The Council of the City of Waterloo, Iowa, met in Regular Session in the Council
Chambers in the City Hall at 7:00 P.M., on September 8, 1980. Mayor Rooff in the
Chair. On roll call: Present: Wilharm, Roehr, Penaluna, Getty, Dowie, Burton and
Bowers. Absent: None. Invocation by Councilman Getty.
79131 - Moved by Roehr, Seconded by Burton, that the Agenda as amended, for the
Regular Session of September 8, 1980, at 7:00 P.M., be accepted and
approved. Motion Carried.
79132 - Moved by Burton, Seconded by Dowie, that the minutes of the Regular Session
held September 2, 1980, at 7:00 P.M., be approved. Motion Carried.
79133 - Moved by Roehr, Seconded by Bowers, that proof of publication of notice
of public hearing on proposed amendments to Ordinance No. 2479, as amended,
Zoning Ordinance, as published in the Waterloo Courier, August 22, 1980,
be received and placed on file. Motion Carried.
79134 - HOLD HEARING - This being the time and place to hold hearing, the Mayor
called for written and oral objections and there were none.
Don Temeyer, Planning and Programing Director, answered several questions
as to what changes in parking requirements were being required for fast
food restaurants. Parking in most instances is determined by the volume
of usage, except in cases of professional office uses where parking is
determined by square footage of building area.

Moved by Bowers, Seconded by Getty, that "an Ordinance amending
Ordinance No. 2479, as amended, known as the Zoning Ordinance, by
repealing subsections D-14 and D-15 of Section 2A-45, Off -Street
Parking Area required, under Part XIX, Parking and Loading Areas,
Public Garages, Parking Lots and Filling Stations, as amended by
Ordinance No. 3050; and enacting in lieu thereof new Subsections
D-14 and D-15 of Section 2A-45, Off -Street Parking Area required,
under Part XIX, Parking and Loading Areas, Public Garages, Parking
Lots and Filling Stations; by repealing Section 2A -7(E), Accessory
Buildings, under Part V, General Regulations, and enacting in lieu
thereof a new Section 2A -7(E), Accessory Buildings, under Part V, General
Regulations; by repealing Section 2A-55, Amendments, under Part XXVI,
Amendments, and enacting in lieu thereof new Section 2A-55, Amendments,
under Part XXVI, Amendments, be received, placed on file for the
first time." Motion Carried.
C. L. Hoffman, 2816 Idaho St., inquired as to when the trees would be
trimmed at the intersection of Idaho and Donald Streets. This
situation will be further investigated.
_ Moved by Wilharm, Seconded by Bowers, that resolution making award of
contract for construction of UDAG Project Public Improvements,
Phase 2, Sections 1, 2, 3, and 4, Contract No. 178, be awarded as
follows: Section 1 - Cedar Falls Construction Co. in the amount of
$298,383.17; Section 2 - Cedar Valley Corporation in the amount of
$730,835.54; Section 2A - Cedar alley Corporation in the amount
of $82,539.40; Section 3 and 4 -tee Electric Company in the amounts
of $27,210.27 and $106,199.56 respectively,"be adopted, and City Clerk
be instructed to return unsuccessful bids. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 27216.

79136 - Moved by Roehr, Seconded by Burton, that City Treasurer's Statement
for August, 1980, showing Fund Balance:
August 1, 1980, $16,320,828.76 + Receipts - Taxes $9,130.04 + Receipts -
City Clerk $642,364.05 + Receipts - City Treasurer $4,079,833.77
+ Receipts - Transfers $147,099.23 - Disbursements $3,524,793.52,
Fund Balance August 31, 1980 $17,674,462.33 be received, placed on
file and approved. Motion Carried.
79137 - Moved by Burton, Seconded by Boweps,that State of Iowa Auditor's
Report, Financial Statement, Supplemental Data, comments and
recommendations for the year ending June 30, 1979, be received
and placed on file. Motion Carried.
79138 - Moved by Burton, Seconded by Dowie, that communication from City
Clerk requesting cancellation of Certificate No. 65-0026947 in the
amount of $47.07 for the F.Y. 1979 Oiling Program, Contract No. 1
be cancelled, be received, placed on file and "Resolution cancelling
Certificate No. 65-0026947 in the amount of $47.07 for the F.Y. 1979
Oiling Program, Contract No. 1", be adopted and certification of
this cancellation be transmitted to the County Auditor. Ayes: Seven.
Resolution approved and upon approval by Mayor, assigned No. 27217.
79139 - Moved by Dowie, Seconded by Bowers, that final plat of Harriet
Hutchins' Addition together with Engineer's Certificate of Survey,
Deed of Dedication, Petition and Waivers, Report of the City
Engineer and Plan and Program Commission's resolution of approval
and its recommendation for Council approval be received, placed
on file and "Resolution approving the final plat of Harriet
Hutchins' Addition, Black Hawk County, Iowa", be adopted.
Ayes: Seven. Resolution adopted and upon approval by Mayor,
be assigned No. 27218.
79140 - Moved by Penaluna, Seconded by Wilharm, that construction plans for
sanitary sewer extension serving Klingaman Park Addition together
with Treatment Agreement Form C 9/75 from the Department of
Environmental Quality and City Engineer's recommendation for
approval be received, placed on file and recommendation approved
and Mayor and City Clerk authorized to execute same. Motion Carried.
79141 - Moved by Bowers, Seconded by Burton, that contract, performance
bond and certification of insurance for Contract No. 203, be
received and placed on file and "Resolution approving the
contract and bond of Cedar Valley Corporation for F. Y. 1981
Highland Park Area Sidewalk Program, Contract No. 203, in the
amount of $26,453.92", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 27219.
79142 - Mayor Rooff reported that the amendment pertains to changes of
dates for various activities and consolidates the number of
rehabilitation and renovation activities.
Moved by Bowers, Seconded by Wilharm, that an amendment to
contract with the Department of Housing and Urban Development
for Federal assistance to the Rath Packing Company (#B -79 -AA -
19 -0004) and the City of Waterloo, be received, placed on file
and "Resolution approving amendment to contract with the
Department of Housing and Urban Development for Federal
assistance to the Rath Packing Company (#B -79 -AA -19-0004)
and the City of Waterloo", adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 27220.

79143 - Moved by Burton, Seconded by Bowers, that "Ordinance creating the
Waterloo Redevelopment Authority to act as an agent for the City
for the purpose of Central Business District Development and
Redevelopment", be received, placed on file and passed for the
second time. Ayes: Seven. Motion Carried.
- Councilman Roehr questioned whether the issue of Urban Revitalization
could be voted on in a referendum. Attorney Griffin stated that
the legislation permiting the establishment of Urban Revitalization
districts by cities allows public input through the public hearing
process (and a possible second hearing). In his search of the Code,
no provision exists for the mandatory placement of this issue on the
ballot if a percentage of electorate signatures are obtained.

Mayor Rooff stated that the paper had misquoted him and that the Maywood
area had received one half million dollars for sanitary sewer and one
half million dollars of City and Waterloo Water Works monies for water
mains. The Mayor again stated that the program would allow a graduated
tax exemption for a ten year period on the value of the improvement only.

79145 - Tyrone Wilson, 1214 Wren Rd., questioned the City Attorney's interpetation
of petitions and how they effect the placement of an issue on the ballot.
He also presented a petition.bearing the names of approximately 700 persons
who desire that Urban Revitalization be placed on the ballot.
Moved by Roehr, Seconded by Getty, that the above petition be received
and placed on file. Motion Carried
79146 - Moved by Penaluna, Seconded by Bowers, that "an Ordinance establishing
Urban Revitalization Area in the Neighborhood Housing Services Project
Area", be received, placed on file and passed for the second time.
Ayes: Penaluna, Getty, Dowie, Burton and Bowers. Nays: Wilharm and Roehr.

79147 - Moved by Bowers, Seconded by Burton, that communication from Community
Development Board transmitting a contract with Robinson Engineering
Company for engineering services for the Sixth Year Community Development
Block Grant Program paving in the Edison Neighborhood Strategy Area be
received, placed on file and "Resolution authorizing the Mayor to execute
engineering services contract with Robinson Engineering Company for
Sixth Year Community Development Block Grant Program paving in the
Edison Neighborhood Strategy Area", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 27221.
79148 - Moved by Burton, Seconded by Dowie, that communication from City Engineer and
Mayor recommending for Council appointment the name of Donald E. Thorson to the
position of Street Superintendent in Street Department, effective September
8, 1980, at a salary of $20,638.00 per year be received, placed on file,
and "Resolution approving the appointment of Donald E. Thorson as Street
Superintendent", be adopted. Ayes: Seven. Resolution adopted and upon
approval by Mayor, assigned No. 27222.

79149 - Councilman Roehr asked why two Attorney's must attend the conference
and was told that it is a separate session that each would be attending.
Moved by Getty, Seconded by Dowie, that the travel request for two
Assistant City Attorneys to attend the National Institute of Municipal
Law Officer's Annual Conference be received, placed on file and approved.

79150 - Moved by Bowers, Seconded by Wilharm, that following request for permission
to attend functions, with expenses allowed not to exceed amounts shown, be
