HomeMy WebLinkAbout08/26/91CITY COUNCIL WORK SESSION August 26, 1991 5:30 p.m. Large Conference Room Members present: Mayor McKinley, Brown, Dell, Buck, Budak, Angel and Fox. Members absent: Wright. The Agenda, as proposed, was approved. Mayor McKinley stated that the purpose of the meeting was to discuss alternatives to controlling access to the Riverview or Mitchell Avenue sandpit area. John Meyer, Public Works Director, provided information. relating to access to the area, private versus public ownership of lands, and lake areas including the previously operated sand and graveling mining operations in the area. Mr. Meyer outlined four possible alternatives and associated costs. 1. Construction of farm fence along Easton Avenue from the Water Pollution Control Plant, westerly to the mill race area, then northerly to Mitchell Avenue. Fencing would consist of chain link and farm fencing with gates at Mitchell and Hawthorne. Signs would also be posted along the perimeter. Estimated cost of this alternative is $45,000. 2. This fencing alternative would be the same as No. 1 described above except that no chain link would be used in any portion of the fence. Fencing would consist of a farm -type fencing with gates at Mitchell and Hawthorne. The estimated cost of this alternative is $33,000. 3. Place signs along Easton Avenue, Mitchell Avenue and Hawthorne Street designating the access control. Estimated cost of this signing alternative is $2,000. 4.. This alternative would include placing a gate at Mitchell Avenue and Hawthorne Street. Signs would be installed indicating hours open and closed to the public. The estimated cost of this alternative is $5,000. Discussion was heard concerning who would be responsible for opening and closing the gates. Mr. Meyer stated that Public Works personnel would be available to open the gates but that someone with law enforcement capabilities should close the gates. Chief Koehrsen stated that it would be the responsibility of a west -side police car to sweep the area, issue tickets if necessary, and close the gates. The city could expect to experience vandalizing of the signs. Spiked type gate fencing exists in several locations. Discussion was heard concerning signing the premises only without benefit of fence or gating. It was explained that in order to enforce the criminal trespass section of the State Code, it would be necessary to adopt this section by reference. This would allow all fines and fees collected to be credited to the Police Department budget. A separate city ordinance would need to be adopted City Council Work Session August 26, 1991 Page 2 establishing the hours of public access to the area. After discussion, it was the consensus of the council members present that this item be referred to the full city council for action on Tuesday, September 3, 1991, with a recommendation that alternative No. 4 be adopted, that an ordinance be drawn establishing criminal trespass as a city offense and establishing the hours of closure to the public.
