Mayor Rooff in the Chair. On roll call: Present: Wilharm, Roehr, Penaluna, Getty, Dowie, Burton, Bowers. Absent: None. Invocation by Councilman Wilharm. 79491 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed for the Regular Session of November 10, 1980, at 7:00 P.M., be accepted and approved. Motion carried. 79492 - Moved by Burton, seconded by Bowers, that the minutes of the Regular Session held Novem- ber 3, 1980 at 7:00 P.M. be approved. Motion carried. 79493 - Moved by Bowers, seconded by Wilharm, that the minutes of the Special Meeting held October 29, 1980 at 12:00 Noon be approved. Motion carried. PUBLIC HEARINGS 79494 - Moved by Dowie, seconded by Bowers, that proof of publication of notice of public hearing on proposed changes in Ordinance No. 3081, Taxicab Ordinance, relating to cleanliness standards of taxicabs operating in the City of Waterloo as published in the Waterloo Courier on October 24, 1980, be received and placed on file. Motion carried. 79495 - Moved by Burton, seconded by Bowers, that the hearing be deferred until such time as appropriate wording to enforce cleanliness of taxicabs is established. Motion carried. ORAL PRESENTATIONS 79496 - Viola Klebs, 1105 Cleveland, was concerned with the building taking place at the corner of Cleveland Avenue and University Avenue and that the alley had not yet been vacated. Don Temeyer, Plan and Program Director,,stated, the portion of the alley now being con- structed on had been vacated in 1971. 'The vacation of the northern portion of the alley is set for November 24, 1980. Tony Wilber, Wilber Auto Salvage, inquired about the denial of their application for ex- pansion and asked that the Council reconsider the request. Frank Dowie, asked why the Plan and Program Commission had denied the request. Don Temeyer, Plan and Program Director, stated the following reasons; adjacent uses were residential and neighborhood opposition. Moved by Dowie, seconded by Bowers, that reconsideration of the expansion of Wilbdr's Auto Salvage be placed on the Council Agenda for November 17, 1980. The Plan and Program Commission Office will contact area residents. Ayes: Wilharm, Penaluna, Dowie, Bowers. Nays: Roehr, Getty, Burton. Motion carried. PETITIONS FROM THE PUBLIC 79497 - Moved by Roehr, seconded by Wilharm, that communication from City Engineer transmitting request of Northwestern Bell Telephone Company for permission to use the Mullan Avenue Bridge for conduit lines across the Cedar River.as shown on attached plat and City Engin- eer`s recommendation for approval be received, placed on file, recommendation approved and permission granted in accordance therewith. Motion carried. 19498 - Moved by Burton, seconded by Bowers, that petition signed by renters of City Parking Lot No. 10 and Lot 2 and others (located between East 6th and East 7th Streets, south of Mulberry and North of Sycamore) requesting asphalt or oil surfacing for said lots at no increase in current monthly rent, be received, placed on file, and referred to Street Department. Motion carried. 79499 - Moved by Dowie, seconded by Burton, that communication from Community Development Adminis- trator transmitting request of John and Jenny Anderson to purchase 12.7 acres in Section 6-89-12 in the Virden Creek Dam and Impounding Area and acquired through condemnation, be received, placed on file and "Resolution setting date of hearing on sale of property lo- cated in Section 6-89-12 as December 8, 1980 at 7:00 P.M. in the City Hall Council Cham- bers", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assign- ed No. 27345. REPORTS '9500 - Moved by Penaluna, seconded by Wilharm, that the Finance Director's Statement for October, 1980, showing Fund Balance October 1, 1980, $15,424,519.63 + Receipts $5,234,551.60 - Bill Payments $1,799,613.41 - Payrolls $1,484,001.16 - Commission Bills $430,500.22 Transfers $383,639.03 Fund Balance October 31, 1980 $16,561.41, be received, placed on file and approved. Motion carried. f �m 79501 - Moved by Wilharm, seconded by Burton, that City Treasurer's Statement for October, 1980, showing Fund Balance October 1, 1980, $15,762,439.62 + Receipts - Taxes $2,861,816.61 + Receipts - City Clerk $400,108.89, + Receipts - City Treasurer $1,437,334.73, + Receipt - Transfers, $552,806.78, - Disbursements, $3,861,461.70, Fund Balance 10/31/80 $17,153, 044.93, be received, placed on file and approved. Motion carried. 79502 - Moved by Roehr, seconded by Wilharm, that communication from City Engineer advising im- provements required as a condition precedent to final approval of plat improvements of addition to be known as Southtown Addition have been completed in substantial conformance with construction plans standards and requirements of his office and submitting two-year maintenance bond for the sewer improvements and a four-year maintenance bond for paving improvements and recommending acceptance of said addition and bond be received, placed on file, approved and accepted with effective dates of bonds being that of final Council approval. Motion carried. 79503 - Moved by Bowers, seconded by Burton, that communication from Director of Parks transmitt- ing the 1981 - 1986 Waterloo Park and Open Space Capital Improvements Program, be receive and placed on file. Motion carried. DOCUMENTS 79504 - Moved by Dowie, seconded by Penaluna, that communication from City Engineer transmitting construction plans for the storm sewer and paving facilities serving Cedar Hills together with City Engineer's recommendation for approval, be received, placed on file and approve Motion carried. ORDINANCE TO BE ADOPTED 79505 - Moved by Penaluna, seconded by Wilharm, that "An Ordinance establishing the Downtown Self Supported Municipal Improvement District pursuant to the provisions of Senate File 356 of the acts of the 66th General Assembly, 1976 Session, and providing for the establishment of funds and the levy of annual taxes in connection therewith", be received, placed on file and passed for the second time. Ayes: Seven. Motion carried. 79506 - Moved by Penaluna, seconded by Getty, that "An Ordinance amending Ordinance No. 2479 as amended, by adding Subsection No. 181 to Section 2A-5, Rezoning Certain Property", be received, placed on file and passed for the third time. Ayes: Seven. Motion carried. 79507 - Moved by Burton, seconded by Dowie, that "An Ordinance amending Ordinance No. 2479 as amended, by adding Subsection No. 181 to Section 2A-5, Rezoning Certain Property", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 3111. NEW BUSINESS 79508 - Moved by Roehr, seconded by Wilharm, that communication from Community Development Board transmitting a contract with Wayne Claassen Engineering Company for F.Y. 1981 Fowler Street Sanitary Sewer Improvement, Contract No. 216, be received, placed on file and "Resolution authorizing the Mayor to execute engineering services contract with Wayne Claassen Engineering Company for F.Y. 1981 Fowler Street Sanitary Sewer Improvements, Contract No. 216", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 2734.6. 79509 - Moved by Roehr, seconded by Bowers, that the following requests for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Three City Councilmen to attend The 1980 Congress of Cities, Atlanta, Georgia, November 30 - December 4, 1980 - $978.00 per person. City Clerk and City Councilmen to attend Municipal Insurance Costs, International Risk Management Insurance, Inc., Dallas, Texas, December 9 - 11, 1980 -- $930 per person.
