The Council of theCity of Waterloo, Iowa, met in Special Session in the Council
Chambers in City Hall at 7:00 P.M. on March 11, 1980, pursuant to the following
call:
TO CITY COUNCILMEN OF THE CITY OF WATERLOO, IOWA:
You are hereby notified that a Special Meeting of the City Council of the City
of Waterloo, Iowa, will be held in the Council Chambers in City Hall, 715
Mulberry Street, in the City of Waterloo, Iowa, at 7x00 P.M. on Tuesday,
March 11, 1980, and that said Special Meeting is being called for the purpose
of a hearing and consideration of the Fiscal 1980 Budget.
You are further notified that no other business except the above will be trans-
mitted at said Meeting.

78114 - Moved by Roehr, seconded by Dowie that Copies of the Call for the Spec-
ial Meeting of March 11, 1980 at 7:00 P.M. in the Council Chambers, in
the City Hall, be received and placed on file. Motion carried.
78115 - Moved by Wilharm, seconded by Burton that Proof of Publication of the
Notice of Hearing on the Budget Estimate for the 12 month period of
July 1, 1980 through June 30, 1981 for the City of Waterloo, Iowa,
be received and placed on file. Motion carried.
78116 - Mayor Rooff announced the time had arrived to hear objections, if
any, and called for written and oral objections.
78117 - Raymond Milot of 617 Keystone asked why can't garbage fees be cut
in half if garbage pick-up is being cut in half.
Mayor Rooff stated that they would have to see what the history is
and if the fee goes below $3.00 we could then re -adjust the cost.
Moved by Burton, seconded by Dowie that the above presentationbe re-
ceived and placed on file. Motion carried.
78118 - After giving opportunity for all desiring to be heard, it was moved
by Wilharm, seconded by Getty that "A Resolution adopting the annual
budget for the Fiscal Year ending June 30, 1981, as amended, for the
the City of Waterloo, Iowa", be adopted as set forth in the Budget
Summary Certificate and in the detailed budget in support thereof, and
the City Clerk instructed to file the adopted Budget with the County
Auditor as provided by law, said Budget being in words and figures
as shown on the following page . . .

the approval of Plans, Specifications, etc. for the Repairs to
Eleventh Street and Falls Avenue Bridges, Contract No. 16, be
adopted.. Ayes: Six,Absent: Dowie. Resolution adopted and upon
approval by Mayor, assigned No. 26872.
78130 - Moved by Penaluna, seconded by Roehr that "Resolution ordering
the Repairs to Eleventh Street and Falls Ave Bridges, Contract
No. 16", be adopted. Ayes: Six, Absent: Dowie. Resolution
adopted and upon approval by Mayor, assigned No. 26873.

78131 - Moved by Roehr, seconded by Burton that Proof of Publication
of Notice to Contractors or Invitation for Bids for Repairs to
Eleventh Street and Falls Avenue Bridges, Contract No. 16, be
Received and placed on file. Motion Carried.
78132 - Moved by Bowers, seconded by Burton, that the following bids
be received, placed on file, Clerk instructed to open and read
same and bids referred to the Engineers for checking and report
back:

78133 - Moved by Burton, seconded by Bowers that Proof of publication of
notice of public hearing on adoption of "An Ordinance Amending the
Subdivision Ordinance (No. 2997) by Repealing Subsection 2 of
Section 3.3 in its entirety and enacting in lieu thereof new Sub-
section 2 of Section 3.3, as published in Waterloo Courier on
2-29-80, be received and placed on file. Motion carried.
78134 - This being the time and place of hearing, the Mayor called for
written and oral objections, and there were none.
Moved by Bowers, seconded by Burton that "Resolution transmitting
a change in the City's Subdivision Ordinance No. 2997, as
amended regarding the maintenance of improvements by striking
Section 3.3, Subsection 1 and substituting the following: the
applicant, for each subdivision submitted, shall be required
to furnish one good and sufficient Maintenance Bond for the
installation of all public improvements within the subdivision,
including streets, curbs and gutter, sanitary sewer and storm sewer,
according to City specifications and for the repairs necessitated
by defects in material or workmanship during a time period not to
exceed two (2) years from and after acceptance of the completion
of the improvements by the City Council. Said bond shall be in
the amount considered adequate by the City Engineer and in a
form satisfactory to the City Attorney", be adopted and passed
for the first time. Ayes: Six, Absent: Dowie. Resolution adopted
and upon approval by Mayor, assigned No. 26874.
78135 - Moved by Roehr, seconded by Bowers, that Proof of Publication
of Notice of Public Hearing on Rezoning from "A-1" Agricultural
District to "R - 2" One and Two Family Residential District
approximately nine (9) acres of land located east of Hammond
Avenue and approximately 1,000 feet north of U. S. Highway 412,
as published in Waterloo Courier on 2-29-80, upon the request
of City Zoning Commission's recommendation and Council's own
motion, be received and placed on file. Motion carried.

78144 - Moved by Burton, seconded by Penaluna that communication from
Community Development Board, transmitting an Offer of Sale to
the City of Waterloo from Eugene C. and Aurelia C. Harringa, a
portion of the property located on Shaulis Road (the south 10 feet
in even width of Lot 7, Guernsey's Orange View Plat. Waterloo,
Black Hawk County, Iowa approximately 949 square feet) for the
sum of $100.00 for the construction of right-of-way for paving of
Shaulis Road and recommending approval, be received, placed on
file and "A Resolution accepting and approving certain offers to
sell real property to the city and accepting and approving
certain deeds", adopted. Ayes; Six, Absent; Dowie. Resolution
adopted and upon approval by Mayor, assigned No. 26877.
78145 - Moved by Bowers, seconded by Burton, that communication from
Community Development Board, transmitting an Offer of Sale to
the City of Waterloo from Guy E. and Marlys Lewis, a portion of
the property located on Shaulis Road (the west 50 feet of the north
17 feet of the south 50 feet in even width of the following
described property: the west one hundred forty (140) feet of
the east two hundred eighty (280) feet in even width of the south
two hundred seventy-eight (278) feet in even width of the south-
east quarter of the southwest quarter of Section No. Eleven (11),
Township No. Eighty-eight (88) north, Range No. thirteen (13) west
of the fifth principal meridian, Black Hawk County, Iowa) for
the sum of $100.00 for the construction right-of-way for paving
of Shaulis Road and recommending approval, be received, placed
on file, and "A Resolution accepting and approving certain offers
to sell real property to the city and accepting and approving
certain deeds", adopted. Ayes; Six, Absent;Dowie. Resolution
adopted and upon approval by Mayor, assigned No. 26878.
78146 - Moved by Roehr, seconded by Getty, that request of Lloyd R. Marlatt
for vacation, sale and conveyance of 50 foot right of way of
Ogden Avenue described as the west one-half of that portion of
Ogden Avenue described as lying north of the northerly right-of-way
line of Fulton Street and south of the southerly right-of-way
line of Ann Street, located in -the City of Waterloo, Black Hawk
County, Iowa and request of Ronald L. and Charlene Ohrt for
vacation, sale and conveyance of 50 foot right-of-way of Ogden
Avenue described as the east one-half of that portion of Ogden
Avenue described as lying north of the northerly right-of-way
line of Fulton Street and south of the southerly right-of-way of
Ann Street, located in the City of Waterloo, Black Hawk County,
Iowa for $700.00 plus costs, and Plan and Program Commission's
recommendation for approval, with City's retention of utility
easement, be received, placed on file, and "resolution fixing
the time and place of hearing as 4-7-80 on proposal to vacate,
sell and convey said alley to Lloyd R. Marlatt and Ronald L.
and Charlene Ohrt, adopted and Clerk instructed to publish

and upon approval by Mayor, assigned No. 26879.
78147 - Moved by Burton, seconded by Bowers, that the Minutes of the
Regular Meeting of the Community Development Board held
February 12, 1980 at 7:00 P.M., be received, placed on file
and approved. Motion carried.
78148 - Moved by Roehr, seconded by Burton that revised construction
plans for storm sewer facilities serving Aerostat Heights
as submitted by Wayne Claassen Engineering & Surveying, Inc.,
Waterloo, Iowa, and City Engineer's recommendation for approval,
be received, placed on file and approved. Motion carried.
78149 - Moved by Bowers, seconded by Roehr, that communication from
Personnel Director, transmitting Bargaining Agreement with
Firefighters Local #66 dated March 13, 1980, for the period of
July 1, 1980 to June 30, 1981, be received, placed on file and
"Resolution approving the agreement with Firefighters Local #66,
and authorizing the Mayor to sign and execute same in behalf of
the City of Waterloo, Iowa," adopted. Ayes; Six, Absent; Dowie.
