Mayor Rooff in the Chair. On roll call: Present: Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: Bowers. Invocation by Councilman Getty. 78560 - Moved by Roehr, seconded by Penaluna the Regular Session of June 2, 1980, proved. Motion carried. 78561 - Moved by Burton, seconded by Wilharm Session held May 27, 1980, at 7:00 P. that the Agenda, as proposed, for at 7:00 P.M., be accepted and ap- that the minutes of the Regular M. be approved. Motion carried. 78562 - Moved by Roehr, seconded by Penaluna that proof of publication of notice of public hearing on proposal to sell and convey real property of approx- imately 1.5 acres generally located between Commercial and Paper Mill Streets east of Lot 1, Rooff's Addition as published in the Waterloo Courier on May 16, 1980, be received and placed on file. Motion carried. 78563 - Mayor Rooff explained that a second appraisal had been ordered after no bids were received at the hearing due to the fact that the first apprais- al was quite high. Moved by Dowie, seconded by Penaluna that communication from the Plan & Program Commission transmitting a revised appraisal summary sheet prepar- ed by Dwayne Guernsey be received and placed on file. Motion carried. 78564 - Hold Hearing - this being the time and place of hearing the Mayor called for written and oral objections, and there were none. Moved by Wilharm, seconded by Burton that the bids be received and placed on file and instruct Clerk to open and read and refer to Plan and Program Department, The Clerk reported that the following sealed bid had been received: BIDDER James L. & Ramona E. Rooff Motion carried. AMOUNT OF BID $6,650.00 78565 - Plan and Program Director Don Temeyer reported that the bid was in order. Moved by Wilharm, seconded by Roehr, that "Resolution approving and auth- orizing the conveyance of real property of approximately 1.5 acres gen- erally•located between Commercial and Paper Mill Streets as published in the Waterloo Courier May 16, 1980 to James L. &Ramona E. Rooff and di- recting and authorizing the Mayor and Clerk to execute and deliver a deed accordingly", be adopted. Ayes: Six. Absent: Bowers. Resolution ad- opted and upon approval by Mayor, assigned No. 27024. 78566 - Moved by Roehr, seconded by Getty that proof of publication of notice of public hearing on proposal to vacate, sell and convey all that part of Poplar Street located west of Riverside Drive to Joyce M. Goss and Paul L. & Donna M. Hamilton for the sum of 10 per sq. ft. plus costs as pub- lished in the Waterloo Courier on May 16, 1980 be received and placed on file. Motion carried. 78567 - Hold Hearing - this being the time and place for hearing the Mayor called for oral and written objections and there were none. Moved by Burton, seconded Wilharm that "Ordinance vacating that part of Poplar Street located west of westerly right-of-way line of Riverside Drive", be received, placed on file, considered and passed for the first time. Ayes: Six. Absent: Bowers. Motion carried. 78568 - Moved by Penaluna, seconded by Getty that proof of publication of notice of public hearing on site plan for RC Realtors located at 346 East Ridge- way Avenue as published in the Waterloo Courier on May 16, 1980, be re- ceived and placed on file. Motion carried. 78569 - Hold Hearing - this being the time and place for hearing the Mayor called for oral and written objections and there were none. 78569 - (continued) Moved by Roehr, seconded by Dowie that "Resolution approving site plan for an addition to RC Realtors located at 346 East Ridgeway Avenue", be adopted. Ayes: Six. Absents Bowers. Resolution adopted and upon ap- proval by Mayor, assigned No. 27025. 78570 - Mayor Rooff informed the Council that the City Engineer's has been work- ing on solutions to the drainage problems in the areas of (1) Carriage Hill Drive, (2) Lynda, Nancy and Rachael Streets and (3) Columbus Drive. Robinson Engineering is currently reviewing the plans for the first two above mentioned area. The Mayor stated that he would be coming back to the Council and ask for funding for the proposed improvements. 78571 - Barbara Oscar, 119 Hawver Court, representing C.C.I. presented the Coun- cil with written demands in regard to the quality of work being performed under the Rehabilitation Program under the administration of the Community Development Board. Specific cases were discussed. Mrs. Donald Konken, 1158 Longfellow Avenue sited complaints relating to furnace work performed by Stiq's Electric. Helen Klinghammer, 124 Clay Street made reference to work performed by Union Plumbing and also that she had trouble with doors closing properly in her home. Cowen Butler, 403 Almond, reported on a poor paint job. M. C. Dabney, 104 Bates, and Geo Hutchens, also expressed objections to the work being performed. Dale Mercer, Community Development Administrator, stated that every effort is being made by his staff to remedy any alleged poor workmanship and to work with all parties. He stated that no new projects will be undertaken until such time as all past jobs are satisfactorily completed. Mayor Rooff reiterated his support for the program and its continuation. He stated that he and Council empathized with the citizens and will make every effort to rectify any problems. Moved by Roehr, seconded by Penaluna that the oral and written remarks be received and placed on file. Motion carried. 78572 - Moved by Burton, seconded by Dowie that communication from Plan and Pro- gram Commission, transmitting an offer of sale to the City of Waterloo from Elizabeth Smith with the National Bank of Waterloo as Conservators for a 'parcel of land located in Section 2-88N-13 (Bethel Street) for the sum of $2,000.00 for the construction of Bethel Street and recommending approval, be received, placed on file and "Resolution accepting and ap- proving certain offers to sell real property to the City and accepting and approving certain deeds", be adopted. Ayes: Six. Absent: Bowers. Resolution adopted and upon approval by Mayor, assigned No. 27026. 78573 - Moved by Roehr, seconded by Wilharm that communication from Community De- velopment Board, transmitting an offer of sale to the City of Waterloo from B. Schultz Company for a parcel of property to the rear of 800 and 900 Block of Commercial Street generally described as parts of lots 38, 39, and 40 in fractional block 8, original plat on the west side of the Cedar River, Waterloo, Black Hawk County, Iowa for the sum of $39,715.00 for the construction of Stage III -E of the Waterloo Flood Control Project and recommending approval, be received, placed on file, and "Resolution accepting and approving certain offers to sell real property to the City and accepting and approving certain deeds", adopted. Ayes: Six. Absent: Bowers. Resolution adopted and upon approval by Mayor, assigned No.27027. 78574 - Daniel Wee, 125 Park Lane asked for clarification as to the action the Council would be taking on the Park Lane Sidewalk issue. He stated that he was still in the process of obtaining signatures of support for the sidewalk. Mayor Rooff stated that he and the City Engineer were under the impression that no more signatures were needed and that the program could get underway. He stated that the tapes of that Council meeting would be checked. Moved by Wilharm, seconded by Getty that the recommendation of the City Engineer be approved of not paying the 25% assessment. A motion was then June 2, 1980 78574 - (continued) presented by Dowie, seconded by Burton to table any action on the above motion for three weeks. Ayes: Six. Absent: Bowers. Motion carried_ Attorney Hultman stated that the motion to table takes presidence over the original motion and that this motion will be on the floor in three weeks. 78575 - Moved by Dowie, seconded by Roehr that communication from the City Eng- ineer advising improvements required as a condition precedent to final approval of plat improvements of the Addition to be known as Southland Park Third Addition have been completed in substantial conformance with construction plans, standards and requirements of his office, submitting two-year maintenance bond for the sewer improvements, and four year main- tenance bond for paving, and recommending acceptance of said Addition and bonds, be received, placed on file, approved and accepted with effective dates of bonds being that of final Council approval. Motion carried. 78576 - Mayor Rooff explained that the City is undertaking a new program of cutt- ing weeds whereby complaints will be handled by the Courts. The City will not be cutting weeds as in years past. Moved by Wilharm, seconded by Roehr that communication from City Clerk recommending that the required public notice to property owners notifying them to cut or destroy all weeds, vines, etc. Not be published, be re- ceived, placed on file and "Resolution authorizing the City Clerk NOT to publish a notice to property owners notifying them to cut or destroy all weeds, vines, etc.", be adopted. Ayes: Burton, Getty, Penaluna, Roehr, Wilharm. Nays: Dowie. Absent: Bowers. Resolution adopted and upon approval by Mayor, assigned No. 27028. 78577 - Moved by Wilharm, seconded by Getty that the rules requiring ordinance to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Rezone Certain Property, (William F. Mclntee & Sons, Inc.) Ayes: Dowie, Getty, Wilharm. Nays: Burton, Penaluna, Roehr. Absent: Bowers. Motion not carried. 78578 - Moved by Wilharm, seconded by Burton that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 175 to Section 2A-5, re- zoning certain property", be received, placed on file, considered, passed for the second time. Ayes: Six. Absent: Bowers. Motion carried. 78579 - Moved by Roehr, seconded by Burton that "An Ordinance amending Ordinance No. 2644, known as the Traffic Ordinance, by adding Subsection (167a) Littlefield Road to Section 551, Parking Prohibited At All Times on Cer- tain Streets; and by repealing Subsection (226a) Rachael Street and en- acting in lieu thereof new Subsection (226a) Rachael Street to Section 551, Parking Prohibited At All Times on Certain Streets", be received, placed on file, considered and passed for the first time. Ayes: Six. Absent: Bowers. Motion carried. 78580 - Moved by Burton, seconded by Penaluna that communication from Fire Chief requesting Council approval of the following promotions in the Waterloo Fire Department effective June 5, 1980, be received, placed on file and approved: To the Rank of Division Chief Verlin Fairbanks To the Rank of Captain Francis Magsamen Motion carried. 78581 - Moved by Roehr, seconded by Wilharm that following request for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Administrative Assistant of the Building Department to Conway to attend Energy Building Code Workshop, Waterloo, Iowa, on July 22, 1980 plus use of City vehicle -- $25.00 Ayes: Six. Absent: Bowers. Motion carried. Motion carried. 78587 - Moved by Burton, seconded by Dowie that report of City Attorney and list of bonds filed with the Clerk through June 2, 1980, be received, placed on file and report and bonds approved.
