The Council of the City of Waterloo, Iowa, met in Regular Session in Council
Chambers in the City Hall at 7:00 P.M., on July 14, 1980. Mayor Rooff in the
Chair. On roll call: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm.
Absent: None. Invocation by Councilman Bowers.
78782 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the
Regular Session of July 14, 1980, at 7:00 P.M., be accepted and approved.
Motion carried.
78783 - Moved by Burton, seconded by Bowers that the minutes of the Regular Sess-
ion held July 7, 1980, at 7:00 P.M. be approved. Motion carried.
78784 - Mayor Rooff presented a petition from residents of the Klingaman Knolls
Subdivision requesting paving for Country Lane, Clover Lane, William
Drive and Winghaven Drive. The percentage of residents requesting paving
are as follows: 52%, 85%, 68% and 50% respectively.
Moved by Wilharm, seconded by Dowie that the petition of residents of
Klingaman Knolls requesting paving be received and placed on file.
Several residents of the area asked if something could be done this con-
struction year to relieve the problems with existing street conditions.
Mayor Rooff stated that due to procedures required by State Law, it would
not be possible to pave this year. Motion carried.
78785 - Councilman Burton presented a petition from area residents requesting
that a stop sign be installed at the corner of Maxwell Street and Upton
Avenue.Currently, a yield sign exists at the corner.
Moved by Burton, seconded by Wilharm that the petition from residents in
the area of Maxwell Street and Upton Avenue be received, placed on file,
referred to Quintin Parker for a recommendation. Motion carried.
78786 - Emmett Brody, 1438 Oakcrest Drive, discussed his interpretation of whether
sidewalks were needed on his lot at the time he purchased his lot. The
former owner told him that he could probably obtain a sidewalk variance.
Discussion followed as to possibly requiring the developer to insure that
sidewalks are constructed on each lot, as well as the requirements at the
time the subdivision was platting, including the need for sidewalks on a
cul-de-sac street.
Moved by Roehr, seconded by Wilharm that request of Emmett Brody, 1438
Oakcrest Drive, to waive sidewalk requirements for Lot 4, Woodland Knolls
Addition and Plan and Program Commission Staff's recommendation for denial
be received, placed on file and tabled for one week. Ayes: Penaluna,
Roehr, Wilharm. Nays: Bowers, Burton, Dowie, Getty. MOTION NOT CARRIED.
The Mayor reiterated his concern for insuring the safety of pedestrians
and the possible dilemna that could result in the future.
78787 - Also discussed was the August 15 deadline that the Building Department
has mandated for the sidewalk construction to be completed. Continuity
of sidewalks in the area including those lots along South Hackett Road
and their inclusion in the plat of Woodland Knolls Addition was discussed.
After further discussion, Moved by Roehr, seconded by Penaluna that side-
walks be constructed only on the east side of Lot 4. Ayes: Penaluna,
Roehr. Nays: Bowers, Burton, Dowie, Getty, Wilharm. MOTION NOT CARRIED.
78788 - After further discussion, moved by Wilharm, seconded by Roehr that the
Council reconsider the request of Emmett Brody, 1438 Oakcrest Drive, to
waive sidewalk requirements for Lot 4, Woodland Knolls Addition. Ayes:
Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Nays: Bowers. Motion
carried.
78789 - After further discussion, moved by Burton, seconded by Wilharm that a
sidewalk program be instituted for Lots 1, 3 and 20 of Woodland Knolls
Addition and that sidewalks be required in the remaining portions of the
subdivision as required by the Subdivision's Contract. Ayes: Bowers, Bur-
ton, Dowie, Getty, Wilharm. Nays: Penaluna, Roehr. Motion carried.
78790 - Gary Witcombe, 3656 West 4th Street, reiterated his reasoningfor wanting
parking on a portion of West 4th Street.
Moved by Wilharm, seconded by Burton that communication from Quintin Park-
er, Sign and Traffic Department, reporting on request of Gary Witcombe,
3656 West 4th Street, for no parking on a portion of West 4th Street, re-
ferred to him under Council Action 78748, July 7, 1980 and recommending
that parking be taken off West 4th Street from Kimball Avenue to south
city limits be received, placed on file and recommendation approved. Ayes
Bowers, Burton, Getty, Penaluna, Roehr, Wilharm. Nays: Dowie. Motion
carried.
78791 - Moved by Roehr, seconded by Bowers that the minutes of the regular meet-
ing of the Community Development Board held on June 10, 1980, be received
and placed on file. Motion carried.
78792 - Moved by Dowie, seconded by Burton that construction plans for Sanitary
Sewer Extension serving Lots 10, 11, 12 of Pro's Addition together with
Treatment Agreement Form WQ 59 from the Department of Environmental Qual-
ity and City Engineer's recommendation for approval subject to no build-
ing permits being issued for any lots that will have sanitary service
from this extension until such time as the Hackett Road Sanitary Sewer
Pumping Station Holding Basin is constructed and operational and subject
to final acceptance of plans being reviewed and accepted by DEQ, be re-
ceived, placed on file, recommendation approved and Mayor and Clerk auth-
orized to execute same. Motion carried.
78793 - Councilman Burton stated that the intent of the proposed Ordinance was
not to harass violaters.
The Environmental Protection Agency (EPA) will provide one sound meter
and the City will be purchasing a second at a cost of approximately $1,
100.00.
Moved by Burton, seconded by Bowers that "An Ordinance amending the Code
of Ordinances of the City of Waterloo, Iowa by adding Chapter 37,
Noise Control", be received, placed on file, considered, and passed for
the first time. Ayes: Seven. Motion carried.
78794 - Moved by Bowers, seconded by Burton that communication from Board of Park
Commissioners requesting utilization of Flood Control Funds and authori-
zation for Park Commission to advertise, accept bids and award contract
for the construction of rest room facilities in Cedar River Park Straub
Field Area be received, placed on file and "Resolution authorizing the
use of Flood Control Funds from the Community Development Block Grant
Funds and instruct the Park Commission to advertise, accept bids, and
award contract for the construction of rest room in the Cedar River Park
Straub Field Area", be adopted. Ayes: Seven. Resolution adopted and
upon approval by Mayor, assigned No. 27104.
78795 - Councilman Wilharm and Burton questioned whether an alternate type of
structure could be constructed at this curve. Mayor Rooff stated that
after considerable research, the proposed type of structure would be
necessary for the type and volume of traffic on Highway 20.
Moved by Dowie, seconded by Penaluna that communication from City Engineer
transmitting an agreement with the Iowa Department of Transportation for
Urban -State Traffic Engineering Program Project IDOT Agreement No.80-U-
053, Project No. UST -20-6(30)--4A-07, be received, placed on file and
"Resolution authorizing the Mayor to execute an agreement with Iowa De-
partment of Transportation for Urban -State Traffic Engineering Program
Project IDOL' Agreement No. 80-U-053, Project No. UST -20-6(30)--4A-07",
be adopted. Ayes: Bowers, Dowie, Getty, Penaluna. Nays: Burton, Roehr,
Wilharm. Resolution adopted and upon approval by Mayor, assigned No.
27105.
78796 - Moved by Roehr, seconded by Getty that communication from City Engineer
transmitting a contract with Schenk Engineering Company for engineering
services for the F.Y. 1981 San Marnan Frontage Road Paving Program, Con-
tract No. 208 be received, placed on file and "Resolution authorizing the
Mayor to execute engineering services contract with Schenk Engineering
Company for F.Y. 1981 San Marnan Frontage Road Paving Program, Contract
No. 208", be adopted. Ayes: Seven. Resolution adopted and upon appro-
val by Mayor, assigned No. 27106.

78797 - Moved by Burton, seconded by Bowers that the Delinquent Weed Certificat-
ion List together with costs for the destruction of weeds, vines, bushes,
etc. be received, placed on file and "Resolution fixing time and place
for hearing on proposed assessments for cutting and destruction of weeds
for 1979", adopted with date of hearing set as August 4, 1980. Ayes:
Seven. Resolution adopted and upon approval by Mayor, assigned No. 27107.
78798 - Moved by Roehr, seconded by Getty that communication from City Engineer
transmitting City Engineer's detailed plans, specifications, formal con-
tract, formal proposal, preliminary estimate of cost, etc., and notice
to bidders for the Hackett Road Sanitary Sewer Pumping Station Storage
Basin and Controls, Contract No. 206, and City Engineer's request to give
Northwestern Bell Telephone Company a "Notice to Proceed" on telephone
connections for the holding tank at a estimated cost of $5,606.00 be re-
ceived, placed on file and "Resolution ordering bids, approving plans,
specifications and form of contract and notice to bidder, fixing amount
of bid security and ordering Clerk to publish notice and fixing a date
for receiving same, and for a public hearing on plans, specification,
form of contract and estimate of costs", adopted and date set as August
4, 1980 and permission granted to notify Northwestern Bell Telephone Com-
pany for a notice to proceed on telephone connections for the holding
tank at an estimated cost of $5,606.00. Ayes: Seven. Resolution adopt-

78799 - Moved by Bowers, seconded by Getty that communication from Community De-

78800 - Moved by Bowers, seconded by Getty that communication from Plan and Pro-
gram Director requesting a date of public hearing be set to review the
proposed plans for the designation of an Urban Revitalization Plan for
an area generally bounded by East 4th Street, Newell Street, Beech Street,
Oneida Street, Linden Avenue and the Illinois Central Railroad as requir-
ed by the Iowa Urban Revitalization Act be received and placed on file
"Resolution setting date of hearing to review plans for the designation
of an Urban Revitalization plan for an area generally bounded by East 4th
Street, Newell Street, Beech Street, Oneida Street, Linden Avenue and the
Illinois Central Railroad as required by the Iowa Urban Revitalization
Act as August 25, 1980", be adopted. Ayes: Bowers, Burton, Dowie, Getty,

78801 - Moved by Burton, seconded by Bowers that following request for permission
to attend functions, with expenses allowed not to exceed amounts shown,
be received, placed on file and approved:
Acting Lieutenant and Sergeant to attend First -Line Supervision School,
Camp Dodge, Iowa, July 14-25, 1980 -- $219.00 plus mileage.

78802 - Moved by Wilharm, seconded by Roehr that a transfer of the Beer -Liquor
License for J.H.M. of Waterloo, Inc., dba The Stable from 2022 Bopp Street
to 2421 Falls Avenue be received, placed on file and approved. Motion
carried.

Permit, be received, placed on file, approved and endorsed application

78806 - Moved by Dowie, seconded by Burton to adjourn to July 17, 1980 at 11:00
A.M. for the purposes of accepting bids on Corporate Purpose Bonds. Motion
carried.
