Mayor Rooff in the Chair. On roll call: Present: Bowers, Burton, Getty, Penaluna, Roehr, Wilharm. Absent: Dowie. Invocation by Councilman Wilharm. 78120 - Moved by Roehr, seconded by Wilharm that the agenda as amended for the Regular Session of March 17, 1980 at 7:00 P.M. be accepted and approved. Motion Carried. 78121 - Moved by Burton, seconded by Bowers that the Minutes of the Regular Session held on March 10, 1980 at 7:00 P.M. be approved. Motion Carried. 78122 - Moved by Bowers, seconded by Burton that Proof of Publication of Notice of Public Hearing on Proposed Plans, specifications, Form of Contract, Estimate of Cost, etc., for Construction 600 Block North Barclay Street, Sanitary Service Relocation, Contract No. 194, and taking of Construction Bids therefor, be received and placed on file. Motion carried. 78123 - This being the time and place for hearing, the Mayor called for written and oral objections, and there were none. Moved by Bowers, seconded by Wilharm that ''Resolution Confirming the Approval of Plans, Specifications, etc. for the Construction 600 Block North Barclay Street, Sanitary Service Relocation, Contract No. 194, be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 26869. 78124 - Moved by Getty, Seconded by Roehr, that "Resolution Ordering the Construction of 600 Block North Barclay Street, Sanitary Service Relocation, Contract No. 194", be adopted. Ayes: Six, Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 26870. 78125 - Moved by Roehr, seconded by Bowers that Proof of Publication of Notice to Contractors or Invitation for Bids of Construction 600 Block North Barclay Street, Sanitary Service Relocation, Contract No. 194, be received and placed on file. Motion Carried. 78126 - Moved by Wilharm, Seconded by Burton, that the following bids, be received, placed on file, Clerk instructed to open and read same and bids referred to the Engineers for checking and report back: Bidder Black Hawk Plumbing Stigs Electric Bid Sec Ray Waschkat Plumbing Motion Carried. Amount of Bid Bid Bond or Cashier Check $14,742.50 . I 875.00 14,706.40 $900.00 43. 75 14, 791.00 78127 - The City Engineer reported back that: Sec. I Waschkat Low Bidder Sec. II Black Hawk Plumbing Low Bidder The City Engineer recommended acceptance of the low bid of Waschkat Plumbing in the amount of $14,706.40 for Contract No. 194. Moved by Getty, seconded by Bowers that the above recommendation be received, placed on file and "Resolution making award of contract for Construction 600 Block North Barclay Street, Sanitary Service Relocation, Contract No. 194 to Ray-Waschkat Plumbing", be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 26871. 78128 - Moved by Roehr, seconded by Wilharm that Proof of Publication of Notice of Public Hearing on Proposed Plans, Specifications, Form of Contract, Estimate of Cost, etc. for Repairs to Eleventh Street and Falls Avenue Bridges, Contract No. 16, and taking of Construction Bids therefor, be received and placed on file. Motion Carried. � - 3- /Ns, 78136 - The Mayor announced this was the time and place for public hearing, as published in Waterloo Courier on 2-29-8Q, called for written and oral objections, and there were oral presentations by Fred Debe of Reed Cadillac who stated he would like the South 100 feet part of the "A-1" zoning and become rezoned " C-2". Moved by Getty, seconded by none to refer the request of Fred Debe to the zoning commission for reconsideration. Motion died for lack of second. Moved by Wilharm, seconded by Roehr that request of City Zoning Commission for Council on its own motion to rezone from its present "A-1" Agricultural District to "R-2" One and Two Family Residential District approximately nine (9) acres of land located east of Hammond Avenue and approximately 1,000 feet north of U.S. Highway 412, for the purpose of maintaining the residential character of the neighborhood, be received, placed on file, conside- red and passed for the first time. Ayes: Six, Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 26875. 78137 - Moved by Roehr, seconded by Wilharm, that the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Roehr, Wilharm. Nays: Bowers, Burton, Getty, Penaluna. Absent: Dowie. Notion died for lack of majority vote. 78138 - Karl Kough of 733 Johnson presented a petition for curb and gutter to be installed in the 500 and 700 Blocks of Johnson St. Moved by Wilharm, seconded by Bowers, be received, placed on file and referred to the Engineers. Motion carried. 78139 - Karen Kopplin of 1715 Commercial asked the Council why the cost of garbage could not be reduced if garbage pick-up was going to be reduced to one day a week, and if there was a possibility of taking over the landfill and save the City the cost of paying for the use of the landfill. The Mayor stated that the actual cost of garbage pick-up per household is $3.82 and the City is only charging $3.00 a month for garbage pickup. He also stated that the landfill is a private corporation and not owned by the city. 78140 - Councilman Bowers presented a petition for oiling and grading to Cottage Grove Ave. between Colorado and Indiana Street was received. Moved by Bowers, seconded by Getty, the above petition be received and placed on file. Motion carried. 78141 - Councilman Bowers presented a petition for the paving of the 800 Block of Linden Avenue. Moved by Bowers, seconded by Getty, the above petition be received, placed on file and referred to the Engineer's for checking as to the possibility of using Block Grant Funds. Motion carried. 78142 - Councilman Getty asked one of the members of the Council on the prevailing side of the vote to reconsider on the Park Lane side- walk project in which the City is to pay 257 of the cost. Motion died for lack of motion. 78143 - Moved by Roehr, seconded by Getty, that communication from Community Development Board, transmitting an Offer of Sale to the City of Waterloo from Richard L. and Mary J. Anderson, a portion of the property located on Shaulis Road (the west 35 feet of the North 10 feet of the South 43 feet of the following described property. the west one hundred sixty (160) feet of the east four hundred forty (440) feet in even width of the south two hundred seventy-eight (278) feet in even width of the southeast quarter of the southwest quarter of Section No. (11), Township No. Eighty- eight (88) north, Range No. Thirteen (13) west of the fifth principal meridian, Black Hawk County, Iowa) for the sum of $100.00 for the construction right-of-way for paving of Shaulis Road and recommending approval, be received, placed on file and "A Resolution accepting and approving certain offers to sell real property to the city and accepting and approving certain deeds", adopted. Ayes:Six, Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 26876. -5- 78150 - Moved by Burton, seconded by Wilharm, that the following Construction Permit from Iowa Department of Evironmental Quality, subject to certain conditions and requirements, be received, placed on file and approved. No. 80-133-S for Sanitary Sewer Extension to Shultz Street No. 80-159-S for Sanitary Sewer Extension to Woodland Knolls Addition. Motion Carried. 78151 - Moved by Penaluna, seconded by Wilharm, that communication from City Clerk recommending for Council appointment the name of Michelle Temeyer to the position of Deputy Clerk in the City Clerk's Office, effective March 21, 1980, at a salary of $15,000 per year be received, placed on file, recommendation approved and Michelle Temeyer appointed Deputy Clerk in accordance therewith. Ayes; Six, Absent, Dowie. Resolution adopted and upon approval by Mayor, assigned 26881. 78152 - Moved by Roehr, seconded by Penaluna, that the City Engineer be instructed to prepare plans, proposal form, cost estimate, form of contract, etc. for F.A.U.S., Black Hawk County, Bridge on Shaulis Road over Sink Creek - Project No. M-6470 (1) -- 81 - 07, Contract No. 200. Motion carried. 78153 - Moved by Councilman Wilharm, seconded by Roehr, that the plans, form of contract, estimate of cost, etc. for F.A.U.S., Black Hawk County, Bridge on Shaulis Road over Sink Creek - Project No. M-6470(1) -- 81-07, contract No. 200, be received, placed on file and "Resolution preliminary approving plans, form of contract, estimate of cost, etc. for F.A.U.S., Black Hawk County, Bridge on Shaulis Road over Sink Creek - Project No. M-6470 (1) -- 81-07, Contract No. 200", adopted. Ayes; Six, Absent; Dowie. Resolution adopted and upon approval by Mayor, assigned No. 26882. 78154 - Moved by Burton, seconded by Bowers that Clerk be instructed to publish the notice of Public Hearing on plans, form of contract, etc. for F.A.U.S., Black Hawk County, Bridge on Shaulis Road over Sink Creek - Project No. M-6470 (1) -- 81-07, Contract No. 200, with date of hearing set as March 24, 1980 at 7:00 P.M. in Council Chambers, Waterloo, and to publish notice to bidders, with date of letting set as April 1, 1980, at Iowa Department of Transportation, Ames, Iowa. Motion carried. 78155 - Moved by Getty, seconded by Burton that following request for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Assistant Superintendent of Water Pollution Control to Iowa Wastewater Short Course, University of Iowa, Iowa City, April 15 - 16, 1980, $126.00 plus use of city vehicle. Finance Director/Treasurer to Iowa Municipal Finance Officers Semi - Annual Meeting & Fire and Police Retirement System Workshop, Des Moines, Iowa, April 16-18, 1980, $219.20 Ayes: Six. Motion carried. 78159 - Moved by Councilman Bowers, seconded by Penaluna, that report of City Attorney and list of bonds filed with clerk through March 17, 1980, be received, placed on file and report and bonds be approved.
