Moved by Jordan, seconded by Murphy to approve the agenda as proposed. Ayes: Seven. Motion carried. Personnel Director Jim Rodemeyer reviewed the proposed Accident Review Policy with the city council. The policy has been drafted as a result of concerns raised about damage to city equipment and standardizing a written policy for a comprehensive risk management program. The policy establishes the formation of an Accident Review Committee whose primary function will be to review accidents involving city employees operating city equipment. Accidents will be evaluated on whether they were preventable and recommendations will be made for correction actions to be implemented by department heads. The committee is comprised of the Personnel Director, City Clerk, Police staff, Fire staff, Parks Director and Central Garage Superintendent. Accidents will be reviewed based on information contained in police department investigations, supervisor reports or employee statements. The committee will review the circumstances and determine whether an accident is preventable based on criteria outlined in the Accident Review Policy. The committee will draft a written recommendation declaring the accident as preventable or non -preventable and make any recommended correction to be taken by the department. The department head's will be expected to implement the recommendations of the committee and report back on the appropriate action which has been taken. Decisions may be challenged by an employee and they will be granted a hearing. Councilperson Getty recommended that all gender references be removed from Section II, Scope. Krizek recommended that a member of council be a representative on the committee also. Anders and Getty agreed with Krizek's recommendation. Councilperson Collier raised a concern that the policy would encourage police investigations to place blame on a citizen rather than facing possible disciplinary action. He is concerned that the policy would encourage false reporting. Councilperson Anders supports the review of all equipment repair or failure to distinguish cases of negligence. He asked that department heads be directed to report all cases to the committee for determination on causes of equipment failure. Rodemeyer will make the changes as requested by the council and forward a revised policy to full council for approval at a later date. With no further discussion, it was moved by Getty, seconded by Jordan to adjourn the meeting at 6:05 p.m. Ayes: Seven. Motion carried. Susan Fangman City Clerk
