Mayor Rooff in the Chair. On roll call: Present:Bowers, Burton, Dowie, Getty, Penaluna, Wilharm. Absent: Roehr. Invocation by Councilman Getty. 77824 - Moved by Wilharm, seconded by Bowers that the Agenda, as proposed, for the Regular Session of January 28, 1980 at 7:00 P.M. be accepted and approved. Motion carried. 77825 - Moved by Burton, seconded by Bowers that a correction in the Minutes of the Meeting held January 21, 1980 should state that the sale of Disposal Parcel No. 42, in the Westfield -Virden Urban Renewal Area should be Disposal Parcel No. A-4, Resolution Number 26759. Motion carried. 77826 - Moved by Burton, seconded by Bowers that the Minutes of the Regular Session, as corrected, held on January 21, 1980 at 5:00 P.M. be approved. Motion carried. 77827 - Moved by Bowers, seconded by Burton that Proof of Publication of Notice of Public Hearing on proposed plans, specifications, form of contract, estimate of cost, etc. for construction of 600 block North Barclay Street, Sanitary Service Relocation, Contract No. 194, and taking of construction bids therefor, be received and placed on file. Motion carried. 77828 - This being the time and place for hearing, the Mayor called for written and oral objections, and there were none. Moved by Bowers, seconded by Getty that "Resolution confirming the approval of plans, specifications, etc. for the construction of 600 block North Barclay Street, Sanitary Service Relocation, Contract No. 194, be adopted. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor, assigned No. 26760. 77829 - Moved by Burton, seconded by Wilharm that "Resolution ordering the construction of 600 block of North Barclay Street, Sanitary Service Relocation, Contract No. 194", be adopted. Ayes: Six. Absent: Roehr, Resolution adopted and upon approval by Mayor, assigned No. 26761. 77830 - Moved by Bowers, seconded by Wilharm that Proof of Publication of Notice to Contractors or Invitation for'Bids for construction of 600 block North Barclay Street, Sanitary Service Relocation, Contract No. 194, be received and placed on file. Motion carried. 77831 - Moved by Wilharm, seconded by Bowers that the following bids, be received, placed on file, Clerk instructed to open and read same and bids referred to the Engineers for checking. Name of Bidder Black Hawk Plumbing Motion carried. Amount of Bid $ 9,357 Sec. I 7,835 Sec. II 17,192 Total Certified Check $ 9,900.00 77832 - Moved by Dowie, seconded by Getty that the bid of Black Hawk Plumbing be referred to Engineers for review of bid and to bring his recommendation to Council on February 4, 1980. Motion carried. 77833 - Moved by Getty, seconded by Penaluna that Proof of Publication of Notice of Intention to issue Hospital Facility Revenue Bonds (Schoitz Memorial Hospital Project) (Not to exceed $4,750,000) in the City of Waterloo, Iowa, as published in Waterloo Courier on 1-11-80, be received and placed on file. Motion carried. 77834 - The Mayor announced this was the time and place for Public Hearing on the proposal to issue said bonds, as published in Waterloo Courier on 1-11-80, called for written and oral objections, and there were none. Moved by Wilharm, seconded by Burton that "Resolution relating to the Public Hearing and approving proceeding with the issuance and sale of not to exceed $4,750,000 Aggregate Principal amount of Hospital Facility Revenue Bonds (Schoitz Memorial Hos- pital Project) of the City of Waterloo, Iowa", be adopted. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor, assigned No. 26762. 77835 - Moved by Penaluna, seconded by Dowie that Proof of Publication of Notice of Intention to issue Hospital Facility Revenue Bonds (Schoitz Memorial Hospital Project) (Not to Exceed $2,000,000), in the City of Waterloo, Iowa, as published in Waterloo Courier on 1-11-80, be received and placed on file. Motion carried. 77836 - The Mayor announced this was the time and place for Public Hearing on the proposal to issue said bonds, as published in Waterloo Courier on 1-11-80, called for written and oral objections, and there were none. 77836 - (Continued) Moved by Wilharm, seconded by Penaluna that "Resolution relating to the Public Hearing and approving proceeding with the issuance and sale of not to exceed $2,000,000 Aggregate Principal amount of Hospital Facility Revenue Bonds (Schoitz Memorial Hos- pital Project) of the City of Waterloo, Iowa", be adopted. Resolution adopted and upon approval by Mayor, assigned No. 26763. 77837 - Moved by Dowie, seconded by Bowers that Proof of Publication of Notice of Public Hearing on Rezoning from "R-3" Multiple Family Residential District to "R-4" Multiple Family Residential District, 4/5 of an acre in part of Section 5 -88N -13W located east of West Fourth Street and 400 feet southwest of Pinehurst Lane, as published in Waterloo Courier on 1-11-80, upon the request of Charles Granger and Associates, the City Zoning Commission's recommendation and Council's own motion, be received and placed on file. Motion carried. 77838 - The Mayor announced this was the time and place for public hearing, as published in Waterloo Courier on 1-11-80, called for written and oral objections, and there were none. Moved by Wilharm, seconded by Getty that request of Charles Granger and Associates for the Council on its own motion to rezone from "R-3" Multiple Family Residential District to "R-4" Multiple Family Residential District four-fifths (4/5)of an acre, as shown on attached plat, located east of West Fourth Street and 400 feet southwest of Pinehurst Lane, and City Zoning Commission recommendation for approval, be received, placed on file, considered and passed for the first time. AVPs: Bowers, Dowie, Getty, Penaluna, Wilharm. Nay: Burton. Absent: Roehr. Resolution adopted and upon approval by Mayor, assigned No. 26764. 77839 - Russell Burt of the Safety Committee asked the Council to include in next year's sidewalk program the construction of sidewalks in the Cresthaven School area. He stated he has been contacted by many of the residents of this area who are concerned about the sidewalk problem and the safety of the school children. The Mayor stated to have sidewalks on one side of the street from Kimball to West 9th Street would cost roughly $30,000. He stated that the sidewalks in this area will be included in next year's sidewalk program. Funding of these sidewalks will have to be checked into as to method of assessment. Russell Burt requested the Council Members to attend the February 21, 1980 Safety Meeting as the needed sidewalks in this area will be discussed further. 77840 - A resident from the Cedar Terrace area brought to the Council's attention of the needed paving of the streets in this area. He stated that they have gotten sewer but felt that federal funds should now provide paving to this needed area. Mayor Rooff stated that in 1974 there was a hearing to provide storm sewer, sanitary sewer and paving but the people in this area objected to the paving as they thought the cost was to high. Discussion followed. 77841 - Moved by Dowie, seconded by Wilharm that offer of Craig or Judith K. Penrose to pur- chase the sixteen (16) feet wide North-South Alley located south of the extension of the North Lot Lines of Lots Eight (8) and Eleven (11) and north of the northerly right- of-way line of Janney Avenue, Block Fourteen (14), Hagerman Place, City of Waterloo, Black Hawk County, Iowa, with City's retention of utility easement", be received, placed on file. "A Resolution authorizing the sale of the sixteen (16) feet wide north - south alley, Janney Avenue, Block Fourteen (14), Hagerman Place, " be adopted. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor, assigned No. 26765. 77842 - Moved by Burton, seconded by Penaluna that communication from City Engineer, advising improvements required as a condition precedent to the final approval of Jane Second Addition, have been completed in substantial conformance with construction plans, standards, and requirements of his office, submitting Four Year Street Improvements and Two Year Sewer Improvements Maintenance Bonds, and recommending acceptance, be received, placed on file, approved and accepted with effective dates of said bonds being that of final approval. Motion carried. 77843 - Moved by Bowers, seconded by Burton that Preliminary Plat of General Lee's Addition with Deed of Dedication, Report of City Engineer, Report of Brice, Petrides and Associates re Impact on Sanitary Wastewater Collection System, Plan and Program Com- mission's Resolution of Approval and its recommendation for Council approval, be received, placed on file and "Resolution approving the Preliminary Plat of General Lee's Addition, Waterloo, Black Hawk County, Iowa", adopted. Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by Mayor, assigned No. 26766. Motion carried. 77869 - Moved by Bowers, seconded by Wilharm that report of City Attorney and list of bonds filed with Clerk through January 28, 1980, be received, placed on file and report and bonds approved.
