The Council of the City of Waterloo, Iowa, met in Regular Session at
City Hall Council Chambers, Waterloo, Iowa at 7:00 p.m. on December
17, 1984. Mayor Bowers in the Chair. Roll call: Getty, Lichty,
Penaluna, Klinger, Seeber, Dowie and Wright.
Invocation by: Seeber.
86735 - Moved by Getty, seconded by Seeber
that the Agenda, as amended for the Regular Session of December 17,
1984, at 7:00 p.m., be accepted and approved.
Potion carried.
86736 - Moved by Lichty,, seconded by Dowie
that the Minutes of the Regular Session held December 10, 1984, at
7:00 p.m., be approved.
Motion carried.
HEARINGS
86737 - Moved by Wright, seconded by Seeber
that proof of publication of notice of public hearing of issuance
not to exceed $10,000,000 Industrial Development Revenue Bonds,
Series 1984 --Majestic Leasing Inc., as published in the Waterloo
Courier on November 30, 1984, be received and placed on file.
Motion carried.
86738 - HOLD HEARING --This being the time and place of public hearing, the
Mayor called for oral and written objections.
Robert Larson asked where the money for the project was coming from.
W. David Tyler, City Attorney, stated that in speaking with counsel
for said project, Mr. Don Gottschalk reported that the entire
financing package has not been completed and suggested that the
Council recess said hearing until such time as this
information is available.
It was reported that the bonds are not a financial obligation to the
City and that approval by the City merely guarantees a reduced tax
rate for the bond buyers.
Moved by Penaluna, seconded by Dawie
that said hearing be recessed until such time as the appropriate
financing package for said project is completed. Ayes: Seven.

that proof of publication of notice of public hearing, for
Applications to Department of Housing and Urban Development for
Additional Units Section 8 Housing --Waterloo Housing, Authority, as
published in the Waterloo Courier on December 4, 1984, be received
and placed an file.

Mayor called for written and oral objections and there were none.

that "Resolution authorizing said applications", be adopted. Ayes:
Seven.
Resolution adopted and upon approval by Mayor assigned No. 1984-568.
86741 - Moved by Getty, seconded by Klinger
that proof of publication of notice of public hearing to vacate &
convey portion of Northland Avenue lying between Lucas and Midland
Streets --Orval Eiler, as published in the Waterloo Courier on
November 30, 1984, be received and placed on file.
Motion carried.
86742 - HOLD HEARING --This being the time and place of public hearing, the
Mayor called for oral and written objections.
Orval Eiler, 741 Hall Street, the requestee, spoke in support of the
vacation. With the additional property, he would develop it and
adjacent property for park purposes.
Leroy Bell, representing Apostolic Pentecostal Church of Waterloo
stated that the church would purchase their one half of the
right-of-way (or twenty-five (25) feet) if the entire portion of
Northland Avenue from Midland to Lucas Street was offered for sale.
Bob Stevenson, City Planner, stated that the Planning, Programming
and Zoning Commission recommended denial because it was felt that the
street should be retained for future street circulation and that past
policy of the Commission has been not to vacate only a portion of a
street and consequently, dead-end a street.
Moved by Klinger, seconded by Dome
that the above remarks and the recommendation of denial of the
Planning, Programming and Zoning Commission be received and placed on
file.

that "an Ordinance vacating portion of Northland Avenue lying between
Lucas and Midland Streets", be received, placed on file and denied.
Ayes: Seven.
Motion carried.
PETITIONS FROM PUBLIC
86744 - Bob Stevenson, City Planner, reported that the Planning, Programming
and Zoning Commission recommended denial because the property did not
meet the minimum City standards of asphalt surfacing.
Moved by Klinger, seconded by Dowie
that communication from Planning, Programming and Zoning Commission
transmitting request of Edward Herold to dedicate certain property to
the City of Waterloo for public street purposes, (near intersection
of U.S. Highway 20 and Northey Street), together with recommendation
of denial be received, placed on file and request denied. Ayes:
Seven.

that petitions from downtown property owners requesting
reestablishment of the Downtown Self Supported Municipal Improvement
District be received, placed on file, and referred to the Planning,
Programming and Zoning Commission and "Resolution setting date of
hearing as January 21, 1985, at 7:00 p.m. in the City Hall Council
Chambers on said reestablishment", be adopted and Clerk/Auditor
instructed to publish notice of hearing accordingly. Ayes: Seven.
Resolution adopted and upon approval by Mayor assigned No. 1984-569.
86746 - Moved by Penaluna, seconded by Getty
that communication from Planning, Programming and Zoning Commission
transmitting request of National Cattle Congress for site plan review
of Greyhound Racing Track located northwest of intersection of U.S.
Highway 63 and relocated Highway 20, together with recommendation of
approval be received, placed on file and "Resolution setting date
of hearing as December 26, 1984, at 7:00 p.m. in the City Hall
Council Chambers on above request", be adopted and Clerk/Auditor
instructed to publish notice of hearing accordingly. Ayes: Seven.

1984 be received and placed on file.

that the lease agreement with National Cattle Congress for McElroy
Auditorium ending May 30, 1986 be deleted from the consent agenda and
acted upon separately.
Motion carried.
86750 - Discussion was heard on whether the Cattle Congress Board of
Directors had mutually agreed to the lease contents.
Mayor Bowers stated that this proposed lease would be for the period
ending May 30, 1986 and would require each party to pay one half of
the cost of structural repairs.
Moved by Klinger, seconded by Dowie
that the Lease Agreement with National Cattle Congress for McElroy
Auditorium for period ending May 30, 1986, be received, placed on
file, and 'Resolution approving same", be adopted and Mayor and
Clerk/Auditor authorized to execute same. Ayes: Penaluna, Klinger
and Dowie. Nays: Getty, Lichty, Seeber and Wright.

that communication from City Engineer transmitting Change Order No. 6
for East Park Avenue Improvements, Contract No. 263 for increase of
$285.00, together with recommendation of approval be received, placed

that "Resolution reinstating truck embargo on W. 4th Street between
San Marnan Drive and Shaulis Road", be adopted. (See Resolution No.
