R. Bailey for Council on its motion to rezone from "M-1" Light Industrial District to "R-2" One and Two Family Residential District approximately five acres of land generally located east of Burton Avenue and north of Walker Street extended i' be received, placed on file, recommendation approved and "resolution setting date of hearing as December 22, 1980 at 7:00 P.M. in the City Hall, Council Chambers", be adopted, and Clerk instructed to publish notice. Resolution adopted and upon approval by Mayor assigned No. 27367. 79585 - Discussion involved the safety aspect of permitting a median cut at this particular location, in view of the fact that River Road experiences a heavy volume of traffic. Moved by Roehr, seconded by Wilharm that request of C. W. Shirey Co. for a median cut on River Road to serve their business located at 84 W. Mullen Avenue, be received, placed on file and denied. UNFINISHED BUSINESS 79586 - Toni Staack, Recreation Commissioner, presented a proposal which would allow the swimming pool construction project to remain within the bond issue of $1,300,000. 1) acceptance of the low base bid of Wendell Lockard Construction, Inc. 2) inclusion of alternate 1 at a cost of $40,200.00; 3) inclusion of Alternate 3 at a reduction of $34,700.00; 4) deletion of the following items: Gates Byrnes Byrnes Byrnes Byrnes Byrnes Byrnes Byrnes These deletions will result $6,241.00. - Delete new bathhouse, new wading pool and related site work - Delete new wading pool and adjacent deck Delete demolition of present bathhouse - Aluminum rolling shutter - Hot water storage tank - Delete stucco - Delete ceramic tile base - Delete interior painting in a cost of $1,255,759.00 with a contingency fund of Moved by Bowers, seconded by Penaluna that "resolution making award of contract in the amount of $1,255,759.00 for construction of the Byrnes and Gates Park Swimming Pool Replacement to Wendel Lockard Construction, Inc.", be adopted. REPORTS 79587 - Moved by Wilharm, seconded by Dowie that communication from City Engineer recommending that a contract with Cedar Valley Corporation for F.Y. 1981 Carriage Hill Retention Basin, Section 2, Contract No. 210 be dissolved due to the unexpected delay in said project, be received, placed on file and "resolution dissolving the contract between the City of Waterloo and Cedar Valley Corporation for F.Y. 1981 Carriage Hill Retention Basin, Section 2, Contract No. 210", be adopted. November 24, 1980 -4- 79588 - Moved by Penaluna, seconded by Wilharm that Declaration of Completion and Recommendation of Acceptance for work completed by Waterloo Construction Co., Inc. for the construction of Repairs to Eleventh Street and Falls Avenue Bridges together with City Engineer's recommendation for approval, acceptance of work, be received, placed on file and "resolution approving the Declaration of Completion and Recommendation of Acceptance for work and materials furnished by Waterloo Construction Co., Inc. for the construction of repairs to Eleventh Street and Falls Avenue Bridges, Contract No. 16 and accepting the work", be adopted. Resolution adopted and upon approval by Mayor assigned No. 27370. 79589 - Moved by Wilharm, seconded by Roehr that Certificate of Completion and Recommendation of Acceptance of Work as submitted by Youngblut Construction Co., Inc. for F.Y. 1981 San Marnan Frontage Road Paving Program and City Engineer's recommendation for approval and acceptance of work, be received, placed on file and "resolution approving the Completion Report and Recommendation of Acceptance of the work materials furnished by Youngblut Construction Co., Inc. for F.Y. 1981 San Marnan Frontage Road and Paving Program, Contract No. 208 and accepting the work", be adopted. Resolution adopted and upon approval by Mayor assigned No. 27371. 79590 - Moved by Roehr, seconded by Bowers that communication from Plan and Program Director transmitting a completion report on the Downtown 80's Study of Communication Network Systems and recommending final payment in the amount of $18,062,00 be received, placed on file, and "resolution authorizing payment in the amount of $18,062.00 to Communication Network System for Downtown 80's Study", be adopted. DOCUMENTS 79591 - Moved by Dowie, seconded by Penaluna that communication from City Engineer, advising improvements required as a condition precedent to final approval of plat of the addition to be known as Aerostat Heights Addition have been completed in substantial conformance with construction plans, standards and requirements of his office, submitting four-year maintenance bond for street improvements and two-year maintenance bond for the sewer improvements and recommending acceptance of said addition and bonds, be received, filed, approved and accepted with effective dates of bonds being that of final Council approval. Motion carried. 79592 - Moved by Burton, seconded by Bowers that communication from Community Development Admin- istrator, transmitting agreement to purchase borrow dirt from the City of Evansdale, Iowa for the construction of a flood control levee within the City of Waterloo, Iowa, be received, placed on file, approved and "resolution approving the agreement to purchase borrow dirt from the City of Evansdale and authorizing the Mayor and City Clerk to sign said agreement", be adopted, and instruct Clerk to record same. Resolution adopted and upon approval by Mayor assigned No. 27373. 79593 - Moved by Dowie, seconded by Burton that construction plans for sanitary sewer extension serving Martin Road Plaza together with Treatment Agreement Form WQ59 from the Depart- ment of Environmental Quality and City Engineer's recommendation for approval, subject to final acceptance of plans being reviewed and accepted by Department of Environmental Quality be received, placed on file and recommendation approved and Mayor and City Clerk authorized to execute same. Motion carried. 79594 - Moved by Roehr, seconded by Penaluna that Change Order No. 1 for work performed on F.Y. 1981 San Marnan Frontage Road Paving Project, Contract No. 208, by Youngblut Construction Co., together with City Engineer's recommendation, for approval be received, placed on file, approved and Mayor and City Clerk authorized to execute same. Motion carried. 79595 Moved by Bowers, seconded by Wilharm that Change Order No. 2 for work performed on Repairs to 11th Street and Falls Avenue Bridges, Contract No. 16 by Waterloo Construction Co., together with City Engineer's recommendation for approval, be received, placed on file, approved and Mayor and City Clerk authorized to execute same. Motion carried. RESOLUTIONS TO BE ADOPTED 79596 - Gene Colburn of the Chamber of Commerce, stated that this resolution changes only the name of the agency, not its functions. Moved by Penaluna, seconded by Bowers that "resolution adopting the name "Waterloo Housing Authority" for the public Housing Agency of the City of Waterloo, Iowa", be adopted. Ayes: Six.
