Invocation by Councilman Getty. February 25, 1980 in Regular Session in Council Cham - 25, 1980. Mayor Rooff in the Chair. Getty, Penaluna, Roehr, Wilharm. 77965 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of February 25, 1980, at 7:00 P.M., be accepted and ap- proved. Motion carried. 77966 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held February 18, 1980 at 7:00 P.M. be approved as corrected. The minutes of February 18, 1980 should state that Larry P. Burger took the minutes of that meeting after he was appointed City Clerk. Motion carried. 77967 - Moved by Roehr,seconded by Getty that proof of publication of notice of public hearing on proposal to vacate the east -west alley located within Block 9, Ricker and Bratnober Land Company Addition, to Waterloo, Iowa and sell and convey that part of the 16' east -west alley located in Block 9, Ricker and Bratnober Land Company Addition, to Waterloo, Iowa lying east of a point described as being 10' east and parallel to the centerline of the most easterly track as now located of the Waterloo Railroad Co. to David H. Buck on behalf of Matt Parrott and Sons Co. for $360.00 plus costs, and also sell and convey that part of the 16' east -west alley located adjacent to Lots 1, 2, 3, 21, 22, 23, Block 9, Ricker and Bratnober Land Company Addition of Waterloo, to Craftbuilt Homes of Waterloo, Inc., for $240.00 plus costs as published in the Waterloo Courier on 2-15-80, be received and placed on file. Motion carried. 77968 - This being the time for hearing, the Mayor called for oral and written objections, and there were none. Moved by Wilharm, seconded by Burton that "Ordinance vacating east -west alley located in Block 9, Ricker find -Bratnober Land Company Addition" be received, placed on file, considered and passed for the first time. Ayes Seven. Resolution adopted and upon approval by Mayor, assigned No. 26809. 77969 - Moved by Roehr, seconded by be considered and voted for above ordinance recorded as second and third times, and Motion carried. Wilharm that the rules requiring ordinances to passage at two prior meetings, suspended, the having been considered and passed for the now placed on its final adoption. Ayes Seven. 77970 - Moved by Bowers, seconded by Wilharm that "Ordinance vacating a portion of east -west alley in Block 9, Ricker and Bratnober Land Company Addition", be adopted. Ayes Seven. Ordinance adopted and upon approval by Mayor, assign ed No. 3073. 77971 - Moved by Wilharm, seconded by Bowers that "Resolution authorizing the con- veyance of a portion of east -west alley in Block 9, Ricker and Bratnober Land Company Addition, to David H. Buck on behalf of Matt Parrott and Sons Company and Craftbuilt Homes of Waterloo, Inc., and directing and authoriz- ing the Mayor and City Clerk to execute and deliver a deed for said proper- ty", be adopted. Ayes Seven. Resolution adopted and upon approval by Mayor, assigned No. 26810. ',77972 - Moved by Burton, seconded by Roehr that proof of publication of notice of public hearing on site plan for Faith Evangelical Lutheran Church located southeasterly of the intersection of West Fourth Street and West Ridgeway Avenue, upon recommendation of Plan and Program Commission and on Council's own motion, as published in Waterloo Courier on 2-8-80, be received and placed on file. Motion carried. ,77973 - This being the time for hearing, the Mayor called for oral and written ob- jections, and there were none. Moved by Roehr, seconded by Wilharm that "Resolution approving the site plan for Faith Evangelical Lutheran Church, located southeasterly of the intersection of West Fourth Street and West Ridgeway Avenue", be adopted. Ayes Seven. Resolution adopted and upon approval by Mayor, assigned No. 26811, 177974 - Moved by Wilharm, seconded by Dowie that proof of publication of notice of public hearing on site plan for Grace Lutheran Church located at the inter- section of West Seventh and Allen Streets, upon recommendation of denial from Plan and Program Commission due to potential negative impacts upon the neighborhood in regard to insufficient off-street parking, and on 77974 - (Continued) Council's own motion, as published in Waterloo Courier on 2-8-80 be receiv- ed and placed on file. Motion carried. 77975 - This being the time for hearing, the Mayor called for oral and written ob- jections, and there were none. Moved by Burton, seconded by Wilharm that "Resolution approving the site plan for Grace Lutheran Church located at the intersection of West Seventh and Allen Streets, be adopted. Ayes: Burton, Dowie, Getty, Wilharm. Nay: Bowers, Penaluna, Roehr. Adoption of Resolution deferred by Mayor Rooff and referred to City Attorney and Plan and Program Director for their de- termination on wether a 3/4 vote is needed to pass this Resolution. Motion carried. 77976 - Andy Aasgaard, 808 Wellington, presented a petition to the Council not to cut any more money out of the Library Fund. Moved by Penaluna,seconded by Burton that the petition be received, placed on file. Motion carried. 77977 - Moved by Wilharm, seconded by Bowers to accept the Resolution authorizing the Northeast Iowa Area Crime Commission to act in the Cities behalf in criminal justice planning, submitting applications for federal and state funds, administering training programs and administering grant funded pro- grams for the years 1980, 1981, 1982 and any future years, be received, placed on file. Ayes Seven. Resolution adopted upon approval by Mayor, assigned No. 26812. 77978 - Councilman Burton presented a petition objecting to the sewer project runn- ing parallel with Black Hawk Street and Commercial Street in the alley be- tween 12th Street and 13th Street. Moved by Burton, seconded by Roehr that the above petition be received and placed on file. Motion carried. 77979 - Moved by Roehr, seconded by Dowie that request of City Zoning Commission for Council on its own motion to rezone from its present "A-1" Agricultural District to "R-2" One and Two Family Residential District approximately nine (9) acres pf land located east of Hammond Avenue and approximately 1,000 feet north of U.S. Highway 412, for the purpose of maintaining the residential character of the neighborhood, be received, placed on file, re- commendation approved, date of hearing set as 3-17-1980 at 7:00 P.M. and Clerk instructed to publish notice. Motion carried. 77980 - Moved by Burton, seconded by Wilharm that request of Plan and Program Com- mission to transmit a change in the City's Subdivision Ordinance (Ordinance #2997) regarding the maintenance of improvements by striking Section 3.3, Subsection 1 and substituting the following: the applicant, for each sub- division submitted, shall be required to furnish one good and sufficient Maintenance Bond for the installation of all public improvements within the subdivision, including streets, curbs and putter, sanitary sewer and storm sewer, according to City specifications and for the repairs necessi- tated by defects in material or workmanship during a time period not to exceed two (2) years from and after acceptance of the completion of the improvements by the City Council, said bond shall be in an amount consider- ed adequate by the City Engineer and in a form satisfactory to the City Attorney, be received, placed on file, and "Resolution fixing the time and place of hearing as 3-17-1980, on transmitting a change in the City's Sub- division Ordinance (Ordinance #2997), be adopted and Clerk instructed to publish Notice of Hearing. Ayes Seven. Resolution adopted and upon approv al of Mayor, assigned No. 26813. 77981 - Moved by Roehr, seconded by Burton that communication from Plan and Pro- gram Commission, transmitting request of F.R.Debe on behalf of Country Manor, Inc., and Association of co-owners of Prairie Meadow West Condo to accept into the public street system certain private streets, and recom- mending denial be sustained by the Council. Ayes Seven. Resolution adopt- ed and upon approval of Mayor, assigned No. 26814. 77982 - Moved by Wilharm, seconded by Burton that communication from City Engineer, transmitting a correction of error under F.Y. 1979 Oiling Program Contract 1, for special assessment to Clarence F. Otto for Real Property Code #65- 0026947 in Highland Addition Lot 4 Block 16, cancel the oiling assessment due to a duplication in the billing, be received, place on file, approved and "Resolution approving correction of error in special assessment for certain real property under Code #65-0026947 for F.Y. 1979 Oiling Program Contract 1", adopted and Clerk instructed and directed to certify said February 25, 1980 3 - 77982 - (Continued) change to Black Hawk County Auditor. Resolution adopted and upon approval by Mayor, assigned No. 26815. 77983 - Moved by Burton, seconded by Dowie that recommendation of Sign and Traffic Maintenance Department for acceptance of the following total bid of Vogel Paint and Wax Company, Orange City, Iowa, be received, placed on file, ap- proved and accepted and issuance of purchase order and warrant authorized: Gallons White Paint $5.30 Per Gal. Gallons Yellow Paint $5.65 Per Gal. Gallons Xylol Thinner $2.42 Per Gal. Ayes Seven. Resolution adopted and upon approval by Mayor assigned No. 26816. 77984 - Moved by Roehr, seconded by Wilharm that communication from City Engineer, transmitting bid tabulation for Repairs to the Eleventh Street and Falls Avenue Bridges, Contract No. 16 and recommending that all bids be rejected and bid bonds be returned to the respective bidders, and Council approve revising the scope of the work and advertising the project for new bids. Ayes Seven. Resolution adopted and upon approval by Mayor, assigned No. 26817. 77985 - Moved by Roehr, seconded by Wilharm that communication from Personnel Di- rector reporting on the contract impasse between Waterloo Firefighters and the City of Waterloo. The Firefighters union rejected the contract and re- quested binding arbitration proceedings, be received, placed on file, and Council recommended the City to reject the report due to the excessive wage increase recommendation of 9%. Ayes Seven. Resolution adopted and upon approval by Mayor, assigned No. 26818. 77986 - Moved by Getty, seconded by Penaluna that communication from Water Pollut- ion Plant, transmitting the Application for the Iowa NPDES Permit on behalf of the City, and recommending approval, be received, placed on file and "Resolution approving Application for the Iowa NPDES Permit", be adopted, and Mayor and City Clerk authorized to execute same. Ayes Seven. Resolut- ion adopted and upon approval by Mayor, assigned No. 26819. 77987 - Moved by Penaluna, seconded by Getty that revised construction plans for sanitary sewerage facilities serving Sanitary Sewer Extension Sec. 11-18-13 Guernsey as submitted by Robinson Engineering Company of Waterloo, and City Engineer's recommendation for approval, be received, place on file and ap- proved. Motion carried. 77988 - Moved by Getty, seconded by Roehr that the following Construction Permit from Iowa Department of Environmental Quality, subject to certain condit- ions and requirement, be received, place on file and approved. No. 80-140- S for Sanitary Sewer Extension to San Souci Drive, Motion carried. 77989 - Moved by Wilharm, seconded by Dowie that "Resolution Lifting the Moratorium on Single Housing Construction" subject to sump pump and proper construct- ion standards on drainage' tile and footing drains in the Castle Hill area. Ayes Seven. Resolution adopted and upon approval by Mayor, assigned No. 26820. 77990 - Moved by Getty, seconded by Burton that "Ordinance amending the Traffic Ordinance, No. 2644, by Repealing Subsection (11) Donald Street (East) on Section 569, Truck Traffic Prohibited on Certain Streets, in its entirety, and enacting in lieu thereof new Subsection (11) Donald Street (East) of Section 569, Truck Traffic Prohibited on certain streets", be received, placed on file, and referred to Quintin Parker, Sign and Traffic Department with a report back on March 3, 1980. Motion carried. 77991 - Moved by Bowers, seconded by Burton that "An Ordinance Establishing Inspect ion Fees for Multiple Family Dwellings", be received, placed on file, con- sidered and passed for the third time and now place on its final adoption.
