Mayor Pro Tem Roehr in the Chair. On roll call: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invocation by Councilman Wilharm. 78653 - Moved by Dowie, seconded by Burton that the Agenda as amended for the re- gular session of June 16, 1980, at 7:00 P.M., be accepted and approved. Motion carried. 78654 - Moved by Burton, seconded by Bowers that the minutes of the Regular Sess- ion held on June 9, 1980, at 7:00 P.M. be approved. Motion carried. 78655 - Moved by Wilharm, seconded by Dowie that proof of publication of notice of public hearing on proposed plans, specifications, form of contract and estimate of costs, etc., for the N'.H.S. Quincy and Manson Paving Program No. 1, Contract No. 202, and taking of construction bids therefore, be re- ceived and placed on file. Motion carried. Hold Hearing - This being the time and place for hearing the Mayor called for written and oral objections and there were none. 78656 - Moved by Getty, seconded by Wilharm that "Resolution confirming the approv- al of plans, specifications, etc., for the construction of N.H.S. Quincy and Manson Paving Program No. 1, Contract No. 202", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No.27038. 78657 - Moved by Bowers, seconded by Burton that "Resolution ordering the construct ion of N.H.S. Quincy and Manson Paving Program No.1, Contract No. 202",be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27039. 78658 - Moved by Burton, seconded by Dowie that Proof of Publication of Notice to Contractors or Invitation for Bids of Construction N.H.S. Quincy and Man- son Paving Program No. 1, Contract No. 202, be received and placed on file. Motion carried. 78659 - Moved by Wilharm, seconded by Penaluna that the following bids, be received placed on file and Clerk instructed to open and read same and bids referred to the Engineers for checking and report back: BIDDER AMOUNT OF BID BID BOND OR CASHIER CHECK Lehman Trucking & Excavating $136,565.05 5% Cedar Valley Corp. $133,162.80 10/ Cedar Falls Const. Co., Inc. $132,966.59 5/ Motion carried. Violet Usher questioned the work that has been thus far completed on Blow- ers Creek and when completion could be expected. She was told that work will continue on the project. Mrs. Ruth Hopper, 180 W. 10th St., inquired as to when the dike work on the west side of the Cedar River between W. 6th & W. llth St. would be completed. Mr. Paul Huntley, Superintendent of Sewers, stated that the U.S. Army Corps of Engineers would be letting a contract in the next 60 days. Mrs. Hopper also asked what action was being taken on a complaint she recently turned in concerning her neighbor's garbage being left in the street. Mr. Bill Hoffman, Health and Sanitation Director, reported that his office has issued a notice to the violator and will see that the complaint -is answered. 78660 - Moved by Wilharm, seconded by Dowie that the above oral presentation of Violet Usher and Mrs. Ruth Hopper be received and placed on file. Glenn Horton, 3652 W. 4th St., questioned the no parking signs recently placed on W. 4th St. near his home and the problems which result. 78661 - Moved by Wilharm, seconded by Bowers that the matter of no parking on W. 4th St. generally located between Kimball Avenue and Highway 412 be re- ferred to Quintin Parker, Sign and Traffic Superintendent. Motion carried 2 Council Member Getty stated that beginning July 1, 1980, the Riverfront Commission will cease its operation due to no monies being allocated in F.Y. 81 Budget. General responsibilities are to be assumed by the Park Department. He stated that patrol of the River and maintenance of the Riverfront should be carried on. 78662 - Moved by Getty, seconded by Wilharm that Community Development and Plan and Program review the possibility of selling any excess riverfront-owned properties with receipts to be used for continued operation of the River - front with a report back in one week. Motion carried. 78663 - Moved by Penaluna, seconded by Bowers that request of Bearing Service Co. for sale of parcel of property currently owned by the City of Waterloo as shown on the attached plat and generally described as located at the in- tersection of Black Hawk Street and 16th Street, be received, placed on file and "Resolution fixing the time and place of hearing and receiving of bids as July 7, 1980 at 7:00 P.M. in the Council Chambers on proposal to sell certain property in Hayes Addition", be adopted and Clerk instruct- ed to publish notice of public hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27040. 78664 - Moved by Bowers, seconded by Getty that request of Crystal Ice and Cold Storage, 105 E. 10th Street for sale of Disposal Parcel I-33 (129 East Mullen Avenue) in the Westfield Virden Urban Renewal Area, Project No. Iowa R-7 be received, placed on file and "Resolution fixing the time and place of hearing as July 21, 1980 at 7:00 P.M., by the City Council on proposal to sell certain property in Westfield -Virden Urban Renewal Area", be adopted and Clerk instructed to publish notice of public hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27041. 78665 - Moved by Wilharm, seconded by Dowie that request of Arlin Zevenbergen for permission to construct a temporary concrete driveway at 1540 West Ridge- way Avenue without regard to 'sidewalk grade, together with $3.00 for re- cording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Arlin Zevenbergen and authorizing con- struction of a temporary concrete driveway at 1540 West Ridgeway Avenue, irrespective of a later official grade", adopted. Ayes: Seven. Resolut- ion adopted and upon approval by Mayor, assigned No. 27042. 78666 - Moved by Wilharm, seconded by Getty that communication from Quintin T. Parker, Sign and Traffic Department, reporting on the feasibility of re- moving a tree at the corner of Russell Road and West Fourth Street, re- ferred to him under Council Action #78621 of June 9, 1980, be received, placed on file and approved. Motion carried. 78667 - Moved by Getty, seconded by Burton that request of Northwestern Bell for installation of one (1) drive -up public telephone on public right-of-way with the City to receive 15% commission on the amount of money that is collected in the phone, be received, placed on file and "Resolution grant- ing permission to Northwestern Bell for installation of one (1) drive -up public telephone located on the corner of West 9th and Jefferson Street with the City to receive 15% commission on the amount of money that is collected at this location", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 27043. 78668 - Moved by Bowers, seconded by Wilharm that Council Action No.78627 recommend inq that the public telephone to be installed at the southeast corner of West 9th Street and Jefferson Street, be rescinded. Ayes: Seven. Motion carried. 78669 - Moved by Dowie, seconded by Burton that communication from Quintin T. Park- er, Sign and Traffic Department,reporting on the request of Helen Riley and others for a truck embargo on Burton Avenue from Highway 20 to Highway 57, referred to him under Council Action 78620, June 9, 1980, and recommend ing request be denied, be received, placed on file, request denied, and that Mrs. Riley be notified of the Council's action. Motion carried. 78670 - Moved by Penaluna, seconded by Getty that communication from Inspection Department transmitting agreements on Right of Entry for repair and con- struction work to be performed on the basement portion of 627 Sycamore Street, 611-615 Sycamore Street, and 226-228 East 4th Street as part of UDAG Site Improvement, Phase II, City Contract #1778, be received, placed on file and approved."1Motion carried. Council Member Getty asked that the City Engineer investigate the apparent blockage of water flow on Virden Creek at its junction with the Cedar River during last week's rain storm and whether any action can be taken. 78681 - Moved by Burton, seconded by Dowie that report of City Attorney and list of bonds filed with Clerk through June 16, 1980, be received, placed on file and report and bonds approved. Motion carried. Norm Stall, 722 Dearborn, reported of difficulties he encountered in his immediate neighborhood after the weekend's record rainfall. He stated that additional work needs to be done along Blowers Creek and that cement blocks were blocking the free flow of water. He has not inquired about having sand delivered from the Street Department, Don Thorson, Project Engineer, stated that this record rainfall well exceeded the 100 Year Flood Level and that no improvements in the City are designed for that rainfall. Mr. Thorson stated that he and various Council Members have visited the site. 78682 - Moved by Dowie, seconded by Burton that the Council adjourn. Motion carried. Larry P. Burger City Clerk.
