Mayor Rooff in the Chair. On roll call: Present: Wilharm, Roehr, Penaluna, Getty, Dowie, Burton, Bowers. Absent: None. Invocation by Council- man Bowers. 79396 - Moved by Roehr, seconded by Bowers, that the Agenda, as amended, for the Regular Session of October 20, 1980, at 7:00 P.M., be accepted and approved. Motion carried. 79397 - Moved by Burton, seconded by Bowers, that the minutes of the Regular Session held October 20, 1980 at 7:00 P.M. be approved. Motion carried. PUBLIC HEARINGS 79398 - Moved by Dowie, seconded by Burton, that proof of publication of notice of hearing on issuance of Industrial Development Revenue Bonds (Fahr Beverage, Inc.) as published in the Waterloo Courier on October 9, 1980, be received and placed on file. Motion carried. 79399 - HOLD HEARING - This being the time and place of hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Roehr, that "Resolution determining to proceed with the issuance of not to exceed $1,200,000.00 Industrial Development Revenue Bonds, Series 1980 (Fahr Beverage, Inc. Project) of the City of Waterloo, Iowa", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27307. 79400 - Moved by Roehr, seconded by Wilharm, that proof of publication of notice of public hear- ing on proposal to sell a parcel of land in Logan Avenue Urban Renewal Area, Project R-2 to James M. Roland as published in the Waterloo Courier on September 25, 1980, be received and placed on file. Motion carried. 79401 - HOLD HEARING - This being the time and place to hold hearing the Mayor called for written and oral objections and there were none. Moved by Burton, seconded by Dowie, that "Resolution approving the sale of Disposal Parcel No. 41a in the Logan Avenue Urban Renewal Area, Project No. R-2, to James M. Roland and authorizing the execution of the necessary contract for sale of land for private redevelop- ment and deed", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned' No. 27308. 79402 - Moved by Penaluna, seconded by Roehr, that proof of publication of notice of public hear- ing on proposal to vacate a portion of alley located north of West Mullan between Commer- cial Street and Cedar River as published in Waterloo Courier on October 14, 1980, be re- ceived and placed on file. Motion carried. 79403 - HOLD HEARING - This being the time and place of hearing the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Burton, that "An Ordinance vacating the north ninety feet of an alley located north of West Mullan between Commercial Street and Cedar River", be re- ceived and placed on file and passed for the first time. Ayes: Seven. Motion carried. 79404 - Moved by Wilharm, seconded by Roehr, that the rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 79405 - Moved by Roehr, seconded by Bowers, that "An Ordinance vacating the north ninety feet of an alley located north of West Mullan between Commercial Street and Cedar River", be adopted. Ordinance adopted and upon approval by Mayor, assigned No. 3109. 79406 - Moved by Wilharm, seconded by Dowie, that "Resolution approving and authorizing the con- veyance of an alley located north of West Mullan between Commercial Street and Cedar River to the Nancy Shirey Trust and directing and authorizing the Mayor and Clerk to execute and deliver deed accordingly", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27309. ORAL PRESENTATIONS 79407 - Darlene McAhren, 1245 Sheffield Avenue, stated her opposition to the proposed expansion of Wilhuzr's Auto Salvage Yard. She was told that a public hearing was to be held on this subject on November 3, 1980. Motion carried. 79417 - Moved by Roehr, seconded by Penaluna, that Certificate of Completion and Final Acceptance of work as submitted by Cedar Valley Corporation, for Contract No. 176, F.Y. 1980 Paving Program No. 1 and City Engineer's recommendation for approval and acceptance of work, be received, placed on file and "Resolution approving the Certificate of Completion and Final Acceptance of the work as to work and materials furnished by,Cedar Valley Corporation, for F.Y. 1980 Paving Program No. 1, Contract No. 176 and accepting the work", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27315. 79418 - Mayor Rooff reported that he had made a decision on the selection of a Police and Fire Chief after consultation with each Councilman. He announced that Junior Grimm be named the Police Chief and Gerald Olson be named the Fire Chief. Moved by Wilharm, seconded by Bowers, that "Resolution affirming and approving the above appointments", be adopted. Mayor Rooff then administered the oath of office to each. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27316. DOCUMENTS 79419 - Moved by Dowie, seconded by Burton, that communication from Community Development Adminis- trator that $75,000.00 be expended from the Block Grant Fund for the acquisition of proper- ty formerly occupied by the Christ Episcopal Church to be used for low-income housing for elderly and handicapped sponsored by the Chamber of Commerce be received, placed on file and "Resolution authorizing the expenditure of $75,000.00 from the Block Grant Fund for acquisition of property to be used by the Chamber of Commerce for low-income housing for elderly and handicapped", be adopted. Resolution adopted and upon approval by Mayor, assigned No. 27319. 79422 - Moved by Burton, seconded by Roehr, that "A Resolution regarding the issuance of not to exceed $1,000,000.00 in Aggregate Principal amount of Industrial Development Revenue Bonds (Forward Broadcasting of Iowa, Inc., Project) of the City of Waterloo, Iowa, directing publication of notice of intention to issue, calling a public hearing on the proposal to issue said bonds and authorizing execution of a memorandum of agreement", be adopted and instructing Clerk to publish notice of hearing with hearing date set as November 17, 1980 at 7:00 P.M. in Council Chambers in City Hall.
