The Council of the City of Waterloo, Iowa, met in Regular Session in Council Ch-
ambers in the City Hall at 7:00 P.M., on April 21, 1980. Mayor Rooff in the
Chair. On roll call: Present: Bowers, Burton, Dowie, Getty, Roehr, Wilharm.
Absent: Penaluna. Invocation by Councilman Wilharm.
78326 - Moved by Roehr, seconded by Getty that the Agenda, as proposed, for the
Regular Session of April 21, 1980, at 7:00 P.M., be accepted and approv-
ed. Motion carried.
78327 - Moved by Wilharm, seconded by Dowie that the minutes of the regular sess-
ion held April 14, 1980, at 7:00 P.M., be approved. Motion carried.
78328 - Moved by Burton, seconded by Bowers that proof of publication of Notice
of Intention to Issue Urban Renewal Revenue Bonds Series 1980 (Stephens,
Inc.) not to exceed $1,200,000 in the City of Waterloo, Iowa, as pub-
lished in the Waterloo Courier on April 4, 1980, be received and placed
on file. Motion carried.
Councilman Dowie questioned what happened to bond money left unexpended
after completion of the project. Mr. Hugh Field replied by indicating
that the Internal Revenue Service Code allows 10% of the bond issue to
be used for expenses other than construction costs which are related to
the project.
78329 - Hold Hearing - Mayor Rooff announced this was the time and place for pub-
lic hearing on the proposal to issue said bonds, as published in the Wat-
erloo Courier on 4/4/80, called for written and oral objections, and
there were none.
Moved by Wilharm, seconded by Burton that "Resolution relating to the
public hearing and approving proceeding with the issuance and sale of
not to exceed $1,200,000 aggregate principal amount of Urban Renewal
Area Revenue Bonds (Stephen's, Inc.) of the City of Waterloo, Iowa." be
adopted. Ayes: Six. Absent: Penaluna. Resolution adopted and upon
approval by Mayor, assigned No. 26947.
78330 - Moved by Roehr, seconded by Bowers that proof of publication of Notice
of Public Hearing on proposed submission of an application to the Dep-
artment of Housing and Urban Development for Federal assistance under
Title I of the Housing and Community Development Act of 1974, as amended,
for the Downtown Sycamore 500 Project, be received and placed on file.
Motion carried.
78331 - Hold Hearing - This being the time and place for hearing, the Mayor call-
ed for written and oral objections, and there were none.
Moved by Bowers, seconded by Wilharm that a "Resolution approving the
submission of an application to the Department of Housing and Urban De-
velopment for Federal assistance under Title I of the Housing and Com-
munity Development Act of 1974, as amended, for the Downtown Sycamore
500 Project," be received, placed on file, and adopted. Ayes: Six.
Absent: Penaluna. Resolution adopted and upon approval by Mayor, as-
signed No. 26948.
78332 - Mr. Hugh Field, Attorney, asked that the City Council set a date of pub-
lic hearing regarding the issuance of $5.2 million of Hospital Facility
Revenue Bonds, Series 1980 B for Schoitz Memorial Hospital. A second
public hearing is being scheduled as the former hearing was for the am-
ount of $4.9 million. The bids for the hospital addition are more than
for the amount previously advertised for.

- Don Thorson of the City Engineer's Office presented a written report re-
garding the request of Roosevelt Roby for the City to use Block Grant
Funds to construct sidewalks and curbs on and around Parcel No. 40 of
Community Development Urban Renewal Plan (C.R.#78291). The report re-
commended that the request be denied.
It was moved by Bowers, seconded by Wilharm to receive and place on file
the City Engineer's recommendation of denial that a copy of the City En-
gineer's report be forwarded to Mr. Roby. Motion carried.
78334 - Moved by Roehr, seconded by Wilharm that request of Robert Francis for
permission to construct temporary concrete driveway, without regard to
sidewalk grade, at 5462 Tucson Drive, and City Engineer's recommendation
for approval subject to the provisions of his letter, be received, plac-
ed on file, recommendations approved anndrmission granted in accord-

permission to construct temporary concrete driveway, without regard to
sidewalk grade, at 87 Zuma Street, and City Engineer's recommendation
for approval subject to the provisions of his letter, be received, plac-
ed on file, recommendations approved and rmission granted in accord-

78336 - Moved by Getty, seconded by Bowers that request of Waterloo Water Works
for permission to construct temporary concrete driveway, without regard
to sidewalk grade, at 3131 West Ridgeway Avenue and City Engineer's re-
commendation for approval subject to the provisions of his letter be re-
ceived, placed on file, recommendations approved and permission granted

78337 - Moved by Burton, seconded by Bowers that communication from City Engin-
eer transmitting various petitions for oiling with assessment plats of
certain streets, avenues, alleys, etc., or portion thereof, for the 1980
Oiling Program, be received, placed on file, and said streets, avenues,
alleys, etc., or portions thereof, be included in the 1980 Oiling Program,
according to the City Engineer's recommendations and the City Engineer
instructed to proceed accordingly. Motion carried.
78338 - Moved by Wilharm, seconded by Bowers that under Council Action No. 78286
of April 14, 1980, communication from City Engineer reporting cost on
various improvements to Ogden Avenue from Fulton to Ann Street be receiv-
ed and placed on file, and action delayed until such time as a drainage
study is completed which is to be funded with Community Development Block
Grant Funds. Motion carried.
78339 - Moved by Bowers, seconded by Dowie that the oral communication of City
Attorney Evan Hultman regarding Council Action No. 78295, April 14, 1980
dealing with the 45' curb cut located on Highway 218, just westerly of
its intersection of Falls Avenue, stating that the motion did not require
a 3/4 majority to pass, therefore the motion to allow the curb cut did
carry, be received and placed on file. Motion carried.
78340 - Moved by Roehr, seconded by Wilharm that communication from the City En-
gineer advising improvements required as a condition precedent to final
approval of plat improvements of the Addition to be known as Ranchero
Park Addition have been completed in substantial conformance with con-
struction plans, standards and requirements of his office, submitting
two-year maintenance bond for the sewer improvements, and recommending
acceptance of said Addition and bonds, be received, placed on file, ap-
proved and accepted with effective dates of bonds being that of final
Council approval. Motion carried.

Bridges," Contract #16, be received, placed on file and "Resolution Ap-

Waterloo Construction Company, Inc., Waterloo, Iowa, for Repairs to llth
Street and Falls Avenue Bridges, Contract #16 in the amount of -$233,485.
