HomeMy WebLinkAbout12/18/1973NOTICE OF SPECIAL MEETING OF CITY COUNCIL, CITY OF WATERLOO, IOWA TO: CITY COUNCILMEN OF THE CITY OF WATERLOO, IOWA: You are hereby notified that a Special Meeting of the City Council of the City of Waterloo, Iowa, will be held at the Schoitz Room in the Waterloo Recreation Center Building in the City of Waterloo, Iowa, at 7:30 o'clock P.M. on Tuesday, December 18, 1973, and that said Special Meeting is being called for the purpose of holding a public hearing on the proposed Resolution of Necessity for the 1973 #1 - Waterloo, Iowa, Sanitary Sewer Program, Contract #175. Absent Councilman Lichty. 65031 - Moved by Morrissey, seconded by Mabrey that the Copies of the Call for the special meeting be received and placed on file. Motion carried. 65032 - Moved by Cavanaugh, seconded by Dykeman that the proof of publication of the Notice to Property Owners of hearing on proposed Resolution of Nec- essity for certain sewer improvements in the City of Waterloo, Iowa, known as the 1973 #1 - Waterloo, Iowa, Sanitary Sewer Program, Contract No. 175, be received and placed on file. Motion carried 65033 - The Mayor then called for objections to the adoption of the proposed Resolution of Necessity for the construction of certain sewer improve- ments in said Municipality, pursuant to notice of the time and place of hearing duly published and mailed, and pursuant to prior action of said Council; and announced to those present at said Council meeting that both written and oral objections would be received and considered by this Council at this time. The Deputy Clerk reported no written objections had been filed. 2 65033 - (Continued) Oral objections were made by: 1. Bob Weston, 822 Belle Street, 2. Craig Cose, 890 Belle Street, 3. Merle Elliott, 1913 Cedar Terrace Drive, for Lot 105, Cedar Terrace 3rd Addition, for use as street, 4. William F. Bellows, 3429 Cedar Terrace Drive Speaking in support was 1. George Orth, 105 Oakridge Road Moved by Dykeman, seconded by Keller that the objections and statement of support be received and placed on file. Motion carried. 65034 - After reviewing all the objections received, the Council found and deter- mined that no remonstrance, pursuant to the provisions of Section 391A.14 of the Code of Iowa, 1973, was filed with the Council, pertaining to any of the sewer improvements proposed to be constructed as set out in said Resolution of Necessity as originally proposed. Moved by Keller, seconded by Dykeman that Resolution No. 23008, overruling the objections with the exception of Lot 105, Cedar Terrace Third Addi- tion, dedicated street, to the 1973 #1 - Waterloo, Iowa, Sanitary Sewer Program, Contract No. 175, be adopted. On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Lichty. Mayor declared the resolution adopted. 65035 - Moved by Mabrey, seconded by Miller that Resolution No. 23009, being a Resolution amending Resolution of Necessity, be adopted. On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Lichty. Mayor declared the resolution adopted. 65036 - Moved by Miller, seconded by Keller that Resolution No. 23010, being a Resolution adopting Resolution of Necessity, as amended, for the 1973 #1 Waterloo, Iowa, Sanitary Sewer Program, Contract No. 175, be adopted. On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Lichty. Mayor declared the resolution adopted. 65037 - Moved by Keller, seconded by Miller that Resolution No. 23011, being a Resolution directing the Engineer to prepare detailed plans and specifi- cations and directing Attorney to prepare form of contract and notice to bidders on the "1973 #1 - Waterloo, Iowa, Sanitary Sewer Program, "-Con- tract No. 175,'I be adopted. On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay. None. Absent: Lichty.
