HomeMy WebLinkAbout01/07/80The Council of the City of Waterloo, Iowa met in Regular Session in Council Chambers in the City Hall at 7:00 P.M., on January 7, 1980. Mayor Rooff in the Chair. On roll call: Present: Bowers, Burton, Dowie, Getty, Penaluna, Roehr, Wilharm. Absent: None. Invocation by Council- man Wilharm. 77671 - Moved by Wilharm, seconded by Burton that the Agenda, as amended, for the Regular Session of January 7, 1980 at 7:00 P.M. be accepted and approved. Motion carried. 77672 - Moved by Penaluna, seconded by Dowie that the Minutes of the Special Session held on January 2, 1980 at 11:50 A.M. and the Organizational Council Meeting at 12:00 Noon, be approved. Motion carried. 77673 - Moved by Roehr, seconded by Bowers that proof of publication of Notice of Public Hearing on Re -Zoning, in the City of Waterloo, Iowa, as published in Waterloo Courier on 12/20/79, be received and placed on file. Motion carried. 77674 - The Mayor announced this was the time and place for public hearing, as published in Waterloo Courier on December 20, 1979, called for written and oral objections, and there were none. Moved by Roehr, seconded by Dowie that request of Capitol Savings and Loan Association for Council on its own motion to rezone from "R-3, R -P" Planned Residence District to "M -2,P" Planned Industrial District approximately 10 acres in part of Section 11 -89N -13W located east of Burton Avenue and 1/4 mile south of West Airline Hiway, as shown on attached plat, together with objection petition from Bruce Smith Realty Company, and City Zoning Commission's recommendation for approval, be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 77675 - Moved by Bowers, seconded by Burton that proof of publication of Notice of Public Hearing on Re -Zoning, in the City of Waterloo, Iowa, as published in Waterloo Courier on 12/20/79, be received and placed on file. Motion carried. 77676 - The Mayor announced this was the time and place for public hearing, as published in Waterloo Courier on December 20, 1979, called for written and oral objections, and there were none. Moved by Roehr, seconded by Bowers that request of Lewis W. McCallum for Council on its own motion to .rezone from "M-1" Light Industrial District to "R-2" One and Two Family Residence District all of Blocks 21 and L2, Auditor Rainbow's Plat of Maywood Second Filing, bounded by Osage Road, Fulton Street, Gilbert Street and Bishop Avenue, as shown on attached plat, for one and two family residence purposes, and City Zoning Commission's recommendation for approval, be received, placed on file, recommendation approved and passed for the first time. Ayes: Seven. Motion carried 77680 - The Mayor announced this was the time and place for public hearing, as published in Waterloo Courier on December 20, 1979, called for written and oral objections, and there were none. Moved by Dowie, seconded by B'urton'thatcommunication from Plan and Program Commission, transmitting site plan for Walgreen Drug Store and proposed rental area to be located in the Crossroads Shopping Center, and recommending approval, and on Council's own motion, be received, placed on file approved and passed for the first time. Ayes: Seven. Motion carried. 77681 - Moved by Roehr, seconded by Bowers that proof of publication of Notice of Public Hearing, in the City of Waterloo, Iowa, as published in Waterloo Courier on December 20, 1979, be received and placed on file. Motion carried. 77682 - The Mayor announced this was the time and place for public hearing, as published in Waterloo Courier on December 20, 1979, called for written and oral objections, and there were none. Moved by Dowie, seconded by Wilharm that communication from Plan and Program Commission, transmitting site plan for First Church of the Nazarene located west of Hammond Avenue and approximately 700' north of Wildwood Road, and recommending approval subject to certain conditions on parking, etc., and on Council's own motion, be received, placed on file, approved and passed for the first time. Ayes: Seven. Motion carried. 77683 - Mayor Rooff announced that the City will follow the odd -even street snow removal plan every time it snows this year. 77684 - Daniel Wee of 129 Park Lane presented a request to the City of Waterloo for the installation of a traffic signal on the corner of Park Lane and S. Kimball, and also the possibility of installing sidewalks on S. Kimball. Moved by Dowie, seconded by Getty that the request of Daniel Wee, be received, placed on file, and referred to Public Safety Committee for review. Motion carried. 77685 - Moved by Roehr, seconded by Wilharm that request of Charles Granger and Associates for the Council on its own motion to rezone from "R-3" Multiple Family Residential District to "R-4" Multiple Family Residential District four-fifths (4/5) of an acre, as shown on attached plat, located east of West Fourth Street and 400 feet SW of Pinehurst Lane, and City Zoning Commissions recommendation for approval, be received, placed on file, recommendation approved, date of hearing set as January 28, 1980 at 7:00 P.M. and Clerk instructed to publish notice. Motion carried. 77686 - Moved by Wilharm, seconded by Dowie that request of Craig E. or Judith K. Penrose for vacation, sale and conveyance of the alley described as the sixteen (16) feet wide North-South Alley located south of the extension of the north lot lines of Lots Eight (8) and Eleven (11) and north of the Northerly Right -of -Line of Janney Avenue, Block Fourteen (14), Hagerman Place for $143.60 plus costs, and Plan and Program Commission's recommendation for approval, with City's retention of utility easement, be received, placed on file, and "Resolution fixing the time and place of hearing as January 21, 1980 on proposal to vacate, sell and convey said alley to Craig E. or Juditly K. Penrose, adopted and Clerk instructed to publish Notice of Hearing. Ayes: Seven. Resolution adopted and upon ,approval of Mayor, assigned No. 26706. 77687 - Moved by Bowers, seconded by Burton that communication from Community Development Board, transmitting an Offer of Sale to the City of Waterloo from Mid West Pattern Company of real property at 84 West llth Street for the sum of $68,250.00 for Stage III -D Waterloo Flood Control Project, and recommending approval, be received, placed on file and "A Resolution accepting and approving certain offers to sell real property to the City and accepting and approving certain deeds", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26707. 77688 - Moved by Dowie, seconded by Bowers that communication from Community Development Board, transmitting an Offer of Sale to the City of Waterloo from Perry K. & Dorothy Miller of real property at 4742 Hammond Avenue for the sum of $19,525.00 for right- of-way construction for paving of Shaulis Road, and recommending approval, be received, placed on file, and "A Resolution accepting and approving certain offers to sell real property to the City and accepting and approving certain deeds", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26708. 77689 - Moved by Penaluna, seconded by Wilharm that City Treasurer's Statement for December, 1979, showing fund balance 12/1/79 $17,683,360.22, + Receipts - Taxes $155,102.79, + Receipts - City Clerk $699,404.32, + Receipts - City Treasurer $1,517,914.61, + Receipts - Transfers $130,595.57, - Disbursements $4,249,123.90, Balance on Hand 12/31/79 $15,937,253.61, be received, placed on file, and approved. Motion carried. 77690 - Moved by Burton, seconded by Wilharm that communication from Plan and Program trans- mitting a request from several property owners in the area of Fletcher Avenue, Reber Avenue and U.S. Highway No. 63 to rezone a parcel bounded by these streets from "S-1" Shopping Center District to "R-1" Residential District. One of the major concerns of the Zoning Commission was the regulations regarding "S-1" Districts and establishing a timetable for the completion of the shopping center and to grant one year from today to come into compliance with "S-1" or subject to rezoning. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26709. 77691 - Moved by Roehr, seconded by Dowie that communication from Plan and Program transmitting bid of Russ Folkers in the amount of $13,750 for approximately 11 acres in parts of Lots 1 and 2, and Lots 3, 4, 5, 6, and 7, and NWly-SEly vacated alley, all in Block 2, Riverside Addition, subject to easements was rejected based on the $33,500 IPS 1974 appraisal, be received, placed on file, date of new hearing set as January 21, 1980, and Clerk instructed to publish notice. Ayes: Seven. Resolution addpted and upon approval by Mayor, assigned No. 26710. January 7, 1980 77692 - Moved by Roehr, seconded by Burton to set a minimum bid price of $22,500 for the bidding of approximately 12 acres in parts of Lots 1 and 2, and Lots 3, 4, 5, 6 and 7, and NWly-SEly vacated alley, all in Block 2, Riverside Additon, subject to ease- ments. Ayes: Seven. Motion carried. 77693 - Moved by Dowie, seconded by Penaluna that construction plans for paving and storm sewer facilities serving Southridge Sixth Addition as submitted by Harold F. Michels, and City Engineer's recommendation for approval, be received, placed on file and approved. Ayes: Seven. Motion carried. 77694 - Moved by Getty, seconded by Bowers that "Ordinance vacating a portion of Litchfield Avenue", be recieved, placed on file, considered and passed for the third time, as amended, December 26, 1979, and now placed on its final adoption. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 3064. 77695 - Moved by Wilharm, seconded by Roehr that "Resolution authorizing the sale and convey- ance of a portion of Litchfield Avenue, for $1,585.72 plus costs, to B. Schultz and Company and The Lloyd Kreger Estate, and directing and authorizing the Mayor and City Clerk to execute and deliver a Quit Claim Deed for said property", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26711. 77696 - Moved by Penaluna, seconded by Dowie to return offer and check of Marion -Hutchison, presented by Atty. Kepford on portion of Litchfield Avenue. Ayes: Seven. Motion carried. 77697 - Moved by Dowie, seconded by Burton that "Resolution designating Depository Banks and fixing the maximum amounts of deposits", be received, placed on file, and adopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 26712. 77698 - Moved by Roehr, seconded by Wilharm that "Resolution fixing a date for hearing on proposed Hospital Facility Revenue Bonds, Series 1980A (Schoitz Memorial Hospital Project), be received, placed on file, and adopted and date of hearing set as January 28, 1980 at 7:00 P.M. in the Council Chambers in City Hall, (Not to exceed $2,000,000.00) Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26713. 77699 - Moved by Dowie, seconded by Bowers that "Resolution fixing a date for hearing on proposed Hospital.Facility Revenue Bonds, Series 1980B (Schoitz Memorial Hospital Project), be received, placed on file, and adopted and date of hearing set as January 28, 1980 at 7:00 P.M. in the Council Chambers in City Hall (Not to exceed $4,750,000.00) Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 26714. 77700 - Moved by Burton, seconded by Bowers that completion report and recommendation of acceptance for Contract No. 166, Section I and City Engineer's recommendation for acceptance, be received, placed on file, and "Resolution approving the completion report and recommendation of acceptance for work and materials furnished by Hurst Excavating, Inc. for F.Y. 1979 Paving Program No. 1, Contract No. 166, Section I be adopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 26715. 77701 - Moved by Bowers, seconded by Burton that completion report and recommendation of acceptance for Contract No. 166, Section III and City Engineer's recommendation for acceptance, be received, placed on file, and "Resolution approving the completion report and recommendation of acceptance for work and materials furnished by Aspro, Inc. for F.Y. 1979 Paving Program No. 1, Contract No. 166, Section III be adopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 26716. 77702 - Moved by Burton, seconded by Penaluna that following requests for permission to attend functions, with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Assistant Police Chief to Southern Police Institute for Training, Louisville, Kentucky, January 21, thru February 1, 1980, $865.00 plus use of City vehicle (75% to be reimbursed by NE Iowa Crime Commission) Ayes: Seven. Motion carried. 77706 - Moved by Wilharm, seconded by Getty that the Council adjourn to meet as Board of Health. Motion carried. Moved by Burton, seconded by Getty that communication from Health & Sanitation Director to renew the "Memorandum of Understanding", between the Iowa Department of Agriculture and the City of Waterloo, until January 1, 1981, for inspecting all food establishments, including Hotels, Motels, & Vending Machines, be received, placed on file, and approved. Moved by Bowers, seconded by Wilharm that the following applications, together with bonds and fees, for City license to operate a Mobile Homo Park at the locations designated, be received, placed on file and approved for issuance of City license: C & M Mobile Home Villa, 2947 Independence Avenue Sky View Terrace, 2754 Independence Avenue Southview Estates, 3451 E.
