The Council of the City of Waterloo, Iowa, met in Regular Session in Council Chambers in the
City Hall at 7:00 P.M. on February 18, 1980. Mayor Rooff in the Chair. On roll call:
Present: Bowers, Burton, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invocation by
Councilman Wilharm.
77935 - Moved by Roehr, seconded by Burton that the Agenda, as amended, for the Regular Session
of February 18, 1980, at 7:00 P.M., be accepted and approved. Motion carried.
77936 - Moved by Burton, seconded by Bowers that the Minutes of the Regular Session held
February 11, 1980 at 7:00 P.M. be approved. Motion carried.
77937 - Moved by Roehr, seconded by Penaluna that Proof of Publication of Notice of Public Hear-
ing on proposed plans, specifications, formof contract, estimate of cost, etc. for
Repairs to the Eleventh Street and Falls Avenue Bridges, Contract No. 16, and the taking
of bids therefor, as published in the Waterloo Courier on 2-11-80, be received and
placed on file. Motion carried.
77938 - This being the time and place for hearing, the Mayor called for written and oral
objections, and there were none.
Moved by Burton, seconded by Getty that "Resolution confirming the approval of plans,
specifications, etc. for the Repairs to the Eleventh Street and Falls Avenue Bridges,
Contract No. 16", be adopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 26804.
77939 - Moved by Bowers, seconded by Wilharm that "Resolution ordering the construction of
repairs to the Eleventh Street and Falls Avenue Bridges, Contract No. 16", be adopted.
Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26805.
77940 - Moved by Wilharm, seconded by Bowers that the following bids, be received, placed on
file, Clerk instructed to open and read same and bids referred to the Engineers for
checking and report back:

77941 - Moved by Burton, seconded by Getty that the bids for the construction of repairs to
the Eleventh Street and Falls Avenue Bridges be referred to the Engineers for
checking and report back on February 25, 1980. Motion carried.
77942 - Moved by Roehr, seconded by Dowie that communication from Sign & Traffic Maintenance
Department, transmitting the following sealed informal bid for purchase of Fast Dry
Traffic Paint and Thinner for use by said Department, be received, placed on file
and Clerk instructed to open and read same:

77943 - Moved by Roehr, seconded by Dowie that the above bid be referred to Quintin T. Parker,
Sign and Traffic Maintenance Department, for his recommendation, with report back on
February 25, 1980. Motion carried.
77944 - Mayor Rooff recommended to Council the appointment of Larry Burger as City Clerk,
with a salary of $20,000 after six months to be readjusted to current City Clerk's
salary.
Moved by Wilharm, seconded by Roehr to receive the recommendation of the Mayor to
appoint Larry Burger as City Clerk at a salary of $20,000 and after six months to be
adjusted to the current salary of the Clerk. Ayes: Bowers, Burton, Roehr, Wilharm.
Nay: Dowie, Getty, Penaluna. Motion carried.
77945 - Mayor Rooff administered the Oath of Office to Larry Burger as City Clerk.

77946 - City Attorney Evan Hultman reported on the Employee's Deferred Compensation Plan,
and recommended not allowing any additional companies to be accepted by the City.
Moved by Bowers, seconded by Dowie not to add any additional insurance companies
to the Employee's Deferred Compensation Plan. Motion carried.
77947 - Moved by Wilharm, seconded by Dowie to receive the recommendation from Engineers
concerning the request from Michael Diers, 3726 E. Shaulis Road to have his assess-
ment under Paving Contract No. 166 reduced due to his triangular lot (See C.R. #77909)
and recommending the assessment be reduced by $850.00. Ayes: Seven. Motion carried.
77948 - Under Council Action No. 77448 of 11/13/79 the proposal to change the business proce-
dure of Waterloo Yellow Cab Company was referred to City Attorney.
Moved by Burton, seconded by Roehr that the report of the City Attorney, be received,
placed on file, recommending action to be deferred until a change in the ordinance
is made. Motion carried.
77949 - Moved by Wilharm, seconded by Getty that report of Quintin T. Parker, Sign & Traffic
Maintenance Department, on request of Councilman Getty, on semi truck traffic on East
and West Donald Street (See C.R. #77912) be received, placed on file and approved
along with Quintin T. Parker's recommendations. Ayes: Seven. Motion carried.
77950 - Moved by Burton, seconded by Bowers that the Minutes of the Regular Meeting of the
Community Development Board held January 8, 1980 at 7:00 P.M., be received, placed on
file and approved. Motion carried.
77951 - Moved by Wilharm, seconded by Bowers that report of Mayor on Sanitary Sewer problem
in Castle Hill area and recommending lifting the Moratorium on single housing construc-
tion subject to sump pump and proper construction standards on drainage tile and
footing drains and ordering plans completed along with accepting and approving
report from Brice, Petrides & Associates, Inc. Ayes: Seven. Motion carried.
77952 - Moved by Bowers, seconded by Burton that Financial Report of Waterloo Water Works for
the year ending December 31, 1979, be received, placed on file and approved. Motion
carried.
77953 - Moved by Burton, seconded by Dowie that construction plans for Sanitary Sewerage
Facilities serving Timothy Ridge Second Addition together with Treatment Agreement
Form WQ-59 for Department of Environmental Quality and City Engineer's recommendation
for approval subject to final acceptance of plans being reviewed and accepted by DEQ,
be received, placed on file, recommendations approved, and Mayor and Clerk authorized
to execute said Agreement Form. Motion carried.
77954 - Moved by Roehr, seconded by Burton that communication from City Engineer transmitting
Iowa Department of Transportation Agreement for Federal Aid Railroad Protection, Pro-
ject Agreement No. 80-F-006 for installation of railroad crossing signals at Burton
Avenue (State Crossing No. 12877), West Donald Street (State Crossing No. 1730) and
Linden Avenue (State Crossing No. 12716) and authorizing the State to approach the
Railroads with instructions to estimate the cost of such signals, be received, placed
on file and approved. Motion carried.
77955 - Moved by Penaluna, seconded by Dowie that "Resolution authorizing the Iowa Department
of Transportation to begin preliminary negotiations with the Railroad companies for
the installation of Railroad Crossing Signals at Burton Avenue (State No. 12877), West
Donald Street (State No. 1730) and Linden Avenue (State No. 12716), and authorizing
the Mayor and Clerk to execute the same", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 26806.
77956 - Moved by Bowers, seconded by Burton that the adoption of an "Ordinance Establishing
Inspection Fees for Multiple Family Dwellings" be received, placed on file, considered
and passed for the second time. Ayes: Seven. Resolution adopted and upon approval
by Mayor, assigned No. 26807.
77957 - Moved by Roehr, seconded by Dowie that communication from Plan and Program Commission,
transmitting a change in the City's Subdivision Ordinance (Ordinance #2997) regarding
the Maintenance of Improvements, be received, placed on file, and directing the City
Attorney to prepare an Ordinance amending the Subdivision Ordinance (Ordinance No.
2997) by striking Section 3.3, Subsection 1 and substituting the following: The
applicant, for each subdivision submitted, shall be required to furnish one good and
sufficient Maintenance Bond for the installation of all public improvements within the
subdivision, including streets, curbs and gutter, sanitary sewer and storm sewer,
according to city specifications and for the repairs necessitated by defects in mater-
ial or workmanship during a time period not to exceed two (2) years from and after
acceptance of the completion of the improvements by the City Council, said bond shall
be in an amount considered adequate by the City Engineer ar-"\in,a form satisfactory

submitting for Council approval the following appointments to the Housing Advisory and
Appeals Board per Section 203 of the Uniform Housing Code:

77959 - Moved by Roehr, seconded by Penaluna that communication from City Building Official,
reporting resignation of David Rainey, effective January 31, 1980, and entitlement of
72 hours sick leave pay and 13.33 hours vacation pay, be received, placed on file and
"Resolution approving payment of $546.11 sick leave and vacation pay to David Rainey
of the Building Official Department", adopted. Ayes: Seven. Resolution adopted and
upon approval by Mayor, assigned No. 26808.
77960 - Moved by Wilharm, seconded by Burton that following request for permission to attend
functions, with expenses allowed not to exceed amounts shown, be received, placed on
file and approved:
Two Golf Course Superintendents to Annual Iowa Turf Grass Conference, Des Moines,
Iowa, March 3-5, 1980, $325.00.
