Members present: Seeber, Wright, Lichty, Angel, Miller, Budak and
Mayor McKinley. Absent: Dowie.
Larry P. Burger, Clerk/Auditor, distributed a revised copy of the
beer garden/outdoor cafe guidelines. He stated that several changes
had been made in the guidelines based on the City Council Work
Session of April 28, 1986. The major changes include: (1) that the
operation of beer gardens/outdoor cafes will cease operation at 10:00
p.m. Sunday through Thursday and at 11:00 p.m. Friday and Saturday;
(2) that the applicant will attach a listing of all the property
owners within 250 feet of the licensed premises; and (3) that beer
gardens/outdoor cafes will be screened on all sides with a fence or
other suitable permanent barrier of not less than six feet nor more
than eight feet in height and inaccessible except through the normal
entrances/exits.
Mr. Burger indicated that these guidelines would be adopted by
resolution of the Council rather than an ordinance. There was some
question as to whether or not a resolution could be enforced by the
Police Department if necessary. It was indicated that a resolution
would allow its enforcement. It was the consensus of the committee
that an emergency exit should be maintained in the beer
garden/outdoor cafe area. Mr. Burger also briefly outlined the
requirements for temporary beer gardens/outdoor cafes.
With the amendments mentioned above the guidelines will be presented
at the Council Meeting of May 12, 1986 in the form of a resolution.
With no further business before the Committee, the meeting was
adjourned.
