HomeMy WebLinkAbout08/17/92CITY COUNCIL WORK SESSION August 17, 1992 6:15 p.m. Large Conference Room Roll call: Mayor Manning, Angel, Buck, Budak, Dell, Lemke, Wright and Fox. The Agenda, as proposed, was approved. The purpose of the meeting was to discuss the appeal of Chris and Angie Blumenstein to the decision of the Waterloo Historic Preservation Commission regarding siding on their home at 305 Prospect Avenue. Bob Stevenson, City Planner, noted that the Historic Preservation Commission had reviewed their request on June 11, 1992, and determined that the vinyl siding was not consistent with the Secretary of the Interior Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings. Chapter 18i of the Waterloo Code of Ordinances states that the appeal process is through the city council. If the parties remain not satisfied with this decision, they must appeal to the District Court within 60 days of the council's action. Mr. Stevenson stated that as an appeal body, the city council may not consider any other evidence than what was considered by the Historical Commission. The council may only reverse this decision if it is determined that the commission acted in an arbitrary or capricious manner in applying the rules and regulations of the historic district. Kay Kober, attorney representing both Sturtz Contractors and the owners of property, stated that the proposed siding would not make any material change to the structure of the house and that it would be a good improvement for the neighborhood. City staff reported that a building permit had been issued to the contract gh a Friday and that a stop work order was placed on the job on the following Monday. It was also reported that city staff had told the property owners that the city may have insurance to cover such an act but later determined that there was a $10,000 deductible. No official action was taken by the council at this meeting concerning this item. The meeting was adjourned at 6:40 p.m. Larry P. Burger City Clerk/Auditor
